The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Higher Education Support
5
Amendment Act 2009.

2 Commence ment
7
This Act commences on the day on which it receives the Royal
8
Assent.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or
11
repealed as set out in the applicable items in the Schedule
12
2 Higher Education Support Amendment Bill 2009 No. , 2009
concerned, and any other item in a Schedule to this Act has effect

according to its terms.

Omit "fulfilled the

VET tuition assurance requirements on the date of

making an application under clause 9", substitute "fulfils the

VET

tuition assurance requirements".

3 Subclause 11(2) of Schedule 1A

Repeal the subclause, substitute:

(2) For the purposes of paragraph 6(f):

(a) the Minister may be satisfied that a body corporate is willing
15
and able to meet the
*
VET quality and accountability
16
requirements if the body gives the Minister such written
17
undertakings as the Minister requires; and
18
(b) the Minister may be satisfied that a body corporate is willing
19
and able to meet:
20
(i) the
*
VET quality and accountability requirements; or
21
(ii) one or more of the requirements referred to in
22
paragraphs 13(1)(a) to (f);
23
if a body approved under the
*
VET Provider Guidelines so
24
recommends in accordance with those guidelines.

(2A) Subclause (2) does not limit the circumstances in which the
26
Minister may be satisfied, for the purposes of paragraph 6(f), that a
27
body corporate is willing and able to meet the
*
VET quality and
28
accountability requirements.
