1 Short title

This Act may be cited as the Inspector-General of Biosecurity Act
8
2012.

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

3 Definitions

In this Act:
14
adjacent premises warrant means a warrant issued under
15
section 35.
16
Agriculture Minister means the Minister administering the
17
Primary Industries Levies and Charges Collection Act 1991.
18
approved arrangement has the same meaning as in the Biosecurity
19
Act 2012.
20
Australian territory has the same meaning as in the Biosecurity Act
21
2012.

biosecurity enforcement officer has the same meaning as in the

Biosecurity Act 2012.

biosecurity industry participant has the same meaning as in the

Biosecurity Act 2012.

biosecurity officer has the same meaning as in the Biosecurity Act

2012.

biosecurity risk has the same meaning as in the Biosecurity Act
7
2012.

BIRA (short for Biosecurity Import Risk Analysis) has the same
9
meaning as in the Biosecurity Act 2012.
10
chief human biosecurity officer has the same meaning as in the
11
Biosecurity Act 2012.
12
civil penalty provision means a subsection, or a section that is not
13
divided into subsections, that has set out at its foot the words "civil
14
penalty" and one or more amounts in penalty units.
15
Commonwealth body has the same meaning as in the Biosecurity
16
Act 2012.
17
conveyance has the same meaning as in the Biosecurity Act 2012.
18
damage, in relation to data, includes damage by erasure of data or
19
addition of other data.
20
data includes:
21
(a) information in any form; and
22
(b) any program (or part of a program).
23
Director of Biosecurity has the same meaning as in the Biosecurity
24
Act 2012.
25
Director of Human Biosecurity has the same meaning as in the
26
Biosecurity Act 2012.
27
evidential burden, in relation to a matter, means the burden of
28
adducing or pointing to evidence that suggests a reasonable
29
possibility that the matter exists or does not exist.

Federal Circuit Court means the Federal Circuit Court of

Australia.

Federal Court means the Federal Court of Australia.

Health Minister means the Minister administering the National

Health Act 1953.

human biosecurity officer has the same meaning as in the
6
Biosecurity Act 2012.
7
import has the same meaning as in the Biosecurity Act 2012.
8
Inspector-General means the Inspector-General of Biosecurity
9
referred to in section 5.
10
issuing officer means:
11
(a) a magistrate; or
12
(b) a Judge of the Federal Court or the Federal Circuit Court.
13
Note:
For conferral of powers on an issuing officer, see section 36.
14
member of staff means a person referred to in section 58.
15
Part 5 review means a review under Part 5.
16
person assisting the Inspector-General has the meaning given by
17
section 25.
18
premises includes the following:
19
(a) a structure, building or conveyance;
20
(b) a place (whether or not enclosed or built on), including a
21
place situated underground or under water;
22
(c) a part of a thing referred to in paragraph (a) or (b).
23
relevant court has the same meaning as in the Biosecurity Act
24
2012.
25
review means a review under this Act.

4 Extension of Act to Christmas Island, Cocos (Keeling) Islands and
3
other prescribed external Territories
4
(1) This Act extends to the Territory of Christmas Island and the
5
Territory of Cocos (Keeling) Islands.
6
(2) The regulations may extend this Act or any provisions of this Act
7
to any other external Territory that is prescribed by the regulations.

5 Inspector-General

There is to be an Inspector-General of Biosecurity.
5
6 Functions
6
(1) The Inspector-General has the following functions:
7
(a) to review the performance of functions and the exercise of
8
powers by the following:
9
(i) the Director of Biosecurity;
10
(ii)
biosecurity
officers;
11
(iii) biosecurity enforcement officers;
12
(b) to review the process of conducting BIRAs generally;
13
(c) to review the process of conducting a particular BIRA;
14
(d) to report on those reviews in accordance with this Act;
15
(e) any other functions conferred on the Inspector-General by
16
this Act, the regulations or any other law of the
17
Commonwealth;
18
(f) to do anything incidental to or conducive to the performance
19
of the above functions.
20
(2) The Inspector-General's review functions under paragraphs (1)(a)
21
and (b) include conducting audits, evaluations and assessments.
22
(3) The Inspector-General's review functions do not include reviewing
23
the operation of an approved arrangement covering a biosecurity
24
industry participant.

Division 2--Review program

7 Setting a review program
2
(1) Each year, the Inspector-General must set a review program.
3
(2) The review program must be in writing.
4
(3) In setting the review program, the Inspector-General may exercise
5
powers under Part 3 as if references in that Part to a review or
6
conducting a review were references to setting a review program.
7
(4) The Inspector-General must consult the Director of Biosecurity and
8
the Agriculture Minister, at least once a year, in setting the review
9
program. The Inspector-General may also consult any other person
10
the Inspector-General considers appropriate.
11
(5) The Inspector-General is not subject to direction by the Director of
12
Biosecurity in relation to any of the following:
13
(a) whether or not a particular subject or matter is to be
14
reviewed;
15
(b) the way in which a particular review is to be conducted;
16
(c) the priority to be given to any particular review.
17
Note:
The Agriculture Minister may direct the Inspector-General to conduct
18
a review (see subsection 8(2)).
19
(6) The review program is not a legislative instrument.
20
8 When reviews are to be conducted
21
(1) The Inspector-General must conduct reviews in accordance with
22
his or her review program.
23
(2) The Agriculture Minister may, in writing, direct the
24
Inspector-General to conduct a review referred to in paragraph
25
6(1)(a), (b) or (c) (other than a Part 5 review).
26
(3) However, the Inspector-General is not subject to direction by the
27
Agriculture Minister in relation to either of the following:
28
(a) the way in which a particular review is to be conducted;
29
(b) the priority to be given to any particular review.

(4) If the Inspector-General is directed under subsection (2) to conduct

a review, the Inspector-General must include the review in his or
2
her review program.

(5) A direction given under subsection (2) is not a legislative
4
instrument.

10 Inspector-General may require persons to provide information
2
etc.
3
(1) This section applies if the Inspector-General has reason to believe
4
that a person:
5
(a) has information or documents relevant to a review; or
6
(b) is capable of giving evidence that is relevant to a review.
7
(2) Subject to subsection 61(3), the Inspector-General may, by written
8
notice given to the person, require the person:
9
(a) to give the information to the Inspector-General by the time,
10
and in the manner and form, specified in the notice; or
11
(b) to produce the documents, or certified copies of the
12
documents, to the Inspector-General by the time, and in the
13
manner, specified in the notice; or
14
(c) to attend before the Inspector-General, at the time and place
15
specified in the notice, to answer questions relevant to the
16
review.

Note:
See Division 3 of this Part for the consequences of giving information,
18
producing documents or answering questions, or the failure to do so.
19
(3) The time specified in the notice must be at least 14 days after the
20
notice is given.
21
Information and answers may be given on oath or by affirmation
22
(4) The Inspector-General may require either or both of the following:
23
(a) that information given under paragraph (2)(a) is to be given
24
in writing, or verified on oath or by affirmation;
25
(b) that answers be given on oath or by affirmation.
26
For this purpose, the Inspector-General may administer the oath or
27
affirmation.
28
(5) The oath or affirmation is an oath or affirmation that the
29
information or answers are or will be true.

Confidential information or documents

(6) A person may, at the time of giving information under this section,
2
request the Inspector-General:
3
(a) not to make some or all of the information available under
4
section 12; and
5
(b) not to publish or make available some or all of the
6
information in a report under section 37 or 62;
7
because the information is confidential.
8
(7) A person may, at the time of producing a document under this
9
section, request the Inspector-General:
10
(a) not to make the whole or a part of the document available
11
under section 12; and
12
(b) not to publish or make available the whole or a part of the
13
document in a report under section 37 or 62;
14
because the information contained in the document, or the part of
15
the document, is confidential.

11 Inspector-General may invite submissions
17
Inviting submissions
18
(1) The Inspector-General may invite members of the public generally,
19
or particular persons or organisations, to make submissions
20
relevant to a review.
21
Note:
See Division 3 of this Part for the consequences of making a
22
submission.

Process for inviting or making submissions
24
(2) The Inspector-General has discretion in deciding matters connected
25
with the process for inviting or making submissions, including:
26
(a) how to communicate an invitation; and
27
(b) how submissions may be made.
28
Note:
For example, the Inspector-General may:
29
(a) advertise in the press or other media seeking written submissions
30
from the public; or
31
(b) contact particular persons or organisations inviting them to attend
32
a meeting at which they may make oral submissions.

Submissions containing confidential information
1
(3) A person may, at the time of making a submission in response to
2
an invitation under subsection (1), request the Inspector-General:
3
(a) not to make the whole or a part of the submission available
4
under section 12; and
5
(b) not to publish or make available the whole or a part of the
6
submission in a report under section 37 or 62;
7
because of the confidential information contained in the
8
submission.
9
(4) If the Inspector-General refuses a person's request in relation to a
10
submission:
11
(a) in the case of a written submission--the person may require
12
that all or part of the submission be returned to the person;
13
and
14
(b) in the case of an oral submission--the person may withdraw
15
all or part of the submission.
16
12 Submissions may be made publicly available
17
(1) Subject to subsections (2) and (3), the Inspector-General may, in
18
any way he or she thinks appropriate, make available:
19
(a) information or answers to questions given under section 10;
20
or
21
(b) a document produced under section 10; or
22
(c) a written submission made in response to an invitation under
23
subsection 11(1); or
24
(d) a written record (which may be a summary) of an oral
25
submission made in response to an invitation under
26
subsection 11(1);
27
to the public generally or to particular persons or organisations.
28
(2) The Inspector-General must not make information, an answer to a
29
question, a document, a submission or a record of a submission
30
available under subsection (1) to the extent that:
31
(a) it names, or otherwise specifically identifies:
32
(i) an officer or employee of a Commonwealth body (other
33
than the Director of Biosecurity); or

(ii) an officer or employee of a State or Territory body; or
1
(iii) a consultant to the Department; or
2
(b) it contains information relating to a matter specified in a
3
certificate given by the Agriculture Minister under
4
section 61.

(3) The Inspector-General must not make any of the following
6
available under subsection (1):
7
(a) information given under section 10 if:
8
(i) the person who gave the information requested, under
9
subsection 10(6), that the information not be published
10
because the information is confidential; and
11
(ii) the Inspector-General agreed to the request;
12
(b) a document, or a part of a document, produced under
13
section 10 if:
14
(i) the person who produced the document requested, under
15
subsection 10(7), that the document, or the part of the
16
document, not be published because the information
17
contained in the document, or the part of the document,
18
is confidential; and
19
(ii) the Inspector-General agreed to the request;
20
(c) a written record of an oral submission made in response to an
21
invitation under subsection 11(1), unless the person who
22
made the submission has verified the content of the record;
23
(d) a submission made in response to an invitation under
24
subsection 11(1) if the person who made the submission has
25
required its return or has withdrawn it under subsection
26
11(4);
27
(e) a part of a submission made in response to an invitation
28
under subsection 11(1) if the person who made the
29
submission has required that part to be returned or has
30
withdrawn that part under subsection 11(4).

13 Assistance from the Director of Biosecurity
32
(1) The Director of Biosecurity must comply with any reasonable
33
request from the Inspector-General for assistance for the purposes
34
of conducting a review.

(2) Without limiting subsection (1), the Inspector-General may request
1
the Director of Biosecurity to give information, produce documents
2
or answer questions relevant to a review.

14 Inspector-General may retain and make copies of documents
4
(1) If a document is produced under section 10 or 13, the
5
Inspector-General:
6
(a) may take possession of, and make copies of, the document, or
7
take extracts from the document; and
8
(b) may retain possession of the document for such period as is
9
necessary for the purposes of the review to which the
10
document relates.
11
(2) If a document is produced under section 10 or 13 for the purpose of
12
setting a review program under section 7, and a review is to be
13
conducted, the document may continue to be kept for as long as is
14
necessary for the purposes of conducting the review.
15
(3) While the Inspector-General retains possession of a document, he
16
or she must allow a person otherwise entitled to possession of the
17
document (or another person authorised by the person) to do any of
18
the following:
19
(a) inspect the document;
20
(b) make copies of the document;
21
(c) take extracts from the document;
22
at the times that the person would ordinarily be able to do so.

15 Inspector-General must consider all evidence provided
24
(1) In conducting a review, the Inspector-General must have regard to:
25
(a) any information given, documents produced and answers to
26
questions given in relation to the review under section 10 or
27
13; and
28
(b) any submission made in response to an invitation under
29
subsection 11(1), unless the person who made the submission
30
has required its return or has withdrawn it under subsection
31
11(4); and

(c) any part of a submission made in response to an invitation

under subsection 11(1), unless the person who made the
2
submission has required that part to be returned or has
3
withdrawn that part under subsection 11(4).

(2) In conducting a review, the Inspector-General may have regard to
5
other information.

16 Civil penalties--failure to comply with notice etc.
2
(1) If a person has been given a notice under subsection 10(2)
3
requiring the person:
4
(a) to give information specified in the notice; or
5
(b) to produce documents or certified copies of documents
6
specified in the notice;
7
the person must comply with the notice within the period specified
8
in the notice.
9
(2) If a person has been given a notice under subsection 10(2)
10
requiring the person to attend to answer questions at the time and
11
place specified in the notice, the person must comply with the
12
notice.
13
(3) If a person is required to take an oath or make an affirmation under
14
subsection 10(4), the person must comply with the requirement.
15
(4) If a person has been given a notice under subsection 10(2)
16
requiring the person to attend before the Inspector-General to
17
answer questions relevant to the review, the person must answer a
18
question put to him or her by the Inspector-General.
19
Civil penalty provision
20
(5) A person is liable to a civil penalty if the person contravenes
21
subsection (1), (2), (3) or (4).
22
Civil penalty:
30 penalty units.
23
Note:
Civil penalty proceedings for a contravention of this civil penalty
24
provision may be brought under the Biosecurity Act 2012 (see
25
section 65 of this Act).

17 Self-incrimination etc.
27
(1) A person is not excused from giving information, producing a
28
document or answering a question relevant to a review, as required
29
by a notice given under section 10, on the ground that doing so

might tend to incriminate the person or make the person liable to a

penalty.

Use/derivative use indemnity
3
(2) However, in the case of an individual:
4
(a) the information given, the document produced, or the answer
5
given; and
6
(b) giving the information, producing the document or answering
7
the question; and
8
(c) any information, document or thing obtained as a direct or
9
indirect consequence of giving the information, producing
10
the document or answering the question;
11
are not admissible in evidence against the individual:
12
(d) in any civil proceedings, other than proceedings for a
13
contravention of subsection 16(1), (2) or (4); or
14
(e) in criminal proceedings, other than:
15
(i) proceedings for an offence against section 137.1 or
16
137.2 of the Criminal Code (which relate to false or
17
misleading information or documents) that relates to
18
this Act; or
19
(ii) proceedings for an offence against section 149.1 of the
20
Criminal Code (which relates to the obstruction of
21
Commonwealth public officials) that relates to this Act.

18 Protection from liability for persons complying with a notice or
23
making a submission
24
(1) A person who, in good faith, gives information, produces a
25
document or answers a question relevant to a review, as required
26
by a notice given under section 10, is not liable:
27
(a) to any proceedings for contravening a law of the
28
Commonwealth, or a State or Territory, because of that
29
conduct; or
30
(b) to civil proceedings for loss, damage or injury of any kind
31
suffered by another person because of that conduct.
32

20 Entering premises to exercise review powers

(1) For the purpose of conducting a review and subject to
4
subsections (2) and (3), the Inspector-General may enter any of the
5
following premises:
6
(a) premises that are owned or controlled by the Commonwealth
7
where functions are or have been performed, or powers are or
8
have been exercised, under the Biosecurity Act 2012 by the
9
Director of Biosecurity or by biosecurity officers or
10
biosecurity enforcement officers;
11
(b) premises at which a biosecurity industry participant carries
12
out biosecurity activities as authorised by an approved
13
arrangement covering the biosecurity industry participant;
14
(c) other premises where functions are or have been performed,
15
or powers are or have been exercised, under the Biosecurity
16
Act 2012 by the Director of Biosecurity or by biosecurity
17
officers or biosecurity enforcement officers.
18
(2) The Inspector-General may enter premises referred to in
19
paragraph (1)(a) or (b) at any reasonable time.
20
(3) The Inspector-General is not authorised to enter premises referred
21
to in paragraph (1)(c) unless:
22
(a) the occupier of the premises has consented to the entry and
23
the Inspector-General has identified himself or herself if
24
required by the occupier; or
25
(b) the entry is made under a review warrant.

21 General review powers

The Inspector-General may exercise any of the following powers

(review powers) in relation to premises entered under section 20

(including under a review warrant):

(a) the power to search the premises and any thing on the

premises that the Inspector-General thinks may be relevant to

a review;
7
(b) the power to examine or observe any activity conducted on
8
the premises that the Inspector-General thinks may be
9
relevant to a review;
10
(c) the power to inspect, examine, take measurements of, or
11
conduct tests on any thing on the premises that the
12
Inspector-General thinks may be relevant to a review;
13
(d) the power to take and keep samples of any thing on the
14
premises that the Inspector-General thinks may be relevant to
15
a review;
16
(e) the power to make any still or moving image or any
17
recording of the premises or any thing on the premises that
18
the Inspector-General thinks may be relevant to a review;
19
(f) the power to inspect any document on the premises that the
20
Inspector-General thinks may be relevant to a review;
21
(g) the power to take extracts from, or make copies of, any such
22
document;
23
(h) the power to take onto the premises such equipment and
24
materials as the Inspector-General requires for the purposes
25
of exercising powers in relation to the premises;
26
(i) the powers set out in subsections 22(1) and (3).

22 Operating electronic equipment
28
(1)
The
review powers include the power to:
29
(a) operate electronic equipment on the premises; and
30
(b) use a disk, tape or other storage device that:
31
(i) is on the premises; and
32
(ii) can be used with the equipment or is associated with it.

(2)
The
review powers include the powers mentioned in subsection (3)

if information relevant to a review (relevant data) is found in the
2
exercise of the power under subsection (1).

(3) The powers are as follows:
4
(a) the power to operate electronic equipment on the premises to
5
put the relevant data in documentary form and remove the
6
documents so produced from the premises;
7
(b) the power to operate electronic equipment on the premises to
8
transfer the relevant data to a disk, tape or other storage
9
device that:
10
(i) is brought to the premises for the exercise of the power;
11
or
12
(ii) is on the premises and the use of which for that purpose
13
has been agreed in writing by the occupier of the
14
premises;
15
and remove the disk, tape or other storage device from the
16
premises.
17
(4) The Inspector-General may operate electronic equipment as
18
mentioned in subsection (1) or (3) only if the Inspector-General
19
believes on reasonable grounds that the operation of the equipment
20
can be carried out without damage to the equipment.

23 Expert assistance to operate electronic equipment
23
(1) This section applies if the Inspector-General enters premises under
24
a review warrant.
25
Securing equipment
26
(2) The Inspector-General may secure any electronic equipment that is
27
on the premises if the Inspector-General suspects on reasonable
28
grounds that:
29
(a) there is information relevant to a review (relevant data) on
30
the premises; and
31
(b) the relevant data may be accessible by operating the
32
equipment; and

(c) expert assistance is required to operate the equipment; and

(d) the relevant data may be destroyed, altered, or otherwise

interfered with, if the Inspector-General does not take action

The equipment may be secured by locking it up, placing a guard or
5
any other means.

Note:
The expert is authorised to enter premises under section 25 (persons
7
assisting Inspector-General).
8
(3) The Inspector-General must give notice to the occupier of the
9
premises, or another person who apparently represents the
10
occupier, of:
11
(a) the Inspector-General's intention to secure the equipment;
12
and
13
(b) the fact that the equipment may be secured for up to 24
14
hours.
15
Period equipment may be secured
16
(4) The equipment may be secured until the earlier of the following
17
happens:
18
(a) the 24-hour period ends;
19
(b) the equipment has been operated by an expert.
20

Extensions
22
(5) The Inspector-General may apply to an issuing officer for an
23
extension of the 24-hour period if the Inspector-General believes
24
on reasonable grounds that the equipment needs to be secured for
25
longer than that period.
26
(6) Before making the application, the Inspector-General must give
27
notice to the occupier of the premises, or another person who
28
apparently represents the occupier, of his or her intention to apply
29
for an extension. The occupier or other person is entitled to be
30
heard in relation to that application.

(7) The provisions of this Division relating to the issue of review
1
warrants apply, with such modifications as are necessary, to the
2
issue of an extension.

(8) The 24-hour period may be extended more than once.

Subdivision B--Entering adjacent premises to gain access to
5
other premises

24 Entering adjacent premises to gain access to other premises
7
(1) The Inspector-General may enter any premises (adjacent premises)
8
if it is necessary to do so for the purpose of gaining access to other
9
premises to conduct a review.
10
(2) However, the Inspector-General is not authorised to enter adjacent
11
premises under subsection (1) unless:
12
(a) the occupier of the premises has consented to the entry and
13
the Inspector-General has identified himself or herself if
14
required by the occupier; or
15
(b) the entry is made under an adjacent premises warrant.

inconvenience to the occupier of the premises as is practicable.

(1) In entering premises under section 20 or 24 (including under a

review warrant or an adjacent premises warrant) and exercising
29
powers or performing functions or duties under this Division, the
30
Inspector-General may be assisted by:

(a) a member of staff; or

(b) a consultant engaged under section 59; or

(c) a person who has the requisite technical expertise;

(2) A person giving assistance under subsection (1) is a person
5
assisting the Inspector-General.

(3) A person assisting the Inspector-General:
7
(a) may enter the premises; and
8
(b) may exercise powers under this Division; and
9
(c) must do so in accordance with a direction given to the person
10
assisting by the Inspector-General.
11
(4) A power exercised by a person assisting the Inspector-General as
12
mentioned in subsection (3) is taken for all purposes to have been
13
exercised by the Inspector-General.
14
(5) A function or duty performed by a person assisting the
15
Inspector-General as mentioned in subsection (3) is taken for all
16
purposes to have been performed by the Inspector-General.
17
(6) If a direction is given under paragraph (3)(c) in writing, the
18
direction is not a legislative instrument.

Subdivision D--Obligations and incidental powers of
20
Inspector-General

26 Consent
22
(1) Before obtaining the consent of an occupier of premises for the
23
purposes of paragraph 20(3)(a) or 24(2)(a), the Inspector-General
24
must inform the occupier of the following:
25
(a) the reasons for entering the premises;
26
(b) that the occupier may refuse consent.
27
(2) A consent has no effect unless the consent is voluntary.

(3) A consent may be expressed to be limited to entry during a
1
particular period. If so, the consent has effect for that period unless
2
the consent is withdrawn before the end of that period.

(4) A consent that is not limited as mentioned in subsection (3) has
4
effect until the consent is withdrawn.
5
(5) If the Inspector-General entered premises because of the consent of
6
the occupier of the premises, the Inspector-General, and any person
7
assisting the Inspector-General, must leave the premises if the
8
consent ceases to have effect.
9
27 Notice of entry etc.
10
(1) Before entering premises under section 20 or 24 (including under a
11
review warrant or an adjacent premises warrant), the
12
Inspector-General must give reasonable notice of the proposed
13
entry to:
14
(a) the occupier of the premises; and
15
(b) if the premises are not owned or controlled by the
16
Commonwealth--the Director of Biosecurity.
17
(2) Before entering premises under a review warrant or an adjacent
18
premises warrant, the Inspector General must:
19
(a) announce that he or she is authorised to enter the premises;
20
and
21
(b) show identification to the occupier of the premises, or to
22
another person who apparently represents the occupier, if the
23
occupier or other person is present at the premises; and
24
(c) give any person at the premises an opportunity to allow entry
25
to the premises.
26
28 Inspector-General to be in possession of warrant
27
If the Inspector-General is executing a review warrant or an
28
adjacent premises warrant, the Inspector-General must be in
29
possession of the warrant or a copy of the warrant.

29 Details of warrant etc. to be given to occupier
1
(1) The Inspector-General must comply with subsection (2) if:
2
(a) a review warrant or an adjacent premises warrant is being
3
executed in relation to premises; and
4
(b) the occupier of the premises, or another person who
5
apparently represents the occupier, is present at the premises.
6
(2) The Inspector-General must, as soon as practicable:
7
(a) make a copy of the warrant available to the occupier or other
8
person; and
9
(b) inform the occupier or other person in writing of the rights
10
and responsibilities of the occupier or other person under
11
Subdivision E.
12
30 Use of force
13
In executing a review warrant or an adjacent premises warrant, the
14
Inspector-General, or a person assisting the Inspector-General, may
15
use such force against things as is necessary and reasonable in the
16
circumstances.
17
31 Compensation for damage to electronic equipment
18
(1) This section applies if:
19
(a) as a result of equipment being operated as mentioned in this
20
Division:
21
(i) damage is caused to the equipment; or
22
(ii) the data recorded on the equipment is damaged; or
23
(iii) programs associated with the use of the equipment, or
24
with the use of the data, are damaged or corrupted; and
25
(b) the damage or corruption occurs because:
26
(i) insufficient care was exercised in selecting the person
27
who was to operate the equipment; or
28
(ii) insufficient care was exercised by the person operating
29
the equipment.
30
(2) The Commonwealth must pay the owner of the equipment, or the
31
user of the data or programs, such reasonable compensation for the

damage or corruption as the Commonwealth and the owner or user
1
agree on.

(3) However, if the owner or user and the Commonwealth fail to
3
agree, the owner or user may institute proceedings in a relevant
4
court for such reasonable amount of compensation as the relevant
5
court determines.
6
(4) In determining the amount of compensation payable, regard is to
7
be had to whether the occupier of the premises, or the occupier's
8
employees or agents, if they were available at the time, provided
9
any appropriate warning or guidance on the operation of the
10
equipment.
11
Subdivision E--Occupier's rights and responsibilities
12
32 Right to observe exercise of powers
13
(1) The occupier of premises entered by the Inspector-General under
14
section 20 or 24 (including under a review warrant or an adjacent
15
premises warrant), or another person who apparently represents the
16
occupier, is entitled to observe the exercise of powers by the
17
Inspector-General while on the premises, if the occupier or other
18
person is present at the premises while the powers are being
19
exercised.
20
(2) The right to observe the exercise of the powers ceases if the
21
occupier or other person impedes the exercise of the powers.
22
(3) This section does not prevent the Inspector-General exercising
23
powers in 2 or more areas of the premises at the same time.
24
33 Responsibility to provide facilities and assistance
25
(1) The occupier of premises entered by the Inspector-General under
26
section 20 or 24 (including under a review warrant or an adjacent
27
premises warrant), or another person who apparently represents the
28
occupier, must provide:
29
(a) the Inspector-General; and
30
(b) any person assisting the Inspector-General;

with all reasonable facilities and assistance for the effective

(2) A person commits an offence if:

(a) the person is subject to subsection (1); and

(b) the person fails to comply with that subsection.

which the issue of the warrant is being sought.

(2) The issuing officer need not accept the power conferred.

(3) An issuing officer exercising a power conferred by this Division

has the same protection and immunity as if the issuing officer were

exercising the power:

(a) as the court of which the issuing officer is a member; or

(2) After completing a review, the Inspector-General must prepare a
6
written report for the Agriculture Minister setting out:
7
(a) the subject and findings of the review; and
8
(b) the evidence and other material on which those findings are
9
based; and
10
(c) any recommendations resulting from the review.
11
(3) The report must not include recommendations in relation to, or
12
comments on:
13
(a) the policy of the Commonwealth Government in relation to
14
managing biosecurity risk; or
15
(b) particular decisions made under the Biosecurity Act 2012 or
16
any other law of the Commonwealth.
17
(4) In particular, the report must not include recommendations in
18
relation to, or comments on:
19
(a) a decision made under Division 3 of Part 3 of Chapter 3 of
20
the Biosecurity Act 2012 relating to a permit to bring or
21
import goods into Australian territory; or
22
(b) the outcome of a BIRA; or
23
(c) the scientific analysis of anything done in the performance of
24
a function, or the exercise of a power, under the Biosecurity
25
Act 2012.

(5) The Inspector-General may give a copy of the report to the Health
27
Minister or the Director of Biosecurity, or both.

38 Certain material to be excluded from reports
29
(1) A report on a review (including a Part 5 review) must not name, or
30
otherwise specifically identify:

Biosecurity a reasonable opportunity to make submissions to
17
the Inspector-General in relation to the material; and
18
(b) in any other case--the Inspector-General has given the

Director of Biosecurity a reasonable opportunity to make
20
submissions to the Inspector-General in relation to the

material.

(3) Submissions may be made orally or in writing, or both.

(4) Oral submissions may be made:

(3) If a report on a review includes a statement relating to legal advice

as mentioned in subsection (2), the advice does not cease to be the
3
subject of legal professional privilege merely because:

(a) the report includes that statement; or
5
(b) the report is given to the Agriculture Minister; or
6
(c) the report, or any part of it, is tabled or made publicly
7
available under section 41 or 47.

41 Tabling etc. of reports
9
(1) This section does not apply in relation to a Part 5 review.
10
Note:
Section 47 deals with publication requirements for reports of Part 5
11
reviews.

(2) The Agriculture Minister must cause a copy of each report on a
13
review:
14
(a) to be tabled in each House of the Parliament; or
15
(b) to be otherwise made publicly available.
16
(3) If the Inspector-General has recommended that the report not be
17
made publicly available for a specified period, the report must not
18
be tabled or otherwise made publicly available until after the
19
specified period ends.
20
(4) Unless the report has been made publicly available earlier, the
21
report must be tabled in each House of Parliament within 25
22
sittings days of that House after:
23
(a) the day the Agriculture Minister receives the report; or
24
(b) if the Inspector-General has recommended that the report not
25
be made publicly available for a specified period--the day
26
the specified period ends.

42 Person may request Inspector-General to review BIRA process
3
(1) A person may request the Inspector-General to review the process
4
of conducting a particular BIRA if the person considers that:
5
(a) the process did not accord with the process required by the
6
Biosecurity Act 2012; and
7
(b) the departure from the process was significant; and
8
(c) the person's interests were, are or may be adversely affected
9
by the failure to conduct the BIRA in accordance with the
10
process required by that Act.
11
(2) A request under subsection (1) must:
12
(a) be in writing; and
13
(b) set out the grounds for making the request; and
14
(c) be made within the prescribed period after the provisional
15
BIRA report required by section 167 of the Biosecurity Act
16
2012 has been published.
17
43 Inspector-General must consider request for review
18
(1) If a request in relation to a BIRA is made under section 42, the
19
Inspector-General must consider the request as soon as practicable
20
after receiving it.
21
(2) If the Inspector-General is satisfied, having regard to the grounds
22
set out in the request, that it is appropriate to review the process of
23
conducting the BIRA, the Inspector-General must:
24
(a) review the process of conducting the BIRA in accordance
25
with this Part; and
26
(b) notify the person who made the request, in writing, when the
27
Inspector-General's report is published under section 47.
28
(3) If the Inspector-General is not satisfied, having regard to the
29
grounds set out in the request, that it is appropriate to review the
30
process of conducting the BIRA, the Inspector-General must notify
31
the person who made the request, in writing, of that decision.

44 Assistance from the Director of Biosecurity

(1) The Director of Biosecurity must comply with any reasonable
2
request from the Inspector-General for assistance for the purposes
3
of conducting a review under this Part.
4
(2) Without limiting subsection (1), the Inspector-General may request
5
the Director of Biosecurity to give information, produce documents
6
or answer questions relevant to the review.
7
(3) Information given or a document produced to the
8
Inspector-General in response to a request under this section does
9
not cease to be the subject of legal professional privilege merely
10
because it is given or produced to the Inspector-General in
11
response to that request.
12
45 Inspector-General may retain and make copies of documents
13
(1) If a document is produced under section 44, the Inspector-General:
14
(a) may take possession of, and make copies of, the document, or
15
take extracts from the document; and
16
(b) may retain possession of the document for such period as is
17
necessary for the purposes of the review to which the
18
document relates.
19
(2) While the Inspector-General retains possession of a document, he
20
or she must allow a person otherwise entitled to possession of the
21
document (or another person authorised by the person) to do any of
22
the following:
23
(a) inspect the document;
24
(b) make copies of the document;
25
(c) take extracts from the document;
26
at the times that the person would ordinarily be able to do so.

46 Inspector-General must consider all evidence provided

In conducting a review under this Part, the Inspector-General must
29
have regard to:
30
(a) any information given, documents produced and answers to
31
questions given under section 44; and

(b) any other information the Inspector-General considers is

relevant.

47 Inspector-General must prepare report
3
(1) After completing a review of the process of conducting a BIRA
4
under this Part, the Inspector-General must prepare a report on the
5
review.
6
(2) The report must set out:
7
(a) the subject and findings of the review; and
8
(b) the evidence and other material on which those findings are
9
based; and
10
(c) any recommendations resulting from the review.
11
Note:
Certain material must not be included in a report prepared under this
12
section (see sections 38, 39, 40 and 61).
13
(3) The report must not include recommendations in relation to, or
14
comments on:
15
(a) the policy of the Commonwealth Government in relation to
16
managing biosecurity risk; or
17
(b) particular decisions made under the Biosecurity Act 2012 or
18
any other law of the Commonwealth.
19
(4) In particular, the report must not include recommendations in
20
relation to, or comments on:
21
(a) a decision made under Division 3 of Part 3 of Chapter 3 of
22
the Biosecurity Act 2012 relating to a permit to bring or
23
import goods into Australian territory; or
24
(b) the outcome of the BIRA to which the report relates; or
25
(c) the scientific analysis of anything done in the performance of
26
a function, or the exercise of a power, under the Biosecurity
27
Act 2012.
28
(5) The Inspector-General must give a copy of the report to the
29
Director of Biosecurity.
30
(6) The report must be published within the period, and in the manner,
31
prescribed by the regulations.

48 Appointment
4
(1) The Inspector-General is to be appointed by the Agriculture
5
Minister by written instrument.
6
(2) The Agriculture Minister must not appoint a person as the
7
Inspector-General unless the Minister is satisfied that the person
8
has suitable qualifications or experience in relevant scientific,
9
auditing or systems assessment disciplines.
10
(3) The Inspector-General may be appointed on a full-time or
11
part-time basis.
12
49 Term of appointment
13
(1) The Inspector-General holds office for the period specified in the
14
instrument of appointment. The period must not exceed 5 years.
15
(2) The Inspector-General must not hold office for a total of more than
16
10 years.

50 Remuneration and allowances
18
(1) The Inspector-General is to be paid the remuneration that is
19
determined by the Remuneration Tribunal. If no determination of
20
that remuneration by the Tribunal is in operation, the
21
Inspector-General is to be paid the remuneration that is prescribed
22
by the regulations.
23
(2) The Inspector-General is to be paid the allowances that are
24
prescribed by the regulations.
25
(3) This section has effect subject to the Remuneration Tribunal Act
26
1973.

51 Leave of absence
1
(1) The following provisions apply if the Inspector-General is
2
appointed on a full-time basis:
3
(a) the Inspector-General has the recreation leave entitlements
4
that are determined by the Remuneration Tribunal;
5
(b) the Agriculture Minister may grant the Inspector-General
6
leave of absence, other than recreation leave, on the terms
7
and conditions as to remuneration or otherwise that the
8
Minister determines.
9
(2) If the Inspector-General is appointed on a part-time basis, the
10
Agriculture Minister may grant leave of absence to the
11
Inspector-General on the terms and conditions that the Minister
12
determines.
13
52 Outside employment
14
(1) If the Inspector-General is appointed on a full-time basis, he or she
15
must not engage in paid employment outside the duties of his or
16
her office without the Agriculture Minister's approval.
17
(2) If the Inspector-General is appointed on a part-time basis, the
18
Inspector-General must not engage in paid employment that, in the
19
Agriculture Minister's opinion, conflicts or may conflict with the
20
proper performance of his or her duties.
21
53 Disclosure of interests
22
The Inspector-General must give written notice to the Agriculture
23
Minister of all interests, pecuniary or otherwise, that the
24
Inspector-General has or acquires and that conflict or could
25
conflict with the proper performance of the Inspector-General's
26
functions.

54 Other terms and conditions
28
The Inspector-General holds office on the terms and conditions (if
29
any) in relation to matters not covered by this Act that are
30
determined by the Agriculture Minister.

55 Resignation
1
(1) The Inspector-General may resign his or her appointment by giving
2
the Agriculture Minister a written resignation.
3
(2) The resignation takes effect on the day it is received by the
4
Agriculture Minister or, if a later day is specified in the
5
resignation, on that later day.
6
56 Termination of appointment
7
(1) The Agriculture Minister may terminate the appointment of the
8
Inspector-General:
9
(a) for misbehaviour; or
10
(b) if the Inspector-General is unable to perform the duties of his
11
or her office because of physical or mental incapacity; or
12
(c) if the Inspector-General:
13
(i) becomes bankrupt; or
14
(ii) applies to take the benefit of any law for the relief of
15
bankrupt or insolvent debtors; or
16
(iii) compounds with his or her creditors; or
17
(iv) makes an assignment of his or her remuneration for the
18
benefit of his or her creditors; or
19
(d) if the Inspector-General fails, without reasonable excuse, to
20
comply with section 53.

Additional grounds: full-time Inspector-General
22
(2) The Agriculture Minister may terminate the appointment of an
23
Inspector-General appointed on a full-time basis if:
24
(a) the Inspector-General is absent, except on leave of absence,
25
for 14 consecutive days or for 28 days in any 12 months; or
26
(b) the Inspector-General engages, except with the Minister's
27
approval, in paid employment outside the duties of his or her
28
office (see subsection 52(1)).

Additional grounds: part-time Inspector-General
30
(3) The Agriculture Minister may terminate the appointment of an
31
Inspector-General appointed on a part-time basis if:

(a) during a vacancy in the office of the Inspector-General

(whether or not an appointment has previously been made to
11
the office); or

(b) during any period, or during all periods, when the
13
Inspector-General:
14
(i) is absent from duty or from Australia; or
15
(ii) is, for any reason, unable to perform the duties of the
16
office.

The staff required to assist the Inspector-General are to be persons

engaged under the Public Service Act 1999 who are made available

by the Director of Biosecurity.

59 Consultants

(1) The Inspector-General may, on behalf of the Commonwealth,
7
engage a person who has suitable qualifications and experience as
8
a consultant to the Inspector-General.
9
(2) The terms and conditions of engagement are to be determined, in
10
writing, by the Inspector-General.

60 Inspector-General to have regard to minimising disruption
3
during review
4
In performing functions or exercising powers under this Act, the
5
Inspector-General must have regard to the desirability of
6
minimising any resulting disruption to:
7
(a) the performance of functions, or the exercise of powers, by
8
the Director of Biosecurity; and
9
(b) the operations or work undertaken by:
10
(i) persons who have been given a notice under section 10;
11
and
12
(ii) occupiers of premises entered under section 20 or 24.

61 Information that would be prejudicial to the public interest
14
(1) The Agriculture Minister may give the Inspector-General a
15
certificate stating that the disclosure of information relating to a
16
specified matter would:
17
(a) prejudice the security, defence or international relations of
18
the Commonwealth; or
19
(b) prejudice negotiations relating to a treaty or other
20
international agreement; or
21
(c) be contrary to a treaty or other international agreement to
22
which Australia is a party; or
23
(d) prejudice relations between the Commonwealth and a State
24
or Territory; or
25
(e) involve the disclosure of deliberations or decisions of the
26
Cabinet or of a Committee of the Cabinet; or
27
(f) involve the disclosure of deliberations or advice of the
28
Executive Council; or
29
(g) prejudice the prevention, investigation or prosecution of an
30
offence against any law; or
31
(h) prejudice the prevention or investigation of, or the conduct of
32
proceedings for recovery of civil penalties for, a
33
contravention of any law; or

(i) be contrary to an order of a court or tribunal; or

(j) be contrary to the public interest for any other reason that
2
could form the basis for a claim in a judicial proceeding that

information relating to the matter should not be disclosed or

documents relating to the matter should not be produced; or
5
(k) endanger the safety of any person; or
6
(l) prejudice the revenue of the Commonwealth.
7
(2) A certificate may be expressed to have effect for the purposes of
8
either or both of the following:
9
(a) the Inspector-General's information-gathering powers under
10
Division 2 of Part 3;
11
(b) the Inspector-General's reporting obligations under Part 4 or
12
section 47.
13
However, a certificate based on the ground referred to in
14
paragraph (1)(l) must only be expressed to have effect for the
15
purposes of the Inspector-General's reporting obligations.
16
(3) The following provisions apply while a certificate that is expressed
17
to have effect for the purposes of the Inspector-General's
18
information-gathering powers under Division 2 of Part 3 is in
19
force:
20
(a) a person must not be required under section 10 to give
21
information, produce documents or answer questions relating
22
to the matter specified in the certificate;
23
(b) any request made under section 10 before the certificate was
24
given ceases to have effect, so far as it relates to the matter
25
specified in the certificate.
26
(4) While a certificate that is expressed to have effect for the purposes
27
of the Inspector-General's reporting obligations under Part 4 or
28
section 47 is in force, information relating to the matter specified in
29
the certificate must not be included in a report on a review.
30
62 Annual report
31
(1) The Inspector-General must, as soon as practicable after the end of
32
each financial year, prepare and give to the Agriculture Minister a
33
report, for presentation to the Parliament, on the operations of the
34
Inspector-General during the year.

(2) The Inspector-General must include in the report:
3
(a) details of any directions given by the Agriculture Minister
4
under subsection 8(2) during the year; and
5
(b) details of any action taken, or proposed to be taken, by the
6
Director of Biosecurity since the last report made under this
7
section in response to the findings and any recommendations
8
set out in a report prepared by the Inspector-General under
9
section 37 or 47; and
10
(c) the number of reviews of the process of conducting a BIRA
11
carried out during the year.

(3) Sections 38, 39, 40 and 61 apply in relation to material relating to a
13
review that is to be included in an annual report required to be
14
prepared under this section as if the annual report were a report on
15
a review.

63 Delegation
17
(1) The Inspector-General may, in writing, delegate all or any of his or
18
her functions and powers under this Act to a member of staff.
19
(2) However, the Inspector-General may only delegate his or her
20
functions and powers under sections 10, 20, 34 and 35 to a member
21
of staff who is an SES employee or an acting SES employee.
22
(3) In performing functions or exercising powers under a delegation,
23
the delegate must comply with any directions of the
24
Inspector-General.
25
64 Secrecy
26
Person must not make record or disclose protected information or
27
protected document
28
(1) A person who is, or was, the Inspector-General, a member of staff,
29
or a consultant engaged under section 59, must not:
30
(a) make a record of protected information, or of all or part of a
31
protected document; or

(b) directly or indirectly disclose protected information, or all or
1
part of a protected document, to another person (other than
2
the person to whom the information or document relates) or
3
to a court;

if in doing so, the person is not acting in the course of performing

functions or exercising powers under, or in relation to, this Act.

Exception
7
(2) Subsection (1) does not apply if the person is authorised to make
8
the record or disclosure under subsection (3).

Note:
A defendant bears an evidential burden in relation to the matter in this
10
subsection (see subsection 13.3(3) of the Criminal Code and
11
section 552 of the Biosecurity Act 2012 (applied by section 65 of this
12
Act)).

(3)
The
Inspector-General
may:
14
(a) make a record of protected information, or of all or part of a
15
protected document; or
16
(b) disclose protected information, or all or part of a protected
17
document, to another person or to a court; or
18
(c) authorise a member of staff or a consultant engaged under
19
section 59:
20
(i) to make a record of protected information, or of all or
21
part of a protected document; or
22
(ii) to disclose protected information, or all or part of a
23
protected document, to another person or to a court;
24
if the Inspector-General has reasonable grounds to believe that
25
making the record or disclosure is necessary for the purpose of
26
preserving the safety of any person.
27
Fault-based offence
28
(4) A person commits an offence if the person contravenes
29
subsection (1).
30
Penalty: Imprisonment for 2 years or 120 penalty units, or both.

Court may not require information or documents
8
(6) Except where it is necessary to do so for the purpose of carrying
9
into effect the provisions of this Act, a person who is, or was, the
10
Inspector-General, a member of staff or a consultant engaged under
11
section 59 is not to be required:
12
(a) to disclose protected information to a court; or
13
(b) to produce all or part of a protected document to a court.

Definitions
15
(7) In this section:
16
court includes any tribunal, authority or person having power to
17
require the production of documents or the answering of questions.
18
produce includes permit access to.
19
protected document means a document that is obtained or made by
20
a person in the course of, or as a result of, performing functions or
21
exercising powers under this Act.
22
protected information means information that is disclosed to, or
23
obtained by, a person in the course of, or as a result of, performing
24
functions or exercising powers under this Act.

65 Application of the Biosecurity Act 2012
26
(1) Parts 1 and 5 of Chapter 11 of the Biosecurity Act 2012 have effect
27
in relation to a civil penalty provision of this Act as if that
28
provision were a civil penalty provision of the Biosecurity Act
29
2012.

(2) Part 5 of Chapter 11 of the Biosecurity Act 2012 has effect in

Inspector-General or a member of staff in relation to anything

done, or omitted to be done, in good faith:

(a) by the Inspector-General or a member of staff in the

performance or purported performance of a function, or the

exercise or purported exercise of a power, conferred by this
10
Act; or
11
(b) by a person in providing or purporting to provide assistance
12
to the Inspector-General or a member of staff (as a result of a
13
request or direction made by the Inspector-General or a
14
member of staff) in the performance or purported
15
performance of a function, or the exercise or purported
16
exercise of a power, conferred by this Act.

(2) Civil proceedings do not lie against a person in relation to anything
18
done, or omitted to be done, in good faith by the person in
19
providing or purporting to provide assistance to the
20
Inspector-General or a member of staff (as a result of a request or
21
direction made by the Inspector-General or a member of staff) in
22
the performance or purported performance of a function, or the
23
exercise or purported exercise of a power, conferred by this Act.

67 Regulations
25
The Governor-General may make regulations prescribing matters:
26
(a) required or permitted by this Act to be prescribed; or
27
(b) necessary or convenient to be prescribed for carrying out or
28
giving effect to this Act.
