A Bill for an Act to amend the Fair Work Act 2009,

The  Parliament of Australia  enacts:

1  Short  title 

4 

 

  This Act may be cited as the Fair Work Amendment (Prohibiting 

5 

Discrimination Based On Location) Act 2015. 

6 

2  Commencement 

7 

 

  This Act commences on the day after this Act receives the Royal 

8 

Assent.

351A  Discrimination  based on where  a person lives 

6 

 

(1)  An employer must not take adverse action against a person who is 

7 

an employee, or prospective employee, of the employer because of 

8 

where the person lives. 

9 

Note: 

This subsection is a civil  remedy provision (see Part 4-1). 

10 

 

(2)  However, subsection (1) does not apply  to action that is taken 

11 

because of the inherent requirements of the particular position 

12 

concerned.
