The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Financial Framework Legislation
5
Amendment Act (No. 4) 2012.

2 Commencement
7
This Act commences on the day after this Act receives the Royal
8
Assent.

Each Act that is specified in a Schedule to this Act is amended or
11
repealed as set out in the applicable items in the Schedule
12

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

in relation to procurement".

Insert:

62B Recoverable death payments
4
(1) If, apart from this subsection, the Commonwealth does not have
5
power under this Act or the regulations to pay an amount (the
6
relevant amount) in any of the following circumstances:
7
(a) the relevant amount is deposited to an account kept in the
8
name of a deceased person;
9
(b) the relevant amount is deposited to an account kept in the
10
names of a deceased person and another person;
11
(c) the relevant amount is paid by way of a cheque made out to a
12
deceased person;
13
the Commonwealth may pay the relevant amount in the
14
circumstances mentioned in paragraph (a), (b) or (c), so long as:
15
(d) on the last day on which changes could reasonably be made
16
to the payment of the relevant amount, the Chief Executive
17
Officer of ComSuper did not know that the deceased person
18
had died; and
19
(e) apart from this subsection, the relevant amount would have
20
been payable as a benefit to the deceased person if the
21
deceased person had not died.
22
(2) If a payment is made under subsection (1), the relevant amount is
23
taken to have been paid to the deceased person's estate.
24
Recovery
25
(3) If a payment is made under subsection (1), the relevant amount:
26
(a) is a debt due to the Commonwealth by the legal personal
27
representative of the deceased person; and
28
(b) may be recovered by the Chief Executive Officer of
29
ComSuper, on behalf of the Commonwealth, in a court of
30
competent jurisdiction.

62C Reports about recoverable death payments
1
(1) During the applicable publication period for a reporting period, the
2
Chief Executive Officer of ComSuper must cause to be published,
3
in such manner as the Chief Executive Officer thinks fit, a report
4
that sets out both:
5
(a) the number of payments made under subsection 62B(1)
6
during the reporting period; and
7
(b) the total amount of those payments.
8
(2) However, a report is not required if the number mentioned in
9
paragraph (1)(a) is zero.

Deferred reporting
11
(3) Subsection (1) does not require a report to deal with a payment
12
unless, before the preparation of the report, a ComSuper official
13
was aware the payment was made under subsection 62B(1).
14
(4) For the purposes of this section, if:
15
(a) a payment was made under subsection 62B(1) in a reporting
16
period and because of subsection (3) of this section,
17
subsection (1) of this section did not require a report to deal
18
with the payment; and
19
(b) during a later reporting period, a ComSuper official becomes
20
aware that the payment was made under subsection 62B(1);
21
the payment is subject to a deferred reporting obligation in
22
relation to the later reporting period.

(5) If one or more payments made under subsection 62B(1) during a
24
reporting period are subject to a deferred reporting obligation in
25
relation to a later reporting period, the Chief Executive Officer of
26
ComSuper must, during the applicable publication period for the
27
later reporting period:
28
(a) prepare a report that sets out:
29
(i) the number of those payments; and
30
(ii) the total amount of those payments; and
31
(iii) the reporting period during which the payments were
32
made; and
33
(b) if a report is required under subsection (1) in relation to the
34
later reporting period--include the paragraph (a) report in the
35
subsection (1) report; and

(c) if paragraph (b) does not apply--publish, in such manner as

the Chief Executive Officer thinks fit, the paragraph (a)
2
report.

Reporting period

(6) For the purposes of this section, a reporting period is:
5
(a) a financial year; or
6
(b) if a shorter recurring period is prescribed in an instrument
7
under subsection (7)--that period.
8
(7) The Minister may, by legislative instrument, prescribe a recurring
9
period for the purposes of paragraph (6)(b).

Applicable publication period
11
(8) For the purposes of this section, the applicable publication period
12
for a reporting period is the period of:
13
(a) 4 months; or
14
(b) if a lesser number of months is prescribed, in relation to the
15
reporting period, in an instrument under subsection (9)--that
16
number of months;
17
beginning immediately after the end of the reporting period.
18
(9) The Minister may, by legislative instrument, prescribe a number of
19
months, in relation to a reporting period, for the purposes of
20
paragraph (8)(b).

ComSuper official
22
(10) For the purposes of this section, ComSuper official means an
23
official (within the meaning of the Financial Management and
24
Accountability Act 1997) who is in ComSuper or is part of
25
ComSuper.
