The Parliament of Australia enacts:

1 Short title

This Act is the Human Services Amendment (Photographic
6
Identification and Fraud Prevention) Act 2019.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

Human Services (Medicare) Act 1973

Insert:

eligible person has the same meaning as in the Health Insurance
6
Act 1973.

medicare card has the same meaning as in Part VII of the National
8
Health Act 1953.

medicare card information means information contained on the
10
front of a Medicare card, including the following:
11
(a) the individual reference number of a person;
12
(b) the medicare number of a person;
13
(c) the family name, given name or names;
14
(d) the medicare card holder's photograph;
15
medicare number has the same meaning as in Part VII of the
16
National Health Act 1953.

41A Medicare card information
20
A medicare card issued to a person must include medicare card
21
information.

41B Minister to be satisfied of person's eligibility and identity
23
Before issuing a medicare card to a person, the Minister must be
24
satisfied:
25
(a) that the person is an eligible person; and
26
(b) of the identity of the person.

41BA Payment obtained through fraud etc.

A person shall not by:

(a) means of impersonation; or
3
(b) false or misleading statement; or
4
(c) fraudulent use of a medicare card;
5
obtain a benefit or payment in respect of the supply of benefits
6
under:
7
(d) this Act; or
8
(e) the Health Insurance Act 1973; or
9
(f) the National Health Act 1953.

Penalty: Imprisonment for 2 years, or 50 penalty units, or both.
