military superannuation entitlements, and for

The Parliament of Australia enacts:
4

1 Short title
7
This Act may be cited as the Fair Indexation of Military
8
Superannuation Entitlements Act 2012.

2 Commencement

This Act commences on the day this Act receives the Royal
11
Assent.

3 Fair indexation of military superannuation entitlements

(1) The Minister must, not later than 6 months after the day on which
2
this Act commences, take legislative action that has the effect that
3
military superannuation entitlements are, as soon as practicable and
4
with ongoing effect, to be indexed using the same indexation
5
methodology, applied with the same frequency, as applies for age
6
pension under the Social Security Act 1991.

(2) In this Act:
8
legislative action means:
9
(a) in relation to the Military Superannuation and Benefits
10
Scheme--make a legislative instrument amending the trust
11
deed for the scheme; and
12
(b) in relation to the other schemes--cause to be introduced into
13
the House of Representatives a Bill for an Act amending the
14
legislation governing the schemes.
15
military superannuation entitlement means an entitlement under
16
any of the following superannuation schemes:
17
(a) the Defence Force Retirement Benefit Scheme;
18
(b) the Defence Force Retirement and Death Benefit Scheme;
19
(c) the Military Superannuation and Benefits Scheme;
20
if the entitlement is, or includes a component that is, subject to
21
indexation under the scheme.
