1 Short title

This Act is the
Interactive Gambling Amendment (Ban on

Gambling Advertisements)
Act 2024

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

means a service that delivers television

programs or radio programs to persons having equipment
2
appropriate for receiving that service, whether the delivery uses the
3
radiofrequency spectrum, cable, optical fibre, satellite or any other
4
means or a combination of those means, but does not include:
5
(a) a datacasting service; or
6
(b) a service that delivers programs using the internet, where the
7
delivery does not use the broadcasting services bands.

broadcasting services bands
has the same meaning as in the
9
Broadcasting Services Act 1992
.
10
datacast
means transmit by means of a datacasting service.
11
display
includes continue to display.
12
exempt library
means:
13
(a) a public library; or
14
(b) a library of a tertiary educational institution; or
15
(c) a library of an authority of the Commonwealth or of a State
16
or Territory.

government or political matters
means government or political
18
matters relating to any level of government in Australia, and
19
includes any of the following matters:
20
(a) participation in, association with and communications in
21
relation to any election or appointment to public office;
22
(b) political views or public conduct relating to activities that
23
have become the subject of political debate;
24
(c) the performance, conduct, capacity or fitness for office of a
25
person elected or appointed to, or seeking election or
26
appointment to, any public office;
27
(d) the actions or policies, or proposed actions or policies, of any
28
government in Australia or any Australian political party.

licensed interactive wagering service
means a regulated interactive
30
gambling service that:
31
(a) is a wagering service (see section 4); and
32
(b) has an Australian-customer link (see section 8); and
33
(c) is not provided in contravention of subsection 15AA(3).

licensed interactive wagering service advertisement
has the

meaning given by Division 2.

licensed interactive wagering service provider
means a person
3
who provides a licensed interactive wagering service.

periodical
means an issue (however described) of a newspaper,
5
magazine, journal, newsletter, or other similar publication, issues
6
of which are published at regular or irregular intervals.

program
has the same meaning as in the
Broadcasting Services Act
8
1992
.
9
public place
means a place, or a part of a place, to which the
10
public, or a section of the public, ordinarily has access, whether or
11
not by payment or by invitation (including, for example, a shop,
12
restaurant, hotel, cinema or club).
13
publish
, in relation to a licensed interactive wagering service
14
advertisement, has the meaning given by Division 3.
15
section of the public
includes:
16
(a) the members of a particular club, society or organisation; and
17
(b) a group consisting only of persons with a common workplace
18
or a common employer.
19
workplace
means premises in which employees or contractors
20
work, other than any part of such premises that is primarily used as
21
a private dwelling.

Division 2--Interpretation: licensed interactive wagering
23
service advertisement
24
61FEA Basic meaning of licensed interactive wagering service
25
advertisement
26
(1)
For the purposes of this Part, a
licensed interactive wagering
27
service advertisement
is any writing, still or moving picture, sign,
28
symbol or other visual image, or any audible message, or any
29
combination of 2 or more of those things, that gives publicity to,
30
or otherwise promotes or is intended to promote:
31
(a) a licensed interactive wagering service; or

(b) licensed interactive wagering services in general; or
1
(c) the whole or part of a trade mark in respect of a licensed
2
interactive wagering service; or
3
(d) a domain name or URL that relates to a licensed interactive
4
wagering service; or
5
(e) any words that are closely associated with a licensed
6
interactive wagering service (whether also closely associated
7
with other kinds of services or products).
8
(2) This section has effect subject to sections 61FEB, 61FEC, 61FED,
9
61FEE, 61FEF, 61FEG and 61FEH.

61FEB Exception--political communication
11
(1) To avoid doubt, if:
12
(a) something (the
advertisement
) does not promote, and is not
13
intended to promote, any particular licensed interactive
14
wagering service or services; and
15
(b) the advertisement relates solely to government or political
16
matters;
17
the advertisement is not a licensed interactive wagering service
18
advertisement for the purposes of this Part.
19
(2) Without limiting paragraph (1)(a), the use in an advertisement of
20
the whole name of a licensed interactive wagering service provider
21
does not, of itself, constitute promotion of a licensed interactive
22
wagering service or licensed interactive wagering services for the
23
purposes of paragraph (1)(a).
24
(3) Subsection (2) does not apply in relation to the use of a name
25
referred to in that subsection in a way prohibited by regulations
26
made for the purposes of this subsection.
27
(4) Section 61FEA does not apply to the extent (if any) that it would
28
infringe any doctrine of implied freedom of political
29
communication.

61FEC Exception--Websites etc. and business documents

Words, signs or symbols that appear:

(a) on the website of a licensed interactive wagering service that
1
is provided to customers using an internet carriage service, or
2
on or at an equivalent point of provision of any other licensed
3
interactive wagering service; or
4
(b) as part of the standard wording of an invoice, statement,
5
order form, letterhead, business card, cheque, manual, or
6
other document ordinarily used in the normal course of the
7
business of a licensed interactive wagering service provider
8
(whether or not the document is in electronic form);
9
do not, when so appearing, constitute a licensed interactive
10
wagering service advertisement (but this does not prevent a still or
11
moving screen shot of a website or equivalent point of provision
12
referred to in paragraph (a), or a still or moving picture or other
13
visual image of a document referred to in paragraph (b), from
14
being a licensed interactive wagering service advertisement).

61FED Exception--premises of providers
16
Words, signs or symbols that appear in or on land or buildings
17
occupied by a licensed interactive wagering service provider do
18
not, when so appearing, constitute a licensed interactive wagering
19
service advertisement (but this does not prevent a still or moving
20
picture, or other visual image, of words, signs or symbols that so
21
appear from being a licensed interactive wagering service
22
advertisement).

61FEE Exceptions--management advertisements etc.
24
To avoid doubt, none of the following constitutes a licensed
25
interactive wagering service advertisement:
26
(a) the doing of anything that is, or apart from this Part would
27
be, required to be done by any other law of the
28
Commonwealth or by any law of a State or Territory;
29
(b) an advertisement (for example, an advertisement for staff or
30
calling for tenders), relating to the internal management of
31
the business of a licensed interactive wagering service
32
provider, that does not promote a licensed interactive
33
wagering service;
34
(c) the taking of any action to prevent persons becoming victims
35
of fraud or any other dishonest or unethical conduct.

61FEF Exception--products or services having the same name as a

licensed interactive wagering service
2
(1) If:
3
(a) apart from this section, something (the
advertisement
) that
4
relates to a product, or a service, that is not a licensed
5
interactive wagering service would, technically, be a licensed
6
interactive wagering service advertisement because the name,
7
or part of the name, of the product or service is the same as,
8
or substantially similar to, the name, or part of the name, of:
9
(i) a licensed interactive wagering service; or
10
(ii) a licensed interactive wagering service provider; and
11
(b) the manufacturer, distributor or retailer of the product, or the
12
provider of the service, is not associated in any way with the
13
licensed interactive wagering service provider concerned;
14
then, despite section 61FEA, the advertisement is not a licensed
15
interactive wagering service advertisement for the purposes of this
16
Part.

Related bodies corporate taken to be associated with each other
18
(2) Without limiting the circumstances in which 2 persons would,
19
apart from this subsection, be taken to be associated with each
20
other for the purposes of subsection (1), 2 bodies corporate that are
21
related to each other are taken to be associated with each other for
22
the purposes of that subsection.
23
(3) For the purposes of subsection (2), the question whether 2 bodies
24
corporate are related to each other is to be determined in the same
25
way as the question would be determined under the
Corporations
26
Act 2001
.

61FEG Exception--anti-gambling advertisements
28
If:
29
(a) apart from this section, something (the
advertisement
)
30
would, technically, be a licensed interactive wagering service
31
advertisement; and
32
(b) it is clear from the advertisement that its sole or principal
33
purpose is to discourage the use of gambling services or
34

particular kinds of gambling services or to reduce harm
1
caused by gambling services or particular kinds of gambling
2
services;
3
then, despite section 61FEA, the advertisement is not a licensed
4
interactive wagering service advertisement for the purposes of this
5
Part.

61FEH Exception--advertisements of a kind specified in the
7
regulations
8
The regulations may provide that an advertisement of a kind
9
specified in the regulations is not a licensed interactive wagering
10
service advertisement for the purposes of this Part.

61FEJ Definition

In this Division:

words
includes abbreviations, initials and numbers.

Division 3--Interpretation: publication of licensed
15
interactive wagering service advertisements
16
61FEK Basic meaning of publish a licensed interactive wagering
17
service advertisement
18
(1) For the purposes of this Part, a person
publishes
a licensed
19
interactive wagering service advertisement if the person does any
20
of the following things:
21
(a) the person includes the advertisement, or something that
22
contains the advertisement, on a website;
23
(b) the person includes the advertisement in a document
24
(including, for example, a newspaper, magazine, program,
25
leaflet or ticket) that is available, or distributed, to the public
26
or a section of the public;
27
(c) the person includes the advertisement in a film, video,
28
television program or radio program that is, or is intended to
29
be, seen or heard by the public or a section of the public;
30
(d) the person:

(i) sells, hires or supplies the advertisement, or something
1
containing the advertisement, to the public or a section
2
of the public; or
3
(ii) offers the advertisement, or something containing the
4
advertisement, for sale or supply to, or hire by, the
5
public or a section of the public;
6
(e) the person displays, screens or plays the advertisement, or
7
something that contains the advertisement, so that it can be
8
seen or heard in or from:
9
(i) a public place; or
10
(ii) public transport; or
11
(iii) a workplace;
12
(f) the person otherwise:
13
(i) brings the advertisement, or something that contains the
14
advertisement, to the notice of; or
15
(ii) disseminates the advertisement, or something that
16
contains the advertisement, to;
17
the public, or a section of the public, by any means
18
(including, for example, by means of a film, video, computer
19
disk or electronic medium).
20
(2) This section has effect subject to sections 61FEL, 61FEM, 61FEN,
21
61FEO and 61FEP.

61FEL Publish does not include broadcast or datacast
23
For the purposes of this Part, the broadcasting or datacasting of a
24
licensed interactive wagering service advertisement by a person
25
does not amount to the publication of the advertisement by the
26
person.
27
61FEM Exception--trade communications
28
For the purposes of this Part, the communication of information
29
that is or includes a licensed interactive wagering service
30
advertisement to a group of people all of whom are involved in the
31
provision of licensed interactive wagering services, does not, of
32
itself, amount to a publication of the licensed interactive wagering
33
service advertisement.

61FEN Exception--advertisements in telephone directories
1
(1) For the purposes of this Part, the publication of the name of a
2
licensed interactive wagering service provider in a telephone
3
directory does not, of itself, amount to the publication of a licensed
4
interactive wagering service advertisement.
5
(2) Subsection (1) does not apply if:
6
(a) the publication is on the internet; and
7
(b) the entry for the provider contains a link to a website for the
8
provider that relates to a licensed interactive wagering
9
service.

61FEO Exception--ordinary activities of exempt libraries
11
Nothing that a person does for the purposes of the ordinary
12
activities of an exempt library amounts, for the purposes of this
13
Part, to a publication of a licensed interactive wagering service
14
advertisement.
15
61FEP Exception--acknowledgements of assistance or support
16
For the purposes of this Part, the publication of an
17
acknowledgement of assistance or support does not amount to the
18
publication of a licensed interactive wagering service
19
advertisement if it complies with regulations made for the purposes
20
of this section that permit the publication of such
21
acknowledgements.

Division 4--Broadcasting or datacasting of licensed
23
interactive wagering service advertisements in
24
Australia
25
61FEQ Licensed interactive wagering service advertisements not to
26
be broadcast or datacast in Australia
27
(1) A person commits an offence if:
28
(a) the person broadcasts or datacasts a licensed interactive
29
wagering service advertisement in Australia; and
30

(b) the broadcast or datacast is not permitted by section 61FER;
1
and
2
(c) the broadcast or datacast is not permitted by section 61FES.

Penalty: 120 penalty units.

(2) A person must not broadcast or datacast a licensed interactive
5
wagering service advertisement in Australia if:
6
(a) the broadcast or datacast is not permitted by section 61FER;
7
and
8
(b) the broadcast or datacast is not permitted by section 61FES.
9
Civil penalty:
180 penalty units.
10
(3) A person commits an offence if:
11
(a) the person authorises or causes a licensed interactive
12
wagering service advertisement to be broadcast or datacast in
13
Australia; and
14
(b) the broadcast or datacast is not permitted by section 61FER;
15
and
16
(c) the broadcast or datacast is not permitted by section 61FES.
17
Penalty: 120 penalty units.
18
(4) A person must not authorise or cause a licensed interactive
19
wagering service advertisement to be broadcast or datacast in
20
Australia if:
21
(a) the broadcast or datacast is not permitted by section 61FER;
22
and
23
(b) the broadcast or datacast is not permitted by section 61FES.
24
Civil penalty for contravention of this subsection: 180 penalty
25
units.
26
61FER Accidental or incidental broadcast or datacast permitted
27
(1) A person may broadcast or datacast a licensed interactive wagering
28
service advertisement if:
29
(a) the person broadcasts or datacasts the advertisement as an
30
accidental or incidental accompaniment to the broadcasting
31
or datacasting of other matter; and

(b) the person does not receive any direct or indirect benefit
1
(whether financial or not) for broadcasting or datacasting the
2
advertisement (in addition to any direct or indirect benefit

that the person receives for broadcasting or datacasting the
4
other matter).

(2) Subsection (1) only has effect for the purposes of this Part.

61FES Broadcast or datacast of advertisements during flights of
7
aircraft
8
(1) A person may broadcast or datacast a licensed interactive wagering
9
service advertisement in an aircraft during a flight of the aircraft
10
unless the flight begins at a place in Australia and is intended to
11
end at another place in Australia.
12
(2) For the purposes of subsection (1), each sector of a flight of an
13
aircraft is taken to be a separate flight.
14
(3) Subsection (1) only has effect for the purposes of this Part.

Division 5--Publication of licensed interactive wagering
16
service advertisements in Australia
17
61FET Licensed interactive wagering service advertisements not to
18
be published in Australia
19
(1) A person commits an offence if:
20
(a) the person publishes a licensed interactive wagering service
21
advertisement in Australia; and
22
(b) the publication is not permitted by section 61FEU; and
23
(d) the publication is not permitted by section 61FEV; and
24
(e) the publication is not permitted by section 61FEW; and
25
(f) the publication is not permitted by section 61FEX.
26
Penalty: 120 penalty units.
27
(2) A person must not publish a licensed interactive wagering service
28
advertisement in Australia if:
29
(a) the publication is not permitted by section 61FEU; and

(b) the publication is not permitted by section 61FEV; and

(3) A person commits an offence if:

(a) the person authorises or causes a licensed interactive
6
wagering service advertisement to be published in Australia;
7
and
8
(b) the publication is not permitted by section 61FEU; and
9
(d) the publication is not permitted by section 61FEV; and
10
(e) the publication is not permitted by section 61FEW; and
11
(f) the publication is not permitted by section 61FEX.

Penalty: 120 penalty units.

(4) A person must not authorise or cause a licensed interactive
14
wagering service advertisement to be published in Australia if:
15
(a) the publication is not permitted by section 61FEU; and
16
(b) the publication is not permitted by section 61FEV; and
17
(c) the publication is not permitted by section 61FEW; and
18
(d) the publication is not permitted by section 61FEX.

Civil penalty:
180 penalty units.

(5) For the purposes of this section, a licensed interactive wagering
21
service advertisement that is included on a website is taken to be
22
published
in Australia
if, and only if:
23
(a) the website is accessed, or is available for access, by
24
end-users in Australia; and
25
(b) having regard to:
26
(i) the content of the website; and
27
(ii) the way the website is advertised or promoted;
28
it would be concluded that it is likely that a majority of
29
persons who access the website are physically present in
30
Australia.

61FEU Periodicals distributed outside Australia--acts of
1
publication permitted
2
(1) A person may do, with a periodical that contains a licensed
3
interactive wagering service advertisement, something that
4
amounts to publishing the advertisement if the periodical is not
5
principally intended for distribution or use in Australia.
6
(2) Subsection (1) only has effect for the purposes of this Part.

61FEV Accidental or incidental publication permitted
8
(1) A person may publish a licensed interactive wagering service
9
advertisement if:
10
(a) the person publishes the advertisement as an accidental or
11
incidental accompaniment to the publication of other matter;
12
and
13
(b) the person does not receive any direct or indirect benefit
14
(whether financial or not) for publishing the advertisement
15
(in addition to any direct or indirect benefit that the person
16
receives for publishing the other matter).
17
(2) Subsection (1) only has effect for the purposes of this Part.

61FEW Publication by person not receiving any benefit permitted
19
(1) A person may publish a licensed interactive wagering service
20
advertisement if:
21
(a) the publication is not in the course of the provision of
22
licensed interactive wagering services; and
23
(b) the person publishes the advertisement on the person's own
24
initiative; and
25
(c) the person does not receive any direct or indirect benefit
26
(whether financial or not) for publishing the advertisement.
27
(2) Subsection (1) only has effect for the purposes of this Part.

61FEX Publication of advertisements during flights of aircraft
1
(1) A person may publish a licensed interactive wagering service
2
advertisement in an aircraft during a flight of the aircraft unless the
3
flight begins at a place in Australia and is intended to end at
4
another place in Australia.
5
(2) For the purposes of subsection (1), each sector of a flight of an
6
aircraft is taken to be a separate flight.
7
(3) Subsection (1) only has effect for the purposes of this Part.

Division 6--Miscellaneous
9
61FEY Failure to broadcast, datacast or publish advertisement not
10
actionable if this Part would be contravened
11
Civil proceedings do not lie against a person for refusing or failing
12
to broadcast, datacast or publish a licensed interactive wagering
13
service advertisement if the broadcast, datacast or publication is
14
prohibited by this Part.

61FEZ Additional conditions for licences under the Broadcasting
16
Services Act 1992
17
Commercial television broadcasting licence
18
(1) Each commercial television broadcasting licence is subject to the
19
condition that the licensee will not, in contravention of this Part,
20
broadcast a licensed interactive wagering service advertisement.
21
Commercial radio broadcasting licence
22
(2) Each commercial radio broadcasting licence is subject to the
23
condition that the licensee will not, in contravention of this Part,
24
broadcast a licensed interactive wagering service advertisement.
25
Community broadcasting licence
26
(3) Each community broadcasting licence is subject to the condition
27
that the licensee will not, in contravention of this Part, broadcast a
28
licensed interactive wagering service advertisement.

Subscription television broadcasting licence
1
(4) Each subscription television broadcasting licence is subject to the
2
condition that the licensee will not, in contravention of this Part,
3
broadcast a licensed interactive wagering service advertisement.

Provision of a broadcasting service under a class licence
5
(5) The provision by a person of a broadcasting service under a class
6
licence is subject to the condition that the licensee will not, in
7
contravention of this Part, broadcast a licensed interactive
8
wagering service advertisement.
9
Datacasting licence
10
(6) Each datacasting licence is subject to the condition that the licensee
11
will not, in contravention of this Part, datacast a licensed
12
interactive wagering service advertisement.

(7) In this section:

class licence
has the same meaning as in the
Broadcasting Services

Act 1992
.

commercial radio broadcasting licence
has the same meaning as

in the
Broadcasting Services Act 1992
