1 Short title
7
This Act may be cited as the Home Insulation Program
8
(Commission of Inquiry) Act 2011.

2 Commencement

This Act commences on the day after it receives the Royal Assent.

This Act binds the Crown.

4 Definitions

In this Act:
6
Agency has the meaning given by section 7 of the Public Service
7
Act 1999.
8
Agency Head has the meaning given by section 7 of the Public
9
Service Act 1999.
10
Commission means the Commission of Inquiry into the Home
11
Insulation Program established under section 6.
12
Commissioner means the Commissioner appointed under section
13
6.
14
Home Insulation Program means the Home Insulation Program
15
and all its subprograms and related programs including the Home
16
Insulation Safety Program and the the Foil Insulation Safety
17
Program.
18
Judge means a Judge of a court created by the Parliament or of the
19
Supreme Court of a State or Territory.
20
legal practitioner means a barrister, a solicitor, a barrister and
21
solicitor, or a legal practitioner, of the High Court or of the
22
Supreme Court of a State or Territory.
23
offence against this Act includes an offence against Chapter 7 of
24
the Criminal Code that relates to this Act.
25
President means the President of the Senate.
26
Speaker means the Speaker of the House of Representatives.

5 Ministerial responsibility for this Act

The Attorney-General is the Minister responsible for administering
2
this Act.

6 Establishment of Commission
8
(1) A Commission is established by this subsection, to be known as the
9
Commission of Inquiry into the Home Insulation Program.
10
(2) The Commission is constituted by a Commissioner appointed for
11
this subsection by a resolution of each House of the Parliament.
12
(3) A person is not eligible for appointment as Commissioner unless
13
the person is or has been a Judge.

7 Terms of reference
15
Ministerial actions
16
(1) The Commission is to inquire and advise the Parliament on:
17
(a) what warnings and advice on the Home Insulation Program
18
were received by Ministers (whether directly or through
19
agencies) from any of the following:
20
(i)
industry;
21
(ii)
Commonwealth
agencies;
22
(iii) State and Territory agencies;
23
(iv)
unions;
24
(v) members of the public; and
25
(b) any decisions by a Minister, or Ministers, to reject such
26
warnings or advice.

Actions by agencies

(2) The Commission is to inquire and advise the Parliament on:
2
(a) what the Home Insulation Program required of:
3
(i) Commonwealth officers and agencies; and
4
(ii) State and Territory governments and agencies; and
5
(iii)
contractors;
6
including informal requirements as well as those expressed in
7
protocols, guidelines, procedures, conditions and timetables;
8
and
9
(b) whether those requirements were adequate to ensure that:
10
(i) they would be complied with; and
11
(ii) appropriate standards of quality and safety would be
12
met; and
13
(ii) the Program would achieve value for money; and
14
(c) what warnings and advice on the Program were received by
15
agencies from any of the following:
16
(i)
industry;
17
(ii) State and Territory agencies;
18
(iii)
unions;
19
(iv) members of the public; and
20
(d) any decisions by agencies to:
21
(i) reject such warnings or advice; or
22
(ii) advise Ministers to reject such warnings or advice; and
23
(e) how the Program's requirements were applied in practice
24
and, in particular, what was the response of the
25
Commonwealth to such warnings or advice; and
26
(f) whether all relevant Commonwealth procurement and other
27
guidelines and procedures were complied with.

Responsibility

(3) The Commission is to inquire and advise the Parliament on
2
whether and to what extent any decisions or omissions by
3
Ministers or agencies caused or contributed to the loss of lives, loss
4
of property, incidence of fraud and incidence of fire under the
5
Home Insulation Program.

8 Report to the Parliament
7
(1) The Commission must submit to the President and the Speaker a
8
report containing:
9
(a) its findings of fact; and
10
(b) any recommendations relevant to the inquiry that the
11
Commissioner thinks fit.
12
(2) The report must be submitted on or before 1 November 2011,
13
unless that date is extended by a resolution of each House of the
14
Parliament.
15
(3) The Commission must submit with its report a record of so much
16
of the evidence before the Commission as the Commissioner thinks
17
necessary to substantiate its findings of fact and its conclusions.
18
(4) If the Commission is of the opinion that, if any of its findings or
19
conclusions or any of the evidence given before the Commission
20
were to be laid before the Houses of the Parliament:
21
(a) a person who has been or may be charged with an offence
22
might not receive a fair trial for the offence; or
23
(b) the conduct of an investigation of a breach or possible breach
24
of the law, might be prejudiced; or
25
(c) the existence or identity of a confidential source of
26
information in relation to the enforcement or administration
27
of the law might be disclosed or a person enabled to ascertain
28
the existence or identity of that source; or
29
(d) there might be prejudice to the safety or reputation of a
30
person;
31
the Commission may submit those findings or conclusions, or that
32
evidence, to the President and the Speaker in a separate report,
33
together with a statement of its opinion.

(5) As soon as practicable after receiving the report and record of

evidence, the President and the Speaker must cause copies of the
2
report and record, other than a separate report submitted under
3
subsection (4), to be laid before the Senate and the House of
4
Representatives.

9 Hearings
7
(1) For the purposes of its inquiry the Commission may hold hearings
8
at places in Australia determined by the Commission.
9
(2) A hearing is to be public unless the Commissioner decides that the
10
circumstances require the hearing, or part of the hearing, to be held
11
in private.
12
(3) A hearing may be recorded or broadcast by media representatives
13
in a manner determined by the Commissioner, unless the
14
Commissioner decides that the circumstances require that the
15
hearing, or part of the hearing, should not be broadcast or recorded.
16
(4) A person who appears before the Commission, or who is or is
17
likely to be affected by evidence given before the Commission,
18
may be represented by a legal practitioner.
19
(5) If a hearing is to be conducted in private, the only persons who
20
may be present are persons authorised by the Commissioner and
21
legal practitioners representing them.
22
(6) Subject to this Act, a hearing may be conducted as the
23
Commissioner thinks fit.
24
(7) The Commission must make a record of a hearing.
25
10 Publication
26
(1) The following must not be published except in accordance with a
27
direction of the Commissioner:
28
(a) evidence given before the Commission;

(b) the contents of a document, or a description of a thing,

produced to the Commission or seized pursuant to a warrant
2
issued under section 12;
3
(c) any information that might enable a person who has given
4
evidence before the Commission to be identified;
5
(d) the fact that any person has given or may be about to give
6
evidence at a hearing.

(2) The Commissioner must not give a direction to publish such
8
material if to do so might prejudice the safety or reputation of a
9
person or prejudice the fair trial of a person who has been or might
10
be charged with an offence.

11 Counsel assisting the Commission
12
The Commission may appoint a legal practitioner to assist the
13
Commission as counsel, either generally or in relation to a
14
particular matter or matters.
15
12 Power to summon witnesses and take evidence
16
(1) The Commissioner may, by a written summons signed by the
17
Commissioner and served on a person, summon the person to
18
attend a hearing at a time and place specified in the summons:
19
(a) to give evidence; or
20
(b) to produce documents or things specified in the summons.
21
(2) At a hearing, the Commissioner may:
22
(a) require a witness either to take an oath or to make an
23
affirmation; and
24
(b) administer the oath or affirmation to the witness.
25
(3) At a hearing, the following persons may, so far as the
26
Commissioner thinks appropriate, examine or cross--examine any
27
witness on any matter that the Commissioner considers relevant:
28
(a) counsel assisting the Commissioner;
29
(b) a person summoned or otherwise authorised to appear before
30
the Commissioner;

(c) a legal practitioner representing a person authorised to appear

before the Commissioner.

(4) The Commissioner may require a witness to answer any question
3
that the Commissioner considers relevant.

13 Exception to privilege for Cabinet documents
5
(1) This section applies if a person who is required to produce a
6
document under paragraph 12(1)(b) claims that the document is
7
privileged from production on the ground that:
8
(a) it is, or relates to, a document that was brought into
9
existence for the dominant purpose of submission for
10
consideration by the Cabinet; or
11
(b) its disclosure would involve the dislosure of a deliberation or
12
decision of the Cabinet.
13
(2) If the Commissioner determines that the document, or a portion of
14
it, is relevant to the inquiry, then even if, apart from this section,
15
the document would be privileged from production on that ground,
16
the Commissioner may order that the document, or the relevant
17
portion, be:
18
(a) disclosed to the persons specified by the Commissioner; or
19
(b) entered into the record of the inquiry;
20
as appropriate to fulfil the purpose of the inquiry.
21
14 Self-incrimination
22
(1) A person is not excused from producing a document or other thing
23
under paragraph 12(1)(b) on the ground that the document or other
24
thing might tend to incriminate the person or expose the person to a
25
penalty.
26
(2) A person is not excused from answering a question under
27
subsection 12(4) on the ground that the answer to the question
28
might tend to incriminate the person or expose the person to a
29
penalty.

15 Statement made by witness not admissible in evidence

The following are not admissible in evidence in any civil or
2
criminal proceedings, except in proceedings for an offence against
3
this Act:
4
(a) a statement or disclosure made, or a document or thing
5
produced, by a witness in the course of giving evidence
6
before the Commission;
7
(b) any information, document or thing obtained as a direct or
8
indirect consequence of the statement or disclosure or the
9
production of the document or thing.

16 Arrest of witness failing to appear
11
(1) If a person served with a summons to attend before the
12
Commission as a witness fails to attend in accordance with the
13
summons, the Commissioner may, on proof of the service of the
14
summons, issue a warrant to arrest the person.
15
(2) A warrant authorises the arrest of the witness, the bringing of the
16
witness before the Commission and the detention of the witness in
17
custody for that purpose until the witness is released by order of
18
the Commissioner.
19
(3) A warrant may be executed by any member of the Australian
20
Federal Police or of the police force of a State or Territory, and the
21
person executing the warrant has power to break and enter any
22
place, building or vessel in order execute it.
23
(4) The arrest of the witness under this section does not relieve the
24
witness from any liability incurred by reason of non--compliance
25
with the summons.

17 Search warrants
27
(1) The Commissioner may issue a search warrant if:
28
(a) the Commissioner has reasonable grounds for suspecting that
29
there may be relevant material, at that time or within the next
30
24 hours, upon any land or upon or in any premises, vessel,
31
aircraft or vehicle; and

(b) the Commissioner believes on reasonable grounds that, if a
1
summons were issued for the production of the material, it
2
might be concealed, lost, mutilated or destroyed.

(3) A search warrant authorises a member of the Australian Federal
4
Police or of the Police Force of a State or Territory, in accordance
5
with its terms:
6
(a) to enter upon the land or upon or into the premises, vessel,
7
aircraft or vehicle; and
8
(b) to search the land, premises, vessel, aircraft or vehicle for
9
relevant material; and
10
(c) to seize any relevant items found upon the land or upon or in
11
the premises, vessel, aircraft or vehicle and deliver things
12
seized to the Commission; and
13
(d) to make copies or extracts, including electronic copies or
14
extracts, of any relevant documents found.
15
(4) A search warrant must:
16
(a) state the purpose for which the warrant is issued; and
17
(b) state whether entry is authorised to be made at any time of
18
the day or night; and
19
(c) include a description of the kinds of things authorised to be
20
seized; and
21
(d) specify a day, not later than one month after the date of issue
22
of the warrant, at the expiration of which the warrant ceases
23
to have effect.
24
(5) If, in the course of searching for relevant material in accordance
25
with a search warrant, the person executing the warrant finds any
26
other thing that the person believes on reasonable grounds to be
27
connected with that material and the person believes on reasonable
28
grounds that it is necessary to seize that thing in order to prevent its
29
concealment, loss, mutilation or destruction, the warrant authorises
30
the person to seize that thing.

(6) For this section, material or a document is relevant if it has
32
evidential value relevant to the Commission's inquiry.

18 Powers of Commission in relation to documents and other things

(1) The Commission, or a person authorised in writing by the
2
Commissioner, may:
3
(a) inspect any documents or other things produced before, or
4
delivered to, the Commission; and
5
(b) retain the documents or other things for so long as is
6
reasonably necessary for the purposes of the Commission's
7
inquiry; and
8
(c) in the case of documents produced before, or delivered to, the
9
Commission, make copies of matter relevant to the
10
Commission's inquiry.
11
(2) Where a document or other thing is no longer needed by the
12
Commission for its inquiry, the Commission is to return the
13
document or thing to the person who appears to be entitled to it, or
14
deal with it at that person's direction.

Part 3--Offences

19 Unauthorised presence at hearing or publication of evidence
18
A person commits an offence if:
19
(a) the person is present at a private hearing of the Commission
20
without being authorised under subsection 9 (5); or
21
(b) the person publishes material in contravention of subsection
22
10 (1).
23
Penalty: Imprisonment for 6 months.
24
20 Failure of witnesses to attend or produce documents
25
(1) A person commits an offence if, when served with a summons to
26
appear as a witness at a hearing before the Commission:
27
(a) the person fails to attend as required by the summons; or
28
(b) the person fails to attend from day to day unless excused, or
29
released from further attendance, by the Commissioner.
30
Penalty: Imprisonment for 6 months.

(2) It is a defence to a prosecution for an offence against subsection (1)
1
if the person has a reasonable excuse.
2
(3) A person appearing as a witness at a hearing before the
3
Commission commits an offence if the person refuses or fails to
4
produce a document or other thing that the person was required to
5
produce by a summons under this Act served on the person or that
6
the person was required to produce by the Commissioner.
7
Penalty: Imprisonment for 6 months.
8
(4) It is a defence to a prosecution for an offence against subsection (3)
9
if:
10
(a) the document or other thing was not relevant to the matter
11
into which the Commission was inquiring; or
12
(b) the person has a reasonable excuse.
13
21 Refusal to be sworn or give evidence
14
(1) A person appearing as a witness at a hearing before the
15
Commission commits an offence if, without reasonable excuse:
16
(a) the person refuses or fails to comply when required pursuant
17
to subsection 12(2) either to take an oath or make an
18
affirmation; or
19
(b) the person refuses or fails to answer a question that the
20
person is required to answer by the Commissioner.
21
Penalty: Imprisonment for 6 months.
22
22 Acts or omissions on different days to constitute separate offences
23
If a person commits an offence under section 21, and the person
24
does or omits to do the same thing at a hearing of the Commission
25
held on some other day, each such act or omission constitutes a
26
separate offence.
27
23 False or misleading evidence
28
(1) A person commits an offence if, at a hearing before the
29
Commission, the person gives evidence that is to the knowledge of
30

the person false or misleading with respect to any matter that is
1
material to the inquiry being made by the Commission.
2
Penalty: Imprisonment for 5 years.

(2) A court of summary jurisdiction may hear and determine
4
proceedings in respect of such an offence if the court is satisfied
5
that it is proper to do so and the defendant and prosecutor consent.
6
Penalty: Imprisonment for 12 months.

24 Destroying documents or other things
8
(1) A person commits an offence if, knowing or having reasonable
9
grounds to believe that a document or other thing is or may be
10
required in evidence before the Commission, the person wilfully:
11
(a) conceals, mutilates or destroys the document or thing; or
12
(b) renders the document or thing incapable of identification; or
13
(c) in the case of a document, renders it illegible or
14
indecipherable.
15
Penalty: Imprisonment for 2 years.
16
(2) A court of summary jurisdiction may hear and determine
17
proceedings in respect of such an offence if the court is satisfied
18
that it is proper to do so and the defendant and the prosecutor
19
consent.
20
Penalty: Imprisonment for 12 months.
21
25 Intimidation or dismissal of witnesses
22
(1) A person commits an offence if the person uses, causes, inflicts, or
23
procures any violence, punishment, damage, loss or disadvantage
24
to a person because the person appeared as a witness before the
25
Commission or because of any evidence given by the person before
26
the Commission.
27
Penalty: Imprisonment for 5 years.

(2) An employer commits an offence if the employer dismisses an
1
employee from employment or prejudices an employee in
2
employment because the employee:
3
(a) appeared as a witness before the Commission; or
4
(b) gave evidence before the Commission; or
5
(c) produced a document or thing pursuant to a summons or
6
requirement under section 12.
7
Penalty: Imprisonment for 5 years.
8
(3) Subsection (2) does not apply if the employee was dismissed or
9
prejudiced in his or her employment for some reason other than the
10
reasons listed in that subsection.

26 Preventing witnesses from attending
12
A person commits an offence if the person wilfully prevents or
13
wilfully endeavours to prevent a person who has been summoned
14
to attend as a witness before the Commission from attending or
15
from producing anything in evidence in accordance with the
16
summons.
17
Penalty: Imprisonment for 12 months.

27 Bribery of witness
19
A person commits an offence if:
20
(a) the person gives, confers, or procures, or promises or offers
21
to give or confer, or to procure or attempt to procure, any
22
property or benefit of any kind to, upon, or for, any person,
23
upon any agreement or understanding that any person called
24
or to be called as a witness before the Commission will give
25
false testimony or withhold true testimony; or
26
(b) the person attempts by any means to induce a person called
27
or to be called as a witness before the Commission to give
28
false testimony or to withhold true testimony; or
29
(c) the person asks, receives or obtains or agrees or attempts to
30
receive or obtain any property or benefit of any kind, whether
31
for the person or for any other person, upon any agreement or
32

understanding that any person will as a witness before the
1
Commission give false testimony or withhold true testimony.
2
Penalty: Imprisonment for 5 years.

28 Fraud on witness
4
A person commits an offence if the person practises any fraud or
5
deceit, or knowingly makes or exhibits any false statement,
6
representation, token, or writing, to any person called or to be
7
called as a witness before the Commission with intent to affect the
8
testimony of that person as a witness
9
Penalty: Imprisonment for 2 years.

29 Contempt of Commission

A person commits an offence if:
12
(a) the person wilfully disturbs or disrupts a hearing of the
13
Commission; or
14
(b) the person makes any statement that is false and defamatory
15
of the Commission; or
16
(c) the person commits any wilful contempt of the Commission.

Penalty: Imprisonment for 12 months.

Part 4--Operation of the Commission

30 Death or incapacity of Commissioner
21
If the Commissioner dies, becomes physically or mentally
22
incapable of performing his or her functions or, by notice in
23
writing to the President and the Speaker, resigns his or her
24
appointment, the position of Commissioner becomes vacant and
25
the Senate and the House of Representatives are to appoint a new
26
Commissioner in accordance with subsection 6(2).

31 Remuneration and allowances
1
(1) The Commissioner is
2
to be paid the remuneration and allowances applicable to an acting Justice of the
3
Federal Court.
4
(2) If a Judge is appointed as the Commissioner, that person is not,
5
while receiving salary or annual allowance as a Judge, entitled to
6
remuneration under this Act.
7
(3) The person appointed as Commissioner ceases to hold office in that
8
capacity 7 days after submitting the report of the Commission to
9
the President and the Speaker.

(1) Subject to subsection (2), the staff of the Commission are to be

persons made available to the Commission by the President and the
13
Speaker.

(2) The President and the Speaker may arrange with an Agency Head
15
for the services of officers or employees in that Agency to be made
16
available to the Commission.
17
(3) While a person is performing services for the Commission
18
pursuant to this section, that person must perform his or her
19
functions and duties in accordance with the directions of the
20
Commissioner.

33 Protection of the Commissioner and others
22
(1) The Commissioner has, in the performance of his or her functions
23
and the exercise of his or her powers, the same protection and
24
immunity as a Justice of the High Court.
25
(2) A legal practitioner assisting the Commission or representing a
26
person at a hearing before the Commission has the same protection
27
and immunity as a barrister has in appearing for a party in
28
proceedings in the High Court.

(3) Subject to this Act, a person summoned to attend or appearing

before the Commission as a witness has the same protection as a
2
witness in proceedings in the High Court.

34 Legal and financial assistance
4
(1) A person who is appearing or is about to appear, or a person who is
5
entitled to appear, before the Commission may apply to the
6
Minister for assistance under this section.
7
(2) The Minister must obtain the advice of the President and the
8
Speaker in relation to an application.
9
(3) The President and the Speaker may, if they are satisfied that:
10
(a) it would involve substantial hardship to the person to refuse
11
the application; or
12
(b) the circumstances of the case are of such a nature that the
13
application should be granted;
14
request the Minister to authorise the provision by the
15
Commonwealth to that person such legal or financial assistance in
16
respect of that person's appearance as the President and the
17
Speaker determine.
18
(4) Any request by the President and the Speaker under this section is
19
to be either subject to conditions or unconditional.
20
(5) The Minister must comply with a request under subsections (3) and
21
(4).

35 Reimbursement of witness expenses

(1) A witness who appears before the Commission in answer to a
24
summons may be paid expenses in accordance with the scale that
25
applies to witnesses appearing before the High Court.
26
(2) The Commission may direct that a witness who appears before a
27
Commission without a summons may be paid expenses in
28
accordance with that scale.
29
(3) In applying that scale to a witness, the Commissioner has the
30
powers and functions of the taxing officer.

36 Commission may communicate information
1
Where, in the course of its inquiry, the Commission obtains
2
information that relates, or may relate, to the commission of an
3
offence, or evidence of the commission of an offence against a law
4
of the Commonwealth, of a State or of a Territory, the Commission
5
may, if in the opinion of the Commission it is appropriate to do so,
6
communicate the information or give the evidence to:
7
(a) the Attorney-General of the Commonwealth or of a State or
8
Territory; or
9
(b) the Australian Crime Commission; or
10
(c) the Commissioner of the Australian Federal Police or of the
11
Police Force of a State or Territory; or
12
(d) the authority or person responsible for the administration or
13
enforcement of that law.

37 Regulations

The Governor-General may make regulations, not inconsistent with
16
this Act, prescribing matters:
17
(a) required or permitted by this Act to be prescribed; or
18
(b) necessary or convenient to be prescribed for carrying out or
19
giving effect to this Act.
