The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act is the Fair Work Amendment (Terminating Enterprise 

5 

Agreements) Act 2017.

2  Commencement 

7 

 

(1)  Each provision of this Act specified in column 1 of the table 

8 

commences, or is taken to have commenced, in accordance with 

9 

column 2 of the table. Any other statement in column 2 has effect 

10 

according to its terms.

(2)  The FWC must not consider it appropriate to terminate the 

8 

enterprise agreement if the terms and conditions of employment of 

9 

any employee covered by the agreement would, immediately after 

10 

the termination, be less favourable than the employee's terms and 

11 

conditions of employment immediately before the termination. 

12 

 

(3)  A decision of the FWC to terminate an enterprise agreement under 

13 

this section is of no effect, and is taken never to have had any 

14 

effect, if: 

15 

 

(a)  the decision was made on or after 22 April 2015 and before 

16 

the commencement of this subsection; and 

17 

 

(b)  the FWC could not have made the decision had 

18 

subsection (2) been in force at the time of the decision.
