1 Short title

This Act is the
Interactive Gambling Amendment (Credit and

Other Measures) Act 2023
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

3 Schedules

Legislation that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

4 Review of the operation of Part 1 of Schedule 1
12
(1) The Minister must cause a review to be conducted of the operation
13
of the amendments made by Part 1 of Schedule 1 to this Act.
14
(2) The review must:
15
(a) make provision for public consultation; and
16
(b) start as soon as practicable after the end of the 2-year period
17
beginning on the day Part 1 of Schedule 1 commenced; and
18
(c) be completed within 6 months.

(3) The person who conducts the review must give the Minister a

written report of the review.

(4) The Minister must cause a copy of the report to be tabled in each

House of the Parliament within 15 sitting days of that House after

the report is given to the Minister.

(1) Each civil penalty provision of this Act is enforceable under Part 6

of the Regulatory Powers Act.

Note:
Part 6 of the Regulatory Powers Act creates a framework for

accepting and enforcing undertakings relating to compliance with
14
provisions.

Authorised person

(2) For the purposes of Part 6 of the Regulatory Powers Act, the
17
ACMA is an authorised person in relation to the civil penalty
18
provisions of this Act.

Relevant court
20
(3) For the purposes of Part 6 of the Regulatory Powers Act, each of
21
the following courts is a relevant court in relation to the civil
22
penalty provisions of this Act:
23
(a) the Federal Court;
24
(b) the Federal Circuit and Family Court of Australia
25
(Division 2).

Enforceable undertaking may be published on the ACMA's website
27
(4) The ACMA may publish an undertaking given in relation to a civil
28
penalty provision of this Act
on the ACMA's website.

Extension to external Territories etc.

(5) Part 6 of the Regulatory Powers Act, as it applies in relation to the
2
civil penalty provisions of this Act, extends to:
3
(a) every external Territory; and
4
(b) acts, omissions, matters and things outside Australia.
5
64F Civil penalty provisions
--
remedial directions
6
(1) This section applies if the ACMA reasonably believes that a person
7
has contravened, or is contravening, a civil penalty provision of
8
this Act (other than subsection (4) of this section).
9
(2) The ACMA may give the person a written direction requiring the
10
person to take specified action directed towards ensuring that the
11
provider does not contravene the provision, or is unlikely to
12
contravene the provision, in the future.
13
(3) A person commits an offence if:
14
(a) the person is subject to a direction under subsection (2); and
15
(b) the person engages in conduct; and
16
(c)
the person's conduct contravenes the direction.
17
Penalty: 50 penalty units.
18
(4) A person must not contravene a direction to which the person is
19
subject under subsection (2).
20
Civil penalty for contravention of this subsection: 75 penalty
21
units.

64G Continuing contraventions

Offence
24
(1) A person who contravenes subsection 64F(3) commits a separate
25
offence in respect of each day (including a day of conviction for
26
the offence or any later day) during which the contravention
27
continues.
28
(2) If an offence against subsection 64F(3) is a continuing offence, the
29
maximum penalty for each day that the offence continues is 10%

of the maximum penalty that could be imposed in respect of the

principal offence.

Civil penalty provision
3
(3) A person who contravenes subsection 64F(4) engages in a separate
4
contravention of that subsection in respect of each day during
5
which the contravention occurs (including the day the relevant civil
6
penalty order is made or any later day).
7
(4) If a contravention of subsection 64F(4) is a continuing
8
contravention, the maximum civil penalty for each day that the
9
contravention continues is 10% of the maximum civil penalty that
10
could be imposed in respect of the principal contravention.
