The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Geothermal and Other Renewable
6
Energy (Emerging Technologies) Amendment Act 2009.

2 Commencement

This Act commences on the day on which it receives the Royal
9
Assent.

(3) The following table sets out the emerging technologies and their

features that qualify as providing emerging renewable energy

source electricity for the purposes of subsection (1):

(4) The regulations may provide for additional emerging technologies

to be added to the table in subsection (3).

(5) A generation unit for a technology listed in subsection (3) must be
3
1 MW capacity or greater to qualify as emerging capacity capable
4
of providing emerging renewable energy source electricity for the
5
purposes of subsection (1).
6
(6) The regulations must make provision for the inclusion of emerging
7
renewable energy source electricity in relation to:
8
(a) the acquisition of electricity by a liable entity;
9
(b) the creation and transfer of certificates;
10
(c) the calculation of the renewable power percentage for a year;
11
(d) the required renewable energy of a liable entity for a year;
12
(e) the surrender of certificates by a liable entity for a year;
13
(f) the renewable energy certificate shortfall of a liable entity for
14
a year.
