The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Families, Housing, Community
7
Services and Indigenous Affairs and Other Legislation Amendment
8
(2009 Measures) Act 2009.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
11
commences, or is taken to have commenced, in accordance with
12
2 Families, Housing, Community Services and Indigenous Affairs and Other Legislation
Amendment (2009 Measures) Bill 2009 No. , 2009
column 2 of the table. Any other statement in column 2 has effect

according to its terms.

residual amount has the same meaning as in subsection 123WJ(2).

Payment of residual amount

(3) The residual amount is to be paid in one or more of the following
14
ways (as determined by the Secretary):
15
(a) to the legal personal representative of the person;
16
(b) to one or more other persons whom the Secretary is satisfied
17
have carried out, are carrying out, or will carry out, an
18
appropriate activity in relation to the estate or affairs of the
19
person;
20
(c) to the credit of a bank account nominated by the person for
21
the purposes of subsection 55(2).

An amount that is to be paid under this subsection is to be paid as a
23
lump sum on a day determined by the Secretary.

(3A) A person may be paid more than one amount under subsection (3).

9 Application--persons becoming subject to the income

management regime again

(1)
The amendment made by item 5 applies in relation to persons who:
3
(a) cease to be subject to the income management regime before,
4
on or after the commencement of that item; and
5
(b) become subject to the income management regime again
6
before, on or after that commencement.
7
(2)
However, for a person who became subject to the income management
8
regime again before that commencement, the time applicable for the
9
purposes of paragraph 123WJA(1)(d) of the Social Security
10
(Administration) Act 1999, as inserted by this Act, is taken to be the
11
start of the day on which this item commences (instead of the time the
12
person became subject to the income management regime again).

10 Application--payment of credit balances of income
14
management accounts--person dies
15
The amendments made by items 6, 7 and 8 apply in relation to:
16
(a) deaths occurring on or after the commencement of those
17
items; and
18
(b) deaths occurring before the commencement of those items if
19
a determination had not been made under subsection
20
123WL(3) of the Social Security (Administration) Act 1999
21
before that commencement.

1 After section 128

128A Power to obtain information or documents
7
(1) This section applies to a person if the Principal Member believes
8
on reasonable grounds that the person has information or a
9
document that is relevant to a review.
10
(2) The Principal Member may, by written notice given to the person,
11
require the person:
12
(a) to give to the SSAT, within the period and in the manner
13
specified in the notice, any such information; or
14
(b) to produce to the SSAT, within the period and in the manner
15
specified in the notice, any such documents.
16
(3) The period specified in a notice given under subsection (2) must be
17
at least 14 days after the notice is given.
18
Offence
19
(4) A person commits an offence if:
20
(a) the person is given a notice under subsection (2); and
21
(b) the person fails to comply with the notice.
22
Penalty: Imprisonment for 6 months.

(5) A notice under subsection (2) must set out the effect of the

following provisions:

128B Inspecting and copying documents

The following may inspect a document produced under
4
section 128A and may make and retain copies of the whole or a
5
part of the document:
6
(a) a member who constitutes, or who is one of the members
7
who constitute, the SSAT for the purposes of the review;
8
(b) a member of the staff of the SSAT.

128C Retention of documents
10
(1) The following may take possession of a document produced under
11
section 128A, and retain it for as long as is reasonably necessary:
12
(a) a member who constitutes, or who is one of the members
13
who constitute, the SSAT for the purposes of the review;
14
(b) a member of the staff of the SSAT.
15
(2) The person otherwise entitled to possession of the document is
16
entitled to be supplied, as soon as practicable, with a copy certified
17
by the Principal Member to be a true copy.
18
(3) The certified copy must be received in all courts and tribunals as
19
evidence as if it were the original.
20
(4) Until a certified copy is supplied, the Principal Member must
21
provide the person otherwise entitled to possession of the
22
document, or a person authorised by that person, reasonable access
23
to the document for the purposes of inspecting and making copies
24
of the whole or a part of the document.

(2) At a conference, the Principal Member may:

(a) fix a day or days for the hearing; and
4
(b) give directions about the time within which submissions are
5
to be made to the SSAT; and
6
(c) give directions about the time within which evidence is to be
7
brought before the SSAT; and
8
(d) give directions about what evidence is to be brought before
9
the SSAT.

(3) Paragraph (2)(d) does not limit the evidence that may be brought
11
before the SSAT.

Restrictions on disclosure of information obtained at a conference
13
(4) The Principal Member may make an order directing a party to the
14
review who is present at a conference:
15
(a) not to disclose information obtained by the party at the
16
conference; or
17
(b) not to disclose information obtained by the party at the
18
conference except in the circumstances, or for the purposes,
19
specified in the order.
20
(5) A person commits an offence if:
21
(a) the person is given an order under subsection (4); and
22
(b) the person contravenes the order.
23
Penalty for contravention of this subsection: Imprisonment for 2
24
years.
25
129B Powers of SSAT if parties reach agreement
26
(1)
If:
27
(a) at a pre-hearing conference under section 129A with the
28
parties to a review, the parties agree to the terms of a decision
29
of the SSAT:
30
(i) in the review; or
31
(ii) in relation to a part of the review, or a matter arising out
32
of the review;
33
that would be acceptable to the parties; and

(b) before the hearing of the review commences, the terms of the

(c) before the hearing of the review commences, the SSAT is

satisfied that a decision in those terms, or consistent with
7
those terms, would be within the powers of the SSAT;
8
the SSAT may act in accordance with whichever of subsection (2)
9
or (3) is relevant.

(2) If the agreement reached is an agreement as to the terms of a
11
decision of the SSAT in the review, the SSAT may make a
12
decision in accordance with those terms without holding a hearing
13
of the review.
14
(3) If the agreement relates to a part of the review, or a matter arising
15
out of the review, the SSAT may in its decision in the review give
16
effect to the terms of the agreement without dealing at the hearing
17
of the review with the part or matter to which the agreement
18
relates.

(1)
If:
5
(a) the SSAT makes a decision on a review; and
6
(b) the presiding member of the SSAT as constituted for the
7
purposes of the review, or the Principal Member, is satisfied
8
that there is an obvious error in:
9
(i) the text of the decision; or
10
(ii) a written statement of reasons for the decision;
11
the presiding member or the Principal Member may alter the text
12
of the decision or statement.
13
(2) If the text of a decision or statement is altered under subsection (1),
14
the altered text is taken to be the decision of the SSAT or the
15
statement of reasons for the decision, as the case may be.

Examples of obvious errors
17
(3) Examples of obvious errors in the text of a decision or statement of
18
reasons are:
19
(a) an obvious clerical or typographical error in the text of the
20
decision or statement; and
21
(b) an inconsistency between the decision and the statement.

of the review;

that would be acceptable to the parties; and

(b) before the hearing of the review commences, the terms of the
23
agreement are:
24
(i) put in writing; and
25
(ii) signed by or on behalf of the parties; and
26

(b) there is a change in the care of the child after the individual

makes the claim and before the end of the period of:

(i) if the claim is based on eligibility for baby bonus under
16
subsection 36(2) of that Act--26 weeks beginning on
17
the day of the child's birth; and
18
(ii) if the claim is based on eligibility for baby bonus under
19
subsection 36(3) of that Act--26 weeks beginning on
20
the day the child is entrusted to care as mentioned in
21
paragraph 36(3)(b) of that Act; and
22
(c) the child ceases to be an FTB child of the individual as a
23
result of that change in care; and
24
(d) before or after that change in care, the Secretary gives the
25
individual a notice (the entitlement notice) under section 46
26
of this Act stating that the individual is entitled to be paid the
27
baby bonus.
28
(2) The individual must notify the Secretary of that change in care:
29
(a) in the manner set out in a written notice given to the
30
individual under section 47C; and
31
(b) as soon as practicable after:
32
(i) if that change in care occurs before the individual
33
receives the entitlement notice--receiving the
34
entitlement notice; and
