The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act is the Lands Acquisition Amendment (Public Purpose) Act 

5 

2017.

2  Commencement 

7 

 

(1)  Each provision of this Act specified in column 1 of the table 

8 

commences, or is taken to have commenced, in accordance with 

9 

column 2 of the table. Any other statement in column 2 has effect 

10 

according to its terms.

1  Subsection 41(1)

Omit "section 42", substitute "sections 41A and 42".

Insert:

41A  Purposes limited for acquisition by compulsory process 

8 

 

  The Minister may not make a declaration under subsection 41(1) 

9 

regarding an interest in land unless the acquisition of the interest is 

10 

for the purpose of using the interest, or is related to an acquiring 

11 

authority's need for the interest: 

12 

 

(a)  for the direct benefit of the Australian public; or 

13 

 

(b)  for an acquiring authority to provide necessary services to 

14 

members of the Australian public which would not be 

15 

provided if the acquisition did not occur.

3  Application provision 

17 

Despite the amendments made by this Schedule, Part VI of the Lands 

18 

Acquisition Act 1989 continues to apply as if those amendments had not 

19 

been made to acquisitions in relation to which: 

20 

 

(a)  a pre-acquisition declaration is made under section 22 of that 

21 

Act; or 

22 

 

(b)  a certificate is given under section 24 of that Act; 

23 

before the commencement of this Schedule.
