The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Freedom of Information Amendment
6
(New Arrangements) Act 2014.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(1) The Attorney-General must, as soon as practicable after the end of

operation of this Act during the year.

following:

(a) the number of requests (the access requests) that were made
21
under section 15 during the year;
22
(b) the number of access requests (other than access requests to
23
which paragraph (d) applies) that were granted during the
24
year;

(c) the number of access requests (other than access requests to
26
which paragraph (d) applies) that were refused during the
27
year;

(3) The Attorney-General must cause copies of the report to be tabled
26
in each House of the Parliament within 15 sitting days of that
27
House after the completion of the preparation of the report.

instrument of appointment. The period must not exceed 5 years.

The Commissioner may be reappointed: see section 33AA of the Acts

Interpretation Act 1901.

26XB Acting appointment

The Minister may, by written instrument, appoint a person to act as
21
the Commissioner:
22
(a) during a vacancy in the office of Commissioner, whether or
23
not an appointment has previously been made to the office;
24
or
25
(b) during any period, or during all periods, when the
26
Commissioner:
27
(i) is absent from duty or from Australia; or

26XC Remuneration and allowances
5
(1) The Commissioner is to be paid the remuneration that is
6
determined by the Remuneration Tribunal. If no determination of
7
that remuneration by the Tribunal is in operation, the
8
Commissioner is to be paid the remuneration that is prescribed by
9
the regulations.
10
(2) The Commissioner is to be paid the allowances that are prescribed
11
by the regulations.

(3) This section has effect subject to the Remuneration Tribunal Act
13
1973.

26XD Leave of absence
15
(1) The Commissioner has the recreation leave entitlements that are
16
determined by the Remuneration Tribunal.
17
(2) The Minister may grant the Commissioner leave of absence, other
18
than recreation leave, on the terms and conditions as to
19
remuneration or otherwise that the Minister determines.
20
26XE Outside work
21
The Commissioner must not engage in paid work outside the duties
22
of his or her office without the Minister's approval.

26XF Disclosure of interests

Disclosure under this Act
25
(1) The Commissioner must give written notice to the Minister of all
26
interests, pecuniary or otherwise, that the Commissioner has or
27
acquires and that conflict or could conflict with the proper
28
performance of the Commissioner's functions.

(2) Subsection (1) applies in addition to section 29 of the Public

Governance, Performance and Accountability Act 2013 (which
2
deals with the duty to disclose interests).

Accountability Act 2013

(3) A disclosure by the Commissioner under section 29 of the Public
6
Governance, Performance and Accountability Act 2013 (which
7
deals with the duty to disclose interests) must be made to the
8
Minister.
9
(4) Subsection (3) applies in addition to any rules made for the
10
purposes of that section.

(5) For the purposes of this Act and the Public Governance,
12
Performance and Accountability Act 2013, the Commissioner is
13
taken not to have complied with section 29 of that Act if he or she
14
does not comply with subsection (3) of this section.

26XG Other terms and conditions
16
The Commissioner holds office on the terms and conditions (if
17
any) in relation to matters not covered by this Act that are
18
determined by the Governor-General.
19
26XH Resignation
20
(1) The Commissioner may resign his or her appointment by giving
21
the Governor-General a written resignation.
22
(2) The resignation takes effect on the day it is received by the
23
Governor-General or, if a later day is specified in the resignation,
24
on that later day.
25
26XI Termination of appointment
26
(1) The Governor-General may terminate the appointment of the
27
Commissioner:
28
(a) for misbehaviour; or
29
(b) if the Commissioner is unable to perform the duties of his or
30
her office because of physical or mental incapacity.

(2) The Governor-General must terminate the appointment of the
1
Commissioner if:
2
(a) the Commissioner:
3
(i) becomes bankrupt; or
4
(ii) takes steps to take the benefit of any law for the relief of
5
bankrupt or insolvent debtors; or
6
(iii) compounds with one or more of his or her creditors; or
7
(iv) makes an assignment of his or her remuneration for the
8
benefit of one or more of his or her creditors; or
9
(b) the Commissioner is absent, except on leave of absence, for
10
14 consecutive days or for 28 days in any 12 months; or
11
(c) the Commissioner engages, except with the Minister's
12
approval, in paid work outside the duties of his or her office
13
(see section 26XE); or
14
(d) the Commissioner fails, without reasonable excuse, to
15
comply with:
16
(i) subsection 26XF(1) (which deals with the disclosure of
17
interests under this Act); and
18
(ii) section 29 of the Public Governance, Performance and
19
Accountability Act 2013 (which deals with the duty to
20
disclose interests under that Act) or rules made for the
21
purposes of that Act.
22
26XJ Commissioner may engage consultants
23
(1) The Commissioner may engage consultants to assist in the
24
performance of the Commissioner's functions, other than:
25
(a) the issuing of rules under section 17; or
26
(b) the making of determinations for the purposes of section 52.
27
(2) The consultants are to be engaged on the terms and conditions that
28
the Commissioner determines in writing.

26XK Delegation by Commissioner
30
Delegation to AHRC staff member
31
(1) The Commissioner may, in writing, delegate all or any of the
32
Commissioner's functions or powers to an AHRC staff member,
33
other than:

(a) the issuing of rules under section 17; or
1
(b) the making of determinations for the purposes of section 52.

Delegation to staff of the Ombudsman
3
(2) The Commissioner may, in writing, delegate all or any of the
4
Commissioner's functions or powers conferred by Part V (other
5
than section 52) to a person who is a member of the staff of the
6
Ombudsman.
7
Directions to delegates
8
(3) In exercising any powers or performing any functions under the
9
delegation, the delegate must comply with any directions of the
10
Commissioner.

26XL Annual report
12
(1) The Commissioner must, as soon as practicable after the end of
13
each financial year, prepare and give to the Minister a report on the
14
performance, during the year, of the functions conferred on the
15
Commissioner by section 27.
16
(2) The report must also include information about the operation,
17
during the financial year, of registered APP codes that contain
18
procedures for making and dealing with complaints in relation to
19

In this Schedule:

AIC Act means the Australian Information Commissioner Act 2010, as

in force immediately before the commencement day.

asset means:

(a) any legal or equitable estate or interest in real or personal

property, whether actual, contingent or prospective; and
10
(b) any right, power, privilege or immunity, whether actual,
11
contingent or prospective.

commence, in relation to an enterprise agreement, means begin to
13
operate.
14
commencement day means the day on which this item commences.
15
covers has the same meaning as in the Fair Work Act 2009.
16
designated agreement means the agreement known as the Office of the
17
Australian Information Commissioner Enterprise Agreement 2011-
18
2014.

enterprise agreement has the same meaning as in the Fair Work Act

2009.

FOI Act means the Freedom of Information Act 1982.

IC review has the meaning given by section 54G of the FOI Act, as in

(1)
This item applies if:

(a) an IC review application in relation to an IC reviewable
5
decision was made before the commencement day; and
6
(b) immediately before that day, no decision has been made
7
under section 54W or 55K of the FOI Act in relation to the
8
application.

Deemed application for review by the Tribunal
10
(2)
On the commencement day, an application (the deemed application) is
11
taken to have been made to the Tribunal for review of the IC reviewable
12
decision.
13
(3)
The following apply in relation to the deemed application in the same
14
way as they apply in relation to an application for review by the
15
Tribunal made under section 57A of the FOI Act:
16
(a) Divisions 3 to 7 of Part VIIA of the FOI Act, as amended by
17
Schedule 1 to this Act;
18
(b) the Administrative Appeals Tribunal Act 1975 and the
19
regulations made under that Act (other than the provisions
20
relating to the payment of fees of a kind mentioned in
21
subsection 70(2) or (3) of that Act), as they are in force on

(b) immediately before that day, an application has not been

made under section 57A of that Act for review by the

Tribunal of:

such an application has not ended (including any extensions

of that time under section 29 of the Administrative Appeals

Despite the repeal of section 57A of the FOI Act by Schedule 1 to this
19
Act, that section, as in force immediately before the commencement
20
day, continues to apply in relation to the IC decision or IC reviewable
21
decision (as the case may be) as if that repeal had not happened.

(3)
If an application for review is made to the Tribunal as a result of the
23
continued application of section 57A of the FOI Act by subitem (2) of
24
this item then the following apply in relation to the application:
25
(a) Divisions 3 to 7 of Part VIIA of the FOI Act, as amended by
26
Schedule 1 to this Act;
27
(b) the Administrative Appeals Tribunal Act 1975 and the
28
regulations made under that Act, as they are in force on and
29
after the commencement day.

(1)
This item applies if:

5 Incomplete investigations of complaints by the Information

(1)
This item applies if:

(a) before the commencement day, a person made a complaint to
14
the Information Commissioner under section 70 of the FOI
15
Act; and
16
(b) immediately before that day, both of the following apply:
17
(i) the Information Commissioner has not transferred the
18
complaint to the Ombudsman under section 74 of that
19
Act;
20
(ii) the Information Commissioner has not given a notice
21
under subsection 75(3) or 86(1) of that Act in relation to
22
the complaint.

(2)
On the commencement day, the complaint is taken to be a complaint
24
made to the Ombudsman under the Ombudsman Act 1976.

6 Saving of protection from civil proceedings etc. provisions

Despite the repeal of sections 55Z, 85 and 89E of the FOI Act by

(a) for the balance of the person's term of appointment that

remained immediately before that day; and
9
(b) on the same terms and conditions as applied to the person
10
immediately before that day.

(2)
This item does not prevent those terms being varied on or after the

commencement day.

(1)
If, before the commencement day, a thing was done by, or in relation to,

12 Employees of the Australian Human Rights Commission

Transferring employees
5
(1)
For the purposes of this item, a person is a transferring employee if:
6
(a) the person was an APS employee in the Office of the AIC
7
immediately before the commencement day; and
8
(b) the person is covered by a determination that:
9
(i) is made under section 72 of the Public Service Act 1999;
10
and
11
(ii) causes the person, on the commencement day, to
12
become an APS employee in the Australian Human
13
Rights Commission.
14
(2)
If:
15
(a) a person is a transferring employee; and
16
(b) immediately before the commencement day, the designated
17
agreement applied to the person's employment in the Office
18
of the AIC;
19
then:
20
(c) the designated agreement (as in force immediately before the
21
commencement day) covers the Commonwealth and the
22
transferring employee in relation to the transferring
23
employee's employment in the Australian Human Rights
24
Commission; and
25
(d) the designated agreement has effect on and after the
26
commencement day, in relation to the transferring
27
employee's employment in the Australian Human Rights
28
Commission, as if it had been made by the President of the
29
Australian Human Rights Commission on behalf of the
30
Commonwealth; and
31
(e) if:
32
(i) an enterprise agreement commences after the
33
commencement day; and

paragraphs (c) and (d) cease to apply in relation to the

transferring employee when the enterprise agreement
9
commences.

(3)
If:
11
(a) a person is a transferring employee; and
12
(b) immediately before the commencement day, a determination
13
under subsection 24(1) of the Public Service Act 1999
14
applied to the person's employment in the Office of the AIC;
15
then:
16
(c) the determination (to the extent to which it relates to the
17
transferring employee) has effect on and after the
18
commencement day, in relation to the transferring
19
employee's employment in the Australian Human Rights
20
Commission, as if:
21
(i) the determination had been made by the President of the
22
Australian Human Rights Commission; and
23
(ii) the determination were applicable to the person's
24
employment in the Australian Human Rights
25
Commission; and
26
(d) paragraph (c) does not prevent the variation or revocation of
27
the determination.

New employees
29
(4)
For the purposes of this item, a person is a new employee if:
30
(a) the person is an APS employee in the Australian Human
31
Rights Commission; and
32
(b) the person is not a transferring employee.
33
(5)
If:
34
(a) the designated agreement covers the Commonwealth because
35
of subitem (2); and

(b) after the commencement day, a person becomes a new

Office of the AIC immediately before the commencement
7
day; and
8
(d) the President of the Australian Human Rights Commission,
9
by written notice given to the new employee before or within
10
14 days after the person becomes a new employee,
11
determines that the designated agreement is applicable to the
12
new employee for the purposes of this subitem from the time
13
when the person becomes a new employee;
14
then:
15
(e) the designated agreement (as in force immediately before the
16
commencement day) covers the Commonwealth and the new
17
employee in relation to the new employee's employment in
18
the Australian Human Rights Commission; and
19
(f) the designated agreement has effect on and after the
20
commencement day, in relation to the new employee's
21
employment in the Australian Human Rights Commission, as
22
if it had been made by the President of the Australian Human
23
Rights Commission; and
24
(g) if:
25
(i) an enterprise agreement commences after the
26
commencement day; and
27
(ii) the enterprise agreement was made by the President of
28
the Australian Human Rights Commission on behalf of
29
the Commonwealth; and
30
(iii) the enterprise agreement covers the Commonwealth and
31
the new employee in relation to the new employee's
32
employment in the Australian Human Rights
33
Commission;
34
paragraphs (e) and (f) cease to apply in relation to the new
35
employee when the enterprise agreement commences.

(6)
The President of the Australian Human Rights Commission may, in

writing, delegate the power conferred by paragraph (5)(d) to:

(a) the Australian Privacy Commissioner; or
4
(b) a person who is:
5
(i) a member of the staff of the Australian Human Rights
6
Commission; and
7
(ii) an SES employee or acting SES employee; or
8
(c) a person who is:
9
(i) a member of the staff of the Australian Human Rights
10
Commission; and
11
(ii) an APS employee who holds or performs the duties of
12
an Executive Level 2 position or an equivalent position.

Determination is not a legislative instrument
14
(7)
A determination made under paragraph (5)(d) is not a legislative

instrument.

13 Separate agreements relating to employment

If, under either or both of subitems 12(2) and (5), the designated
18
agreement covers the Commonwealth and one or more employees in
19
relation to their employment in the Australian Human Rights
20
Commission, the Fair Work Act 2009 and the Fair Work (Transitional
21
Provisions and Consequential Amendments) Act 2009 have effect as if
22
the following were separate agreements:
23
(a) the designated agreement, so far as it has the coverage
24
mentioned in this item;
25
(b) the designated agreement, so far as it does not have the
26
coverage mentioned in this item.

14 Application of the Safety, Rehabilitation and
28
Compensation Act 1988
29
(1)
This item applies if, before the commencement day, an employee of the
30
Office of the AIC suffered an injury resulting in an incapacity for work
31
or an impairment.

(2)
Sections 36, 37, 38, 39, 41 and 41A of the Safety, Rehabilitation and
33
Compensation Act 1988 apply on and after the commencement day, in

On and after the commencement day, the Australian Human Rights

Commission is, for the purposes of section 40 of the Safety,

Rehabilitation and Compensation Act 1988, taken to be the relevant

This item does not prevent those terms and conditions being varied after

the commencement day.

16 Transfer of records to the Australian Privacy

25
(1)
This item applies to any records or documents:

(a) that, immediately before the commencement day, were in the
27
possession of the Information Commissioner or a member of
28
the staff of the Office of AIC; and
29
(b) that relate to a privacy purpose.

(2)
The records and documents are to be transferred to the Australian
31
Privacy Commissioner on or after the commencement day.

17 Unauthorised dealing with information

(1)
This item applies to information acquired, before the commencement

day, by a person in the course of performing functions or exercising

powers conferred for the purposes of:

(a) the information commissioner functions (within the meaning

of the AIC Act); or
6
(b) the freedom of information functions (within the meaning of
7
the AIC Act); or
8
(c) the privacy functions (within the meaning of the AIC Act).

(2)
Despite the repeal of section 29 of the AIC Act, that section (as in force

immediately before the commencement day) continues to apply in

relation to the information as if that repeal had not happened.

(1)
This item applies if:

(a) before the commencement day, a person who made a request

under section 15 of the FOI Act agreed in writing to an

extension of a period referred to in section 15AA of that Act;

(b) immediately before that day, the notice referred to in
8
paragraph 15AA(b) of that Act had not been given.

(2)
On the commencement day, section 15AA as amended by Schedule 1 to
10
this Act is taken to apply in relation to the agreement.

19 Saving of extensions of time under section 15AB of the

FOI Act
13
(1)
This item applies if:

(a) before the commencement day, the Information

Commissioner extended the period referred to in
16
paragraph 15(5)(b) of the FOI Act by a further period under

subsection 15AB(2) of that Act; and
18
(b) immediately before that day, the further period has not ended.

(2)
Despite the repeal of section 15AB of the FOI Act by Schedule 1 to this

Act, the extension continues to have effect on and after the

commencement day as if the repeal had not happened.

(1)

(a) before the commencement day, the Information

Commissioner allowed further time under

21 Saving of determination

A determination that:

(a) was made under subsection 11C(2) of the FOI Act; and

(b) was in force immediately before the commencement day;

continues in force (and may be dealt with) on and after that day as if it
11
had been made under that subsection as amended by Schedule 1 to this
12
Act.

22 Rules may prescribe matters of a transitional nature
14
(1)
The Attorney-General may, by legislative instrument, make rules
15
prescribing matters of a transitional nature (including prescribing any
16
saving or application provisions) relating to the amendments or repeals
17
made by this Act.
18
(2)
Without limiting subitem (1), the rules may:
19
(a) provide for matters of a transitional nature in relation to the
20
transfer of APS employees from the Office of the AIC to the
21
Australian Human Rights Commission; or
22
(b) make provision for the transfer of the assets or liabilities of
23
the Commonwealth that relate to the Office of the AIC.
