The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Farm Household Support Amendment
5
Act 2005.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

1 Subsection 3(2) (definition of farmer)

Repeal the definition, substitute:
8
farmer means a person who has a right or interest in the land used
9
for the purposes of a farm enterprise.
10
2 Subparagraph 8A(1)(b)(i)
11
Repeal the subparagraph, substitute:
12
(i) the person:
13
(A) is a farmer; and
14
(B) contributes a significant part of his or her
15
labour and capital to the farm enterprise; and
16
(C) derives a significant part of his or her income
17
from the farm enterprise; and
18
(D) is at least 18; and
19
(E) is an Australian resident; and
20
(F) is in Australia; and
21
3 Paragraph 8B(1)(c)

Repeal the paragraph, substitute:
23
(c) for a continuous period (the qualifying period) of at least 2
24
years immediately before the period, the person:
25
(i) has been a farmer; and
26
(ii) has derived more than 50% of his or her gross income
27
from the farm enterprise; and
28
(iii) has contributed more than 50% of his or her capital to
29
the farm enterprise; and
30
(iv) has spent more than 50% of his or her working hours in
31
work on the farm enterprise; and

Insert:

(1A) A person is qualified for farm help income support even though the
3
person does not satisfy subparagraph (1)(c)(ii), if the Secretary
4
determines in writing that the person's gross income from the farm
5
enterprise during the qualifying period is significantly diminished
6
because of:
7
(a) drought, flood, bushfire or some other natural disaster; or
8
(b) unforeseeable extreme variation in seasonal norms; or
9
(c) market collapse; or
10
(d) illness or disability.

52AB Secretary may require re-establishment grant recipient to
16
notify if events or circumstances indicative of a return to
17
farming or a change of address occur
18
(1) The Secretary may give a person to whom a farm help
19
re-establishment grant has been paid a notice that requires the
20
person to inform the Department if a specified event or change of
21
circumstances occurs.
22
(2) An event or change of circumstances is not to be specified in a
23
notice under subsection (1) unless:
24
(a) the occurrence of the event or change in circumstances would
25
indicate that the person, or the person's partner, has acquired
26
a right or interest in a farm enterprise within 5 years after
27
receiving the grant; or
28
(b) the event or change in circumstances is a change of address
29
within 5 years after receiving the grant.

(3) A person must not refuse or fail to comply with a notice under
31
subsection (1) to inform the Department of an event or change in
32
circumstances that would indicate that the person, or the person's

partner, has acquired a right or interest in a farm enterprise within
1
5 years after receiving the grant.

Penalty: 30 penalty units.

(4) A person must not refuse or fail to comply with a notice under
4
subsection (1) to inform the Department of a change of address
5
within 5 years after receiving the grant.
6
Penalty: 20 penalty units.

(5) A notice under subsection (1):
8
(a) must be in writing; and
9
(b) must be given personally or by post; and
10
(c) must specify how the person is to give the information to the
11
Department; and
12
(d) must specify the period within which the person is to give the
13
information to the Department.

(6) The period must end at least 14 days after the earlier of:
15
(a) the day on which the event or change of circumstances
16
occurs; or
17
(b) the day on which the person becomes aware that the event or
18
change of circumstances is likely to occur.

52AC Secretary may require re-establishment grant recipient to
20
give a statement about whether returned to farming
21
(1) The Secretary may give a person to whom a farm help
22
re-establishment grant has been paid a notice that requires the
23
person to give the Department a statement about whether the
24
person, or the person's partner, has acquired a right or interest in a
25
farm enterprise within 5 years after receiving the grant.
26
(2) A person must not refuse or fail to comply with a notice under
27
subsection (1).
28
Penalty: 30 penalty units.
29
(3) A notice under subsection (1):
30
(a) must be in writing; and
31
(b) must be given personally or by post; and

(c) must specify how the statement is to be given to the

Department; and
2
(d) must specify the period within which the person is to give the

statement to the Department.

(4) The period must end at least 14 days after the day on which the
5
notice is given.

(5) A statement given in response to the notice must be in writing and
7
in accordance with a form approved by the Secretary.

7 Definition

In this Part:
4
Principal Act means the Farm Household Support Act 1992.
5
8 Farm help income support
6
(1)
The amendments made by items 1, 3 and 4 of this Schedule apply in
7
relation to farm help income support where the claim for that support is
8
made on or after the commencement of this item.
9
(2)
Despite subitem (1), if:
10
(a) a person makes a claim for farm help income support on or
11
after the commencement of this item; and
12
(b) in making the claim, the person relies on advice on financial
13
outlook or an activity plan obtained with the assistance of a
14
farm help advice and training grant; and
15
(c) that grant was made before the commencement of this item
16
but within the period of 3 months ending on the day on which
17
the claim for farm help income support is made;
18
the amendments made by items 1, 3 and 4 of this Schedule do not apply
19
for the purposes of determining whether the person is qualified for farm
20
help income support in respect of that claim.

9 Exceptional circumstances relief payment
22
The amendments made by items 1 and 2 of this Schedule apply in
23
relation to exceptional circumstances relief payment where the claim for
24
that payment is made on or after the commencement of this item.
25
10 Farm help re-establishment scheme
26
(1)
The amendment made by item 6 of this Schedule applies in relation to
27
the farm help re-establishment scheme where a claim for a grant under
28
the scheme is made on or after the commencement of this item.
29
(2)
Despite the insertion of sections 52AB and 52AC of the Principal Act
30
made by item 6 of this Schedule, section 52A of the Principal Act and
31
instruments made under that section, as in force immediately before the
32
commencement of that item, continue in force on and after that
33

commencement, in relation to a farm help re-establishment grant where

the claim for the grant was made before that commencement, as if the
2
amendment and insertion had not been made.
