A Bill for an Act to
amend the Higher Education Funding Act 1988,
and for related purposes
The Parliament of Australia enacts:
This Act may be cited as the Higher Education Funding Amendment Act
(No. 2) 1996.
This Act commences on the day on which it receives the Royal
Assent.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.
Higher
Education Funding Act 1988
1 Sections 25A and 25B
Repeal the sections.
2 Effect of repeal of sections 25A and
25B
(1) Despite any provision of any other Act, financial assistance is
not payable in respect of a year after 1996 under:
(a) section 25A of the Higher Education Funding Act 1988;
or
(b) section 25B of the Higher Education Funding Act 1988.
(2) If, before the repeal day, the Minister has authorised payment of an
amount by way of financial assistance to a student organisation in respect of a
year before 1997 under section 25B of the Higher Education Funding Act
1988, that section continues to apply, despite its repeal, in relation to
that student organisation in respect of that payment.
(3) If an amount purporting to have been paid by way of financial
assistance under section 25B of the Higher Education Funding Act 1988, as
in force immediately before the repeal day or as that section is continued in
force under subitem (2), should not have been paid, the amount is a debt due to
the Commonwealth and is recoverable in a court of competent
jurisdiction.
(4) Subject to subitem (5), expressions used in this item have the same
meanings as in the Higher Education Funding Act 1988.
(5) In this item:
repeal day means the day on which item 1 commences.
student organisation has the same meaning as in section 25B
of the Higher Education Funding Act 1988.
