The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Farm Household Support Amendment
6
(Ancillary Benefits) Act 2010.

2 Commencement

This Act commences on the day this Act receives the Royal
9
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

52D Treatment of payments under Farm Family Support Scheme

(1) The purpose of this section is to set out how other laws apply in
9
relation to:
10
(a) payments under the pilot scheme, known as the Farm Family
11
Support Scheme, to provide support for farmers facing
12
hardship to meet their household expenses and to help them
13
assess the long-term future of their farm enterprises; and
14
(b) things done in connection with that scheme.

(2) The following provisions apply in relation to a payment of income
16
support under the Farm Family Support Scheme in the same way
17
as they apply in relation to exceptional circumstances relief
18
payment under this Act:
19
(a) sections 54 and 56 of this Act;
20
(b) sections 79A and 160AAA of the Income Tax Assessment Act
21
1936;
22
(c) sections 53-10 and 53-15 of the Income Tax Assessment Act
23
1997;
24
(d) section 64 of the Small Superannuation Accounts Act 1995;
25
(e) sections 547B, 573A and 1061ZK, points 1067G-F3 and
26
1067G-G3 of the Youth Allowance Rate Calculator in
27
Part 3.5, and sections 1130B, 1131, 1227A and 1231A of the
28
Social Security Act 1991;
29
(f) section 106B of the Social Security (Administration) Act
30
1999;
31
(g) a provision of any Act, so far as it relates to a provision
32
described in any of paragraphs (a) to (f) (inclusive) of this
33
subsection.

Note:
Exceptional circumstances relief payment is a payment made under

Part 5 of this Act.

Example: Paragraph
(g)--sections 84, 84A, 92 and 92A of the A New Tax

System (Family Assistance) (Administration) Act 1999 are examples of
4
provisions that relate to section 56 of this Act, because they relate to
5
debts created by that section.

(3) The following provisions apply in relation to the doing of anything
7
in relation to the Farm Family Support Scheme in the same way as
8
they apply in relation to the doing of anything under or in relation
9
to this Act:
10
(a) the definition of officer in subsection 23(1) of the Social
11
Security Act 1991;
12
(b) Parts 4 and 5 of the Social Security (Administration) Act
13
1999.

(4) Subsection 41(2AA) of the Age Discrimination Act 2004 applies in
15
relation to anything done under the Farm Family Support Scheme
16
in the same way as it applies to anything done in direct compliance
17
with section 24A of this Act.

2 Application
19
Section 52D of the Farm Household Support Act 1992 applies to the
20
doing of things (including the making of payments) in connection with
21
the Farm Family Support Scheme before, on or after the
22
commencement of that section.
