A Bill for an Act to amend the Immigration (Education)
Charge Act 1992, and for related purposes
The Parliament of Australia enacts:
This Act may be cited as the Immigration (Education) Charge Amendment
Act 1996.
(1) This Act commences on a day to be fixed by Proclamation.
(2) If this Act does not commence under subsection (1) within 6 months
beginning on the day on which it receives the Royal Assent, it commences on the
first day after the end of that period.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.
1 Paragraph 5(a)
After “1993”, insert “and before the commencement of the
Migration (Visa Application) Charge Act 1996”.
2 After paragraph 5(a)
Insert:
(aa) any visa application fee payable in relation to the application has
been paid before the commencement of the Migration (Visa Application) Charge
Act 1996; and
3 Subsection 6(2)
Repeal the subsection, substitute:
(2) The applicable charge limit in relation to an application is
$5,500.
4 Subsection 6(3)
Repeal the subsection.
5 Application
The amendments made by items 3 and 4 of this Schedule apply in relation to
applications that are not finally determined (within the meaning of the
Migration Act 1958) at the commencement of the Migration (Visa
Application) Charge Act 1996.
