The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Independent National Security
6
Legislation Monitor Repeal Act 2014.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

--protection from criminal and civil liability

Despite the repeal of the Independent National Security Legislation
3
Monitor Act 2010 by this Schedule, section 26 of that Act continues to
4
apply on and after the commencement of this item in relation to a
5
person who was served with a notice before that commencement.

3 Transfer of records and documents to the Department
7
(1)
This item applies to any records or documents that were in the
8
possession of the Independent National Security Legislation Monitor
9
immediately before the commencement of this item.
10
(2)
The records and documents are to be transferred to the Department after
11
the commencement of this item.

Note:
The records and documents are Commonwealth records for the purposes of the Archives
13
Act 1983.

4 Transitional
--reports
15
(1)
Despite the repeal of the Independent National Security Legislation
16
Monitor Act 2010 (the Act) by this Schedule, section 29 of the Act
17
continues to apply in relation to the financial year starting on 1 July
18
2013 and is taken to have been satisfied in relation to that financial year
19
if subitems (2) and (3) are satisfied.

(2)
This subitem is satisfied if the Independent National Security
21
Legislation Monitor (the Monitor) has given to the Prime Minister after
22
1 January 2014 and before the commencement of this item:
23
(a) a report (the final annual report):
24
(i) relating to the performance of the Monitor's functions
25
as set out in paragraphs 6(1)(a) and (b) of the Act; and
26
(ii) containing such details relating to the performance of
27
the Monitor's function as set out in paragraph 6(1)(c) of
28
the Act as the Monitor considers appropriate; and
29
(b) a version of the report (a declassified final annual report)
30
that does not contain information of the kind referred to in
31
subsection 29(3) of the Act, if the Monitor considers that the
32
final annual report contains information of that kind.

(3)
This subitem is satisfied if:
1
(a) the final annual report; or
2
(b) if the final annual report contains information of the kind
3
referred to in subsection 29(3) of the Act--the declassified
4
final annual report;
5
is, or was, presented to each House of Parliament within 15 sittings days
6
of that House after the day on which it was received.

5 Saving
--immunity from legal action
8
Despite the repeal of the Independent National Security Legislation
9
Monitor Act 2010 by this Schedule, section 31 of that Act continues to
10
apply after the commencement of this item in relation to anything done,
11
or omitted to be done, on or before that commencement by a person
12
who is, or has been, the Independent National Security Legislation
13
Monitor.
