The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Fairer Private Health Insurance
5
Incentives (Medicare Levy Surcharge) Act 2011.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

1 Subsection 3(1)

Insert:

family tier 1 threshold, of a person for a year of income, means the
6
family tier 1 threshold (within the meaning of the Private Health
7
Insurance Act 2007) of the person for the financial year
8
corresponding to the year of income.

2 Subsection 3(1) (definition of singles surcharge threshold)

Repeal the definition.

3 Subsection 3(1)

Insert:

singles tier 1 threshold, of a person for a year of income, means

the singles tier 1 threshold (within the meaning of the Private

Health Insurance Act 2007) of the person for the financial year

corresponding to the year of income.

(1) Subject to this section, for the purposes of this Act:

(a) tier 2 earner, for a year of income, means a tier 2 earner

(within the meaning of the Private Health Insurance Act
2
2007) for the financial year corresponding to the year of

income; and

(b) tier 3 earner, for a year of income, means a tier 3 earner
5
(within the meaning of that Act) for the financial year
6
corresponding to the year of income.

(2) In determining whether a person is a tier 2 earner or tier 3 earner
8
for a year of income for the purposes of this Act, section 22-30 of
9
the Private Health Insurance Act 2007 operates with the
10
modification set out in subsection (3).

(3) Replace paragraph 22-30(1)(b) of the Private Health Insurance Act
12
2007 with the following paragraph:
13
(b) on any day in the year, the person has one or more
14
dependants (within the meaning of the A New Tax System
15
(Medicare Levy Surcharge--Fringe Benefits) Act 1999),
16
other than a dependant to whom the person is married (within
17
the meaning of that Act):

24 Transitional--2011-12 year of income

(1)
Subitem (2) applies to an increase under section 8B, 8C or 8D of the
3
Medicare Levy Act 1986 of the amount of the levy payable by a person
4
under that Act for the 2011-12 year of income.

(2)
The amount of the increase worked out under that section is treated as
6
being the total of:
7
(a) the amount that would be the amount of the increase under
8
that section if:
9
(i) the amendments made by this Schedule did not apply to
10
the year of income; and
11
(ii) that section were treated as not applying to the person
12
for any day after 31 December 2011; and
13
(b) the amount that would be the amount of the increase under
14
that section, as amended by this Schedule, if that section
15
were treated as not applying to the person for any day before
16
1 January 2012.

Trustees

(3)
Subitem (4) applies to an increase under section 8E, 8F or 8G of the
19
Medicare Levy Act 1986 of the amount of the levy payable under that
20
Act by a trustee of a trust estate in that capacity in relation to a
21
beneficiary of the trust estate for the 2011-12 year of income.

(4)
The amount of the increase worked out under that section is treated as
23
being the total of:
24
(a) the amount that would be the amount of the increase under
25
that section if:
26
(i) the amendments made by this Schedule did not apply to
27
the year of income; and
28
(ii) that section were treated as not applying to the
29
beneficiary for any day after 31 December 2011; and
30
(b) the amount that would be the amount of the increase under
31
that section, as amended by this Schedule, if that section
32
were treated as not applying to the beneficiary for any day
33
before 1 January 2012.
