The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Family Law Amendment (Validation
6
of Certain Orders and Other Measures) Act 2012.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

1 Interpretation

(1)
In this Part:
4
affected order: see subitems 2(4) and (5).
5
assumed matters: see subitem 2(1).

court, except in items 5 and 6, has the same meaning as in the Family
7
Law Act 1975, and also includes a court exercising jurisdiction in
8
relation to a matter arising under this Part.
9
Family Court means the Family Court of Australia.
10
liability includes a duty, responsibility or obligation.
11
order includes a decree, judgement, declaration, injunction, direction or
12
other decision.
13
order-based rights or liabilities: see subitem 3(1).
14
Registrar means:
15
(a) a Registrar within the meaning of the Family Law Act 1975,
16
to the extent that his or her powers were or are exercised
17
under a delegation of the Family Court's powers under Rules
18
of Court made under section 37A of the Family Law Act
19
1975; or
20
(b) a Judicial Registrar appointed under section 26A of the
21
Family Law Act 1975, to the extent that his or her powers
22
were or are exercised under a delegation of the Family
23
Court's powers under Rules of Court made under section 26B
24
of that Act; or
25
(c) a Registrar within the meaning of the Federal Magistrates
26
Act 1999, to the extent that his or her powers were or are
27
exercised:
28
(i) under section 102 of that Act; or
29
(ii) under a delegation of the Federal Magistrates Court's
30
powers under Rules of Court made under section 103 of
31
that Act.

Any other expression has the same meaning in this Part as in the Family

Law Act 1975.

2 Rights and liabilities of persons

(1)
Subject to subitem (3), the rights and liabilities of all persons are, by
4
force of this item, declared to be, and always to have been, the same as
5
if the following matters (the assumed matters) had been the case:
6
(a) a Proclamation had been made under subsection 40(2) of the
7
Family Law Act 1975 (as in force before the commencement
8
of this Part), fixing 1 March 2009 as the date on and after
9
which the jurisdiction of the Family Court under paragraph
10
31(1)(aa) of that Act could be exercised in the following
11
States and Territories:
12
(i)
New
South
Wales;
13
(ii)
Victoria;
14
(iii)
Queensland;
15
(iv)
Tasmania;
16
(v) the Australian Capital Territory;
17
(vi) the Northern Territory;
18
(vii)
Norfolk
Island;
19
(b) a Proclamation had been made under subsection 40(2) of the
20
Family Law Act 1975 (as in force before the commencement
21
of this Part), fixing 1 July 2010 as the date on and after which
22
the jurisdiction of the Family Court under paragraph
23
31(1)(aa) of that Act could be exercised in South Australia;
24
(c) each of those Proclamations had been in force at all times
25
from the start of the date fixed by the Proclamation to the end
26
of 10 February 2012.

(2)
Without limiting the effect of subitem (1):
28
(a) all persons are, by force of this item, declared to be, and
29
always to have been, entitled to act on the basis that other
30
persons had, and have, the rights and liabilities as declared by
31
subitem (1); and
32
(b) a right or liability that a person is declared by subitem (1) to
33
have, or to have had:
34
(i) is exercisable or enforceable; and
35
(ii) is to be regarded as always having been exercisable or
36
enforceable;

as if the assumed matters had been the case; and

(c) the rights and liabilities that a person is declared by
2
subitem (1) to have, or to have had, include any right the
3
person would have or have had, if the assumed matters had
4
been the case, to appeal, or to seek review of, an affected
5
order.

(3)
Subitem (1) does not apply to liabilities arising from a conviction (or
7
purported conviction), before the commencement of this Part, of a
8
person for an offence that relates to a de facto financial cause.

(4)
Subject to subitem (5), an affected order is:
10
(a) an order purportedly made, before 11 February 2012, by:
11
(i) the Family Court; or
12
(ii) the Federal Magistrates Court; or
13
(iii)
a
Registrar;
14
in the exercise of jurisdiction under the Family Law Act 1975
15
in respect of matters referred to in paragraph 31(1)(aa) or
16
subsection 39B(1) of that Act; or
17
(b) an award purportedly:
18
(i) made in section 13E arbitration, or in relevant property
19
or financial arbitration; and
20
(ii) registered in the Family Court, or the Federal
21
Magistrates Court, under section 13H of the Family Law
22
Act 1975 before 11 February 2012 in the exercise of
23
jurisdiction under the Family Law Act 1975 in respect of
24
matters referred to in paragraph 31(1)(aa) or subsection
25
39B(1) of that Act; or
26
(c) an order purportedly made, before the commencement of this
27
Part, on appeal from, or review of, an order or award referred
28
to in paragraph (a) or (b) of this subitem.

(5)
If, before the commencement of this Part, a court or Registrar purported
30
to vary, revoke, set aside, revive or suspend an order or award referred
31
to in subitem (4), the affected order is that order or award in the form in
32
which, and to the extent to which, it purports or purported to have effect
33
from time to time.

Note:
If the affected order was declared or held to be invalid before the commencement of this
35
Part, this Part does not apply in relation to the order: see item 5.

3 Additional provisions relating to order-based rights or

liabilities

Item applies to order-based rights or liabilities

(1)
This item applies in relation to rights or liabilities (order-based rights
4
or liabilities):
5
(a) that a person is declared by item 2 to have; and
6
(b) that were purportedly conferred, imposed or affected by an
7
affected order.
8
New order made on basis that affected order was or might be
9
invalid
10
(2) If:
11
(a) before the commencement of this Part, a court or Registrar
12
made an order (the new order) on the basis that the affected
13
order was or might be invalid; and
14
(b) the new order:
15
(i) conferred or imposed rights or liabilities similar to or
16
different from those purportedly conferred or imposed
17
by the affected order; or
18
(ii) affected rights or liabilities in the same way as they
19
were purportedly affected by the affected order or in a
20
different way;
21
item 2 is to be regarded as having ceased to have effect, in relation to
22
the order-based rights or liabilities, when the new order took effect.
23
Note 1: If the affected order was declared or held to be invalid before the commencement of this
24
Part, this Part does not apply in relation to the order: see item 5.
25
Note 2: If the new order was made before 11 February 2012, the new order may itself be an
26
affected order that gives rise to order-based rights and liabilities.

Variation, revocation etc. of order-based rights or liabilities
28
(3) A
court or Registrar may vary, revoke, set aside, revive or suspend an
29
order-based right or liability in the same way as the court or Registrar
30
could do so if the assumed matters had been the case.

(4)
In addition to the powers of a court or Registrar under subitem (3), a
32
court or Registrar also has power to make an order achieving any other
33
result that could have been achieved if:

(a) the assumed matters had been the case; and

(b) the court or Registrar had been considering whether to vary,
2
revoke, set aside, revive or suspend the affected order.

Generality of item 2 not limited

(5)
Nothing in this item limits the generality of item 2.

4 Evidence
6
The court record, or a copy of the court record, of an affected order may
7
be adduced in evidence to show the existence, nature and extent of an
8
order-based right or liability.

5 Part does not apply to certain orders
10
Nothing in this Part applies to an order declared or held to be invalid, or
11
to have been made without power, by a court before the commencement
12
of this Part.

6 Jurisdiction of courts
14
(1)
Subject to subitem (3), jurisdiction is conferred on:
15
(a) the Family Court; and
16
(b) the Federal Magistrates Court; and
17
(c) the Supreme Court of the Northern Territory; and
18
(d) each court of summary jurisdiction of each Territory;
19
with respect to matters arising under this Part.

(2)
Subject to subitem (3), each court of summary jurisdiction of each
21
referring State is invested with federal jurisdiction with respect to
22
matters arising under this Part.
23
(3)
A court only has jurisdiction with respect to a matter arising under this
24
Part if it has jurisdiction with respect to an equivalent matter arising
25
under the Family Law Act 1975. The court's jurisdiction under this Part
26
is subject to the same conditions and limitations as would apply to it in
27
dealing with the equivalent matter.

8 Rights and liabilities of persons

(1)
Subject to subitem (3), the rights and liabilities of all persons are, by

force of this item, declared to be, and always to have been, the same as
8
if the following matters (the assumed matters) had been the case:

(a) a Proclamation had been made under subsection 40(2) of the

Family Law Act 1975 (as in force before the commencement
11
of this Part), fixing 1 July 2006 as the date on and after which
12
the jurisdiction of the Family Court under paragraph
13
93A(1)(aa) of that Act could be exercised, in Western
14
Australia, in respect of appeals under subsection 94AAA(1A)
15
of that Act;
16
(b) that Proclamation had been in force at all times from the start
17
of 1 July 2006 to the end of 20 October 2011.

(2)
Without limiting the effect of subitem (1):
19
(a) all persons are, by force of this item, declared to be, and
20
always to have been, entitled to act on the basis that other
21
persons had, and have, the rights and liabilities as declared by
22
subitem (1); and
23
(b) a right or liability that a person is declared by subitem (1) to
24
have, or to have had:
25
(i) is exercisable or enforceable; and
26
(ii) is to be regarded as always having been exercisable or

enforceable;

as if the assumed matters had been the case; and
29
(c) the rights and liabilities that a person is declared by
30
subitem (1) to have, or to have had, include any right the

person would have or have had, if the assumed matters had

been the case, to appeal, or to seek review of, an affected

order.

(3)
Subitem (1) does not apply to liabilities arising from a conviction (or
35
purported conviction), before the commencement of this Part, of a

person for an offence that relates to proceedings on an appeal under

(4)
Subject to subitem (5), an affected order is:

(a) an order purportedly made, before 21 October 2011, by the
4
Family Court in the exercise of jurisdiction under paragraph
5
93A(1)(aa) of the Family Law Act 1975 in respect of an
6
appeal under subsection 94AAA(1A) of that Act; or
7
(b) an order purportedly made, before the commencement of this
8
Part, on appeal from, or review of, an order referred to in
9
paragraph (a) of this subitem.

(5)
If, before the commencement of this Part, a court or Registrar purported
11
to vary, revoke, set aside, revive or suspend an order referred to in
12
subitem (4), the affected order is that order in the form in which, and to
13
the extent to which, it purports or purported to have effect from time to
14
time.

Note:
If the affected order was declared or held to be invalid before the commencement of this
16
Part, this Part does not apply in relation to the order: see item 11.

9 Additional provisions relating to order-based rights or

liabilities

(1)
This item applies in relation to rights or liabilities (order-based rights
21
or liabilities):

(a) that a person is declared by item 8 to have; and
23
(b) that were purportedly conferred, imposed or affected by an
24
affected order.

Variation, revocation etc. of order-based rights or liabilities

(2) A
court or Registrar may vary, revoke, set aside, revive or suspend an
27
order-based right or liability in the same way as the court or Registrar
28
could do so if the assumed matters had been the case.

(3)

10 Evidence

this Part.

Part if it has jurisdiction with respect to an equivalent matter arising

under the Family Law Act 1975. The court's jurisdiction under this Part

is subject to the same conditions and limitations as would apply to it in

Repeal the heading, substitute:

40 Limitations on jurisdiction of Family Court and of State and

Territory Supreme Courts

2 Subsections 40(1) and (2)

Repeal the subsections, substitute:

(1) The regulations may provide that, from a date specified in the
10
regulations (not being a date before the regulations are registered
11
under the Legislative Instruments Act 2003), the jurisdiction of the
12
Family Court under this Act in relation to all proceedings, or a
13
specified class of proceedings, must not be exercised in a specified
14
State or Territory, or in 2 or more specified States and Territories.

3 Subsection 40(5)
16
Omit "subsections (2) and (3)", substitute "subsection (3)".

4 Application of amendments
18
The amendments made by this Schedule apply in relation to the exercise
19
of jurisdiction after the commencement of this Schedule (even if the
20
proceedings in which the jurisdiction is exercised were initiated before
21
that commencement).
