The Parliament of Australia enacts:

1 Short title

This Act is the Fair Work Amendment (Protecting Weekend Pay
5
and Penalty Rates) Act 2017.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

subsection 135B(5).

135A Protecting penalty rates
20
(1) A penalty rate in a modern award cannot be varied to make the
21
penalty rate lower than that in force under the award on 1 January
22
2017.

(2) A determination of the FWC made on or after 22 February 2017
24
that would reduce a penalty rate in a modern award so that the
25
penalty rate would be lower than that in force under the award on
26
1 January 2017 has no effect.

135B Protecting take-home pay

Object of this section
2
(1) The object of this section is to ensure that no employee's, or
3
prospective employee's, take-home pay is reduced as a result of a
4
variation of a modern award.

FWC cannot reduce take-home pay
6
(2) A modern award cannot be varied in a way that would, or would be
7
likely to, reduce the take-home pay of any employee covered by
8
the award.

Determinations reducing take-home pay of no effect
10
(3) A determination of the FWC made on or after 22 February 2017
11
that would, or would be likely to, have the effect of reducing the
12
take-home pay of any employee covered by a modern award is of
13
no effect.

Definition of take-home pay
15
(4) The take-home pay of an employee covered by a modern award is
16
the pay the employee actually receives, or would receive:
17
(a) including wages and incentive-based payments, and
18
additional amounts such as allowances and overtime; but
19
(b) disregarding the effect of any deductions that are made as
20
permitted by section 324.

Note:
Deductions permitted by section 324 may (for example) include
22
deductions under salary sacrificing arrangements.

Definition of reduction in take-home pay

(5) An employee covered by a modern award suffers a reduction in
25
take-home pay through a variation of the award if the amount of
26
the employee's take-home pay for working particular hours or for a
27
particular quantity of work would be less after the variation than it
28
would have been before.
