The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Financial Framework Legislation
5
Amendment Act (No. 2) 2013.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

(1) Each Act, and each set of regulations, that is specified in a

Schedule to this Act is amended or repealed as set out in the

applicable items in the Schedule concerned, and any other item in a

Schedule to this Act has effect according to its terms.

(2) The amendment of any regulation under subsection (1) does not
12
prevent the regulation, as so amended, from being amended or
13
repealed by the Governor-General.

(1) If:

(a) apart from this subsection, the Commonwealth does not have

power to:

(i) form a company; or

(ii) participate in the formation of a company; and

would be a company:

(i) that is specified in the regulations; and
20
(ii) whose objects or proposed activities are specified in the
21
regulations;
22
the Commonwealth has power to:
23
(c) form the company; or
24
(d) participate in the formation of the company;
25
as the case may be.

Acquisition of shares in company etc.

(2) If:

(a) apart from this subsection, the Commonwealth does not have

power to:

(i) acquire shares in a company; or

(ii) become a member of a company;

in circumstances that would result in the company becoming

a Commonwealth company; and

(b) both:

(i) the company is specified in the regulations; and
8
(ii) the company's objects or proposed activities are
9
specified in the regulations;
10
the Commonwealth has power to:
11
(c) acquire shares in the company; or
12
(d) become a member of the company;
13
as the case may be, in circumstances that would result in the
14
company becoming a Commonwealth company.

Finance Minister's power
16
(3) A power conferred on the Commonwealth by subsection (1) or (2)
17
may be exercised on behalf of the Commonwealth by the Finance
18
Minister.

Executive power of the Commonwealth
21
(4) This section does not, by implication, limit the executive power of
22
the Commonwealth.

Definitions

(5) In this section:

acquire includes acquire by subscription.

Commonwealth company has the same meaning as in the

Commonwealth Authorities and Companies Act 1997.

4 Transitional

(1)
This item applies to action taken, or purportedly taken, by the
6
Commonwealth before the commencement of this item if, assuming
7
that:
8
(a) both:
9
(i) section 39B of the Financial Management and
10
Accountability Act 1997 as amended by this Schedule;
11
and
12
(ii) the amendments of the Financial Management and
13
Accountability Regulations 1997 made by Schedule 2 to
14
this Act;
15
had been in force when the action was taken or purportedly
16
taken; and
17
(b) if the name of a company changed after the action was taken
18
or purportedly taken--a reference in Schedule 1B to the
19
Financial Management and Accountability Regulations 1997
20
to the company under its new name were read as a reference
21
to the company under its former name;
22
the action would have been authorised by subsection 39B(1) or (2) of
23
the Financial Management and Accountability Act 1997 as amended by
24
this Schedule.

(2)
The action has, and is taken to have had, effect, after the
26
commencement of this item, as if it had been taken under
27
subsection 39B(1) or (2), as the case may be, of the Financial
28
Management and Accountability Act 1997 as amended by this Schedule.

1061PAAA Recoverable payments
7
(1) If, apart from this subsection, the Commonwealth does not have
8
power under the social security law to pay an amount (the relevant
9
amount) to a person (the recipient) purportedly as an Australian
10
Government Disaster Recovery Payment, then the Commonwealth
11
may pay the relevant amount to the recipient.

Recovery
13
(2) If a payment is made under subsection (1) to the recipient, the
14
relevant amount:
15
(a) is a debt due to the Commonwealth by the recipient; and
16
(b) may be recovered by the Secretary, on behalf of the
17
Commonwealth, in a court of competent jurisdiction.

1061PAAB Recoverable death payments
21
(1) If, apart from this subsection, the Commonwealth does not have
22
power under the social security law to pay an amount (the relevant
23
amount) in any of the following circumstances:
24
(a) the relevant amount is deposited to an account kept in the
25
name of a deceased person;
26
(b) the relevant amount is deposited to an account kept in the
27
names of a deceased person and another person;
28
(c) the relevant amount is paid by way of a cheque made out to a
29
deceased person;

the Commonwealth may pay the relevant amount in the

circumstances mentioned in paragraph (a), (b) or (c), so long as:
2
(d) on the last day on which changes could reasonably be made
3
to the payment of the relevant amount, no Department
4
official knew that the deceased person had died; and
5
(e) apart from this subsection, the relevant amount would have
6
been payable as an Australian Government Disaster
7
Recovery Payment to the deceased person if the deceased
8
person had not died.

(2) If a payment is made under subsection (1), the relevant amount is
11
taken to have been paid to the deceased person's estate.

Recovery
13
(3) If a payment is made under subsection (1), the relevant amount:
14
(a) is a debt due to the Commonwealth by the legal personal
15
representative of the deceased person; and
16
(b) may be recovered by the Secretary, on behalf of the
17
Commonwealth, in a court of competent jurisdiction.

1061PAAC Reports about recoverable payments and recoverable
21
death payments

(1) During the applicable publication period for a reporting period, the
23
Secretary must cause to be published, in such manner as the
24
Secretary thinks fit, a report that sets out:
25
(a) both:
26
(i) the number of payments made under
27
subsection 1061PAAA(1) during the reporting period;
28
and
29
(ii) the total amount of those payments; and
30
(b) both:
31
(i) the number of payments made under
32
subsection 1061PAAB(1) during the reporting period;
33
and
34
(ii) the total amount of those payments.

(2) However, a report is not required if:
1
(a) the number mentioned in subparagraph (1)(a)(i) is zero; and
2
(b) the number mentioned in subparagraph (1)(b)(i) is zero.

Deferred reporting
4
(3) Paragraph (1)(a) of this section does not require a report to deal
5
with a payment unless, before the preparation of the report, a
6
Department official was aware the payment was made under
7
subsection 1061PAAA(1).

(4) Paragraph (1)(b) of this section does not require a report to deal
10
with a payment unless, before the preparation of the report, a
11
Department official was aware the payment was made under
12
subsection 1061PAAB(1).

(5) For the purposes of this section, if:
15
(a) a payment was made under subsection 1061PAAA(1) or
16
1061PAAB(1) in a reporting period; and
17
(b) either:
18
(i) because of subsection (3) of this section,
19
paragraph (1)(a) of this section did not require a report
20
to deal with the payment; or
21
(ii) because of subsection (4) of this section,
22
paragraph (1)(b) of this section did not require a report
23
to deal with the payment; and
24
(c) during a later reporting period, a Department official
25
becomes aware that the payment was made under
26
subsection 1061PAAA(1) or 1061PAAB(1), as the case may
27
be;
28
the payment is subject to a deferred reporting obligation in
29
relation to the later reporting period.

(6) If one or more payments made under subsection 1061PAAA(1)
32
during a reporting period are subject to a deferred reporting
33
obligation in relation to a later reporting period, the Secretary must,
34
during the applicable publication period for the later reporting
35
period:

(a) prepare a report that sets out:

(i) the number of those payments; and

later reporting period--include the paragraph (a) report in the
7
subsection (1) report; and
8
(c) if paragraph (b) does not apply--publish, in such manner as
9
the Secretary thinks fit, the paragraph (a) report.

(7) If one or more payments made under subsection 1061PAAB(1)
11
during a reporting period are subject to a deferred reporting
12
obligation in relation to a later reporting period, the Secretary must,
13
during the applicable publication period for the later reporting
14
period:
15
(a) prepare a report that sets out:
16
(i) the number of those payments; and
17
(ii) the total amount of those payments; and
18
(iii) the reporting period during which the payments were
19
made; and
20
(b) if a report is required under subsection (1) in relation to the
21
later reporting period--include the paragraph (a) report in the
22
subsection (1) report; and
23
(c) if paragraph (b) does not apply--publish, in such manner as
24
the Secretary thinks fit, the paragraph (a) report.

Reporting period
26
(8) For the purposes of this section, a reporting period is:
27
(a) a financial year; or
28
(b) if a shorter recurring period is prescribed in an instrument
29
under subsection (9)--that period.

(9) The Minister may, by legislative instrument, prescribe a recurring
31
period for the purposes of paragraph (8)(b).

Applicable publication period
33
(10) For the purposes of this section, the applicable publication period
34
for a reporting period is the period of:

(a) 4 months; or
1
(b) if a lesser number of months is prescribed, in relation to the
2
reporting period, in an instrument under subsection (11)--
3
that number of months;
4
beginning immediately after the end of the reporting period.

(11) The Minister may, by legislative instrument, prescribe a number of
6
months, in relation to a reporting period, for the purposes of
7
paragraph (10)(b).

1061PAAD Review of decisions
9
Part 4 of the Social Security (Administration) Act 1999 does not
10
apply to a decision under this Division.

1061PAAE Department official
12
For the purposes of this Division, Department official means an
13
official (within the meaning of the Financial Management and
14
Accountability Act 1997):
15
(a) who:
16
(i) is in the Department or is part of the Department; or
17
(ii) is a Departmental employee (within the meaning of the
18
Human Services (Centrelink) Act 1997); and
19
(b) whose duties consist of, or include, matters relating to
20
Australian Government Disaster Recovery Payments.

20A Recoverable payments

(1) If, apart from this subsection, the Commonwealth does not have
6
power under this Act to pay an amount (the relevant amount) to a
7
person (the recipient) purportedly as a benefit, then the

Commonwealth may pay the relevant amount to the recipient.

(2) If a payment is made under subsection (1) to the recipient, the
11
relevant amount:
12
(a) is a debt due to the Commonwealth by the recipient; and
13
(b) may be recovered by the Secretary of the Department, on
14
behalf of the Commonwealth, in a court of competent

jurisdiction.

Appropriation

(3) For the purposes of subsection 12A(5), if a payment under
20
subsection (1) of this section relates to a benefit under
21
subsection 12A(2), the payment is taken to be a benefit under
22
subsection 12A(2).

(4) For the purposes of section 14 (other than paragraph (a) of that
24
section), if a payment under subsection (1) of this section relates to
25
a pension under this Act, the payment is taken to be a pension
26
under this Act.

(5) For the purposes of subsection 17AB(7), if a payment under
28
subsection (1) of this section relates to an amount under
29
subsection 17AB(6), the payment is taken to be an amount under
30
subsection 17AB(6).

Benefit

(6) For the purposes of this section, benefit means:

(a) a pension under this Act; or
3
(b) a benefit under subsection 12A(2); or
4
(c) an amount under subsection 17AB(6).

20B Recoverable death payments
6
(1) If, apart from this subsection, the Commonwealth does not have
7
power under this Act to pay an amount (the relevant amount) in
8
any of the following circumstances:
9
(a) the relevant amount is deposited to an account kept in the
10
name of a deceased person;
11
(b) the relevant amount is deposited to an account kept in the
12
names of a deceased person and another person;
13
(c) the relevant amount is paid by way of a cheque made out to a
14
deceased person;
15
the Commonwealth may pay the relevant amount in the
16
circumstances mentioned in paragraph (a), (b) or (c), so long as:
17
(d) on the last day on which changes could reasonably be made
18
to the payment of the relevant amount, the Secretary of the
19
Department did not know that the deceased person had died;
20
and
21
(e) apart from this subsection, the relevant amount would have
22
been payable as a benefit to the deceased person if the
23
deceased person had not died.
24
(2) If a payment is made under subsection (1), the relevant amount is
25
taken to have been paid to the deceased person's estate.

Recovery

(3) If a payment is made under subsection (1), the relevant amount:
28
(a) is a debt due to the Commonwealth by the legal personal
29
representative of the deceased person; and
30
(b) may be recovered by the Secretary of the Department, on
31
behalf of the Commonwealth, in a court of competent

Appropriation

(4) For the purposes of subsection 12A(5), if a payment under
2
subsection (1) of this section relates to a benefit under
3
subsection 12A(2), the payment is taken to be a benefit under
4
subsection 12A(2).

(5) For the purposes of section 14 (other than paragraph (a) of that
6
section), if a payment under subsection (1) of this section relates to
7
a pension under this Act, the payment is taken to be a pension
8
under this Act.

(6) For the purposes of subsection 17AB(7), if a payment under
10
subsection (1) of this section relates to an amount under
11
subsection 17AB(6), the payment is taken to be an amount under
12
subsection 17AB(6).

Benefit

(7) For the purposes of this section, benefit means:
15
(a) a pension under this Act; or
16
(b) a benefit under subsection 12A(2); or
17
(c) an amount under subsection 17AB(6).

20C Reports about recoverable payments and recoverable death
19
payments
20
(1) During the applicable publication period for a reporting period, the
21
Secretary of the Department must cause to be published, in such
22
manner as the Secretary of the Department thinks fit, a report that
23
sets out:
24
(a) both:
25
(i) the number of payments made under subsection 20A(1)
26
during the reporting period; and
27
(ii) the total amount of those payments; and
28
(b) both:
29
(i) the number of payments made under subsection 20B(1)
30
during the reporting period; and
31
(ii) the total amount of those payments.
32
(2) However, a report is not required if:
33
(a) the number mentioned in subparagraph (1)(a)(i) is zero; and

(b) the number mentioned in subparagraph (1)(b)(i) is zero.

Deferred reporting

(3) Paragraph (1)(a) of this section does not require a report to deal
3
with a payment unless, before the preparation of the report, a
4
designated Department official was aware the payment was made
5
under subsection 20A(1).
6
(4) Paragraph (1)(b) of this section does not require a report to deal
7
with a payment unless, before the preparation of the report, a
8
designated Department official was aware the payment was made
9
under subsection 20B(1).

(5) For the purposes of this section, if:
11
(a) a payment was made under subsection 20A(1) or 20B(1) in a
12
reporting period; and
13
(b) either:
14
(i) because of subsection (3) of this section,
15
paragraph (1)(a) of this section did not require a report
16
to deal with the payment; or
17
(ii) because of subsection (4) of this section,
18
paragraph (1)(b) of this section did not require a report
19
to deal with the payment; and
20
(c) during a later reporting period, a designated Department
21
official becomes aware that the payment was made under
22
subsection 20A(1) or 20B(1), as the case may be;
23
the payment is subject to a deferred reporting obligation in
24
relation to the later reporting period.

(6) If one or more payments made under subsection 20A(1) during a
26
reporting period are subject to a deferred reporting obligation in
27
relation to a later reporting period, the Secretary of the Department
28
must, during the applicable publication period for the later
29
reporting period:
30
(a) prepare a report that sets out:
31
(i) the number of those payments; and
32
(ii) the total amount of those payments; and
33
(iii) the reporting period during which the payments were
34
made; and

(b) if a report is required under subsection (1) in relation to the

later reporting period--include the paragraph (a) report in the
2
subsection (1) report; and

(c) if paragraph (b) does not apply--publish, in such manner as
4
the Secretary of the Department thinks fit, the paragraph (a)
5
report.

(7) If one or more payments made under subsection 20B(1) during a
7
reporting period are subject to a deferred reporting obligation in
8
relation to a later reporting period, the Secretary of the Department
9
must, during the applicable publication period for the later
10
reporting period:
11
(a) prepare a report that sets out:
12
(i) the number of those payments; and
13
(ii) the total amount of those payments; and
14
(iii) the reporting period during which the payments were
15
made; and
16
(b) if a report is required under subsection (1) in relation to the
17
later reporting period--include the paragraph (a) report in the
18
subsection (1) report; and
19
(c) if paragraph (b) does not apply--publish, in such manner as
20
the Secretary of the Department thinks fit, the paragraph (a)
21
report.

Reporting period

(8) For the purposes of this section, a reporting period is:
24
(a) a financial year; or
25
(b) if a shorter recurring period is prescribed in an instrument
26
under subsection (9)--that period.
27
(9) The Minister may, by legislative instrument, prescribe a recurring
28
period for the purposes of paragraph (8)(b).
29
Applicable publication period
30
(10) For the purposes of this section, the applicable publication period
31
for a reporting period is the period of:
32
(a) 4 months; or

(b) if a lesser number of months is prescribed, in relation to the

reporting period, in an instrument under subsection (11)--

(11) The Minister may, by legislative instrument, prescribe a number of
5
months, in relation to a reporting period, for the purposes of
6
paragraph (10)(b).

Designated Department official
8
(12) For the purposes of this section, designated Department official
9
means an official (within the meaning of the Financial
10
Management and Accountability Act 1997) who is in the
11
Department or is part of the Department.

(1) If, apart from this subsection, the Commonwealth does not have

power under this Act to pay an amount (the relevant amount) to a
7
person (the recipient) purportedly as a benefit, then the
8
Commonwealth may pay the relevant amount to the recipient.

Recovery
10
(2) If a payment is made under subsection (1) to the recipient, the
11
relevant amount:
12
(a) is a debt due to the Commonwealth by the recipient; and
13
(b) may be recovered by the Chief Executive (as determined
14
under the Financial Management and Accountability Act
15
1997) of the relevant agency, on behalf of the
16
Commonwealth, in a court of competent jurisdiction.

(3) If:

(a) a payment is made under subsection (1) to the recipient; and

(b) the recipient is receiving, or is entitled to receive, a benefit;
22
then:
23
(c) the relevant amount; or
24
(d) such part of the relevant amount as the Chief Executive (as
25
determined under the Financial Management and
26
Accountability Act 1997) of the relevant agency determines;
27
may, if the Chief Executive so directs, be recovered by deduction
28
from that benefit, unless the recipient is a Justice or Judge of a
29
federal court.

(7) For the purposes of this section, the relevant agency, in relation to

a recovery under this section of the whole or part of a relevant
17
amount, means:
18
(a) the Agency (as defined by section 5 of the Financial
19
Management and Accountability Act 1997) that paid the
20
relevant amount under subsection (1) on behalf of the
21
Commonwealth; or
22
(b) if a different Agency is prescribed in an instrument under
23
subsection (8)--the Agency.

(8) The Minister may, by legislative instrument, prescribe an Agency
25
(as defined by section 5 of the Financial Management and
26
Accountability Act 1997) for the purposes of paragraph (7)(b).

16B Recoverable death payments
28
(1) If, apart from this subsection, the Commonwealth does not have
29
power under this Act to pay an amount (the relevant amount) in
30
any of the following circumstances:
31
(a) the relevant amount is deposited to an account kept in the
32
name of a deceased person;

(b) the relevant amount is deposited to an account kept in the

names of a deceased person and another person;
2
(c) the relevant amount is paid by way of a cheque made out to a
3
deceased person;
4
the Commonwealth may pay the relevant amount in the
5
circumstances mentioned in paragraph (a), (b) or (c), so long as:
6
(d) on the last day on which changes could reasonably be made
7
to the payment of the relevant amount, the Chief Executive
8
(as determined under the Financial Management and
9
Accountability Act 1997) of the relevant agency did not know
10
that the deceased person had died; and
11
(e) apart from this subsection, the relevant amount would have
12
been payable as a benefit to the deceased person if the
13
deceased person had not died.
14
(2) If a payment is made under subsection (1), the relevant amount is
15
taken to have been paid to the deceased person's estate.
16
Recovery
17
(3) If a payment is made under subsection (1), the relevant amount:
18
(a) is a debt due to the Commonwealth by the legal personal
19
representative of the deceased person; and
20
(b) may be recovered by the Chief Executive (as determined
21
under the Financial Management and Accountability Act
22
1997) of the relevant agency, on behalf of the
23
Commonwealth, in a court of competent jurisdiction.

16C Reports about recoverable payments and recoverable death
19
payments
20
(1) During the applicable publication period for a reporting period, the
21
Chief Executive (as determined under the Financial Management
22
and Accountability Act 1997) of the relevant agency must cause to
23
be published, in such manner as the Chief Executive thinks fit, a
24
report that sets out:
25
(a) both:
26
(i) the number of payments made under subsection 16A(1)
27
during the reporting period; and
28
(ii) the total amount of those payments; and
29
(b) both:
30
(i) the number of payments made under subsection 16B(1)
31
during the reporting period; and
32
(ii) the total amount of those payments.
33
(2) However, a report is not required if:
34

(a) the number mentioned in subparagraph (1)(a)(i) is zero; and
1

Deferred reporting

(3) Paragraph (1)(a) of this section does not require a report to deal
4
with a payment unless before the preparation of the report, an
5
official (as determined under the Financial Management and
6
Accountability Act 1997) of the relevant agency was aware the
7
payment was made under subsection 16A(1).
8
(4) Paragraph (1)(b) of this section does not require a report to deal
9
with a payment unless before the preparation of the report, an
10
official (as determined under the Financial Management and
11
Accountability Act 1997) of the relevant agency was aware the
12
payment was made under subsection 16B(1).
13
(5) For the purposes of this section, if:
14
(a) a payment was made under subsection 16A(1) or 16B(1) in a
15
reporting period; and
16
(b) either:
17
(i) because of subsection (3) of this section,
18
paragraph (1)(a) of this section did not require a report
19
to deal with the payment; or
20
(ii) because of subsection (4) of this section,
21
paragraph (1)(b) of this section did not require a report
22
to deal with the payment; and
23
(c) during a later reporting period, an official (as determined
24
under the Financial Management and Accountability Act
25
1997) of the relevant agency becomes aware that the payment
26
was made under subsection 16A(1) or 16B(1), as the case
27
may be;
28
the payment is subject to a deferred reporting obligation in
29
relation to the later reporting period.
30
(6) If one or more payments made under subsection 16A(1) during a
31
reporting period are subject to a deferred reporting obligation in
32
relation to a later reporting period, the Chief Executive of the
33
relevant agency must, during the applicable publication period for
34
the later reporting period:
35
(a) prepare a report that sets out:
36
(i) the number of those payments; and

(ii) the total amount of those payments; and

(iii) the reporting period during which the payments were

(c) if paragraph (b) does not apply--publish, in such manner as
7
the Chief Executive thinks fit, the paragraph (a) report.

(7) If one or more payments made under subsection 16B(1) during a
9
reporting period are subject to a deferred reporting obligation in
10
relation to a later reporting period, the Chief Executive of the
11
relevant agency must, during the applicable publication period for
12
the later reporting period:
13
(a) prepare a report that sets out:
14
(i) the number of those payments; and
15
(ii) the total amount of those payments; and
16
(iii) the reporting period during which the payments were
17
made; and
18
(b) if a report is required under subsection (1) in relation to the
19
later reporting period--include the paragraph (a) report in the
20
subsection (1) report; and
21
(c) if paragraph (b) does not apply--publish, in such manner as
22
the Chief Executive thinks fit, the paragraph (a) report.

Reporting period
24
(8) For the purposes of this section, a reporting period is:
25
(a) a financial year; or
26
(b) if a shorter recurring period is prescribed in an instrument
27
under subsection (9)--that period.
28
(9) The Minister may, by legislative instrument, prescribe a recurring
29
period for the purposes of paragraph (8)(b).

Applicable publication period
31
(10) For the purposes of this section, the applicable publication period
32
for a reporting period is the period of:
33
(a) 4 months; or

(b) if a lesser number of months is prescribed, in relation to the

reporting period, in an instrument under subsection (11)--

(11) The Minister may, by legislative instrument, prescribe a number of
5
months, in relation to a reporting period, for the purposes of
6
paragraph (10)(b).

Relevant agency
8
(12) For the purposes of this section, the relevant agency means:
9
(a) the Agency (as defined by section 5 of the Financial
10
Management and Accountability Act 1997) that is responsible
11
for making payments under subsection 16A(1) or 16B(1) on
12
behalf of the Commonwealth; or
13
(b) if a different Agency is prescribed in an instrument under
14
subsection (13)--the Agency.

(13) The Minister may, by legislative instrument, prescribe an Agency

The object of this item is to provide for loss relief relating to the transfer

Transfer of net capital loss

(2)
Each of the following is transferred from the MSB Fund to the ARIA

Investments Trust:

(a) any of the MSB Fund's net capital losses for income years
13
earlier than the 2011-12 income year, to the extent that the
14
loss was not utilised before the end of 11 May 2012 (an
15
earlier year net capital loss);
16
(b) a net capital loss the MSB Fund would have made for the
17
2011-12 income year if it were assumed that the income year
18
had ended at the end of 11 May 2012 (a transfer year net
19
capital loss).

Effect of transferring a net capital loss

(3)
To the extent that an earlier year net capital loss is transferred to the
22
ARIA Investments Trust:

(a) the MSB Fund is taken not to have made the loss for that

earlier income year; and

(b) an amount equal to the transferred amount is taken to be a

capital loss made by the ARIA Investments Trust for the
27
2011-12 income year.

To the extent that a transfer year net capital loss is transferred to the

ARIA Investments Trust:

(a) the sum of the MSB Fund's capital losses for the transfer

year is reduced by an amount equal to the transferred

amount; and
