The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Legislative Instruments Amendment
5
(Sunsetting Measures) Act 2012.

2 Commencement
7
This Act commences on the day after this Act receives the Royal
8
Assent.

Each Act that is specified in a Schedule to this Act is amended or
11
repealed as set out in the applicable items in the Schedule
12

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

as practicable after the giving of the notice.

9 Subsection 45(2)

Repeal the subsection, substitute:

(2)
If:

(a) a legislative instrument (the repealing instrument) or a
8
provision (the repealing provision) of a legislative
9
instrument either:
10
(i) ceases under subsection 38(3) or section 42 to have
11
effect at a particular time (the cessation time); or
12
(ii) would so cease to have effect then if it had not already
13
been repealed by section 48A or 48C; and
14
(b) the repealing instrument or repealing provision wholly or
15
partly repealed another legislative instrument or law, or a
16
provision of another legislative instrument or law, that was in
17
force immediately before the repealing instrument or
18
repealing provision commenced;
19
the repealed instrument, law or provision revives from the
20
cessation time as if the repealing instrument or repealing provision
21
had not been made.

making any application, saving or transitional provisions relating

to the amendment or repeal).

Time of repeal

(2) The repeal of the instrument by this section happens on the day
4
after the last occurrence of one of the following events:
5
(a) the commencement of the instrument or of the last of its
6
provisions to commence;
7
(b) the registration of the instrument.

Effect of repeal
9
(3) The repeal of the instrument by this section does not affect any
10
amendment or repeal made by the instrument. This does not limit
11
the effect of section 7 of the Acts Interpretation Act 1901 as it
12
applies in relation to the repeal of the instrument by this section
13
because of section 13 of this Act.
14
(4) The repeal of the instrument by this section does not prevent
15
section 38 or 42 from applying to the instrument after the repeal.
16
That application does not delay the repeal of the instrument by this
17
section.

Subdivision B--Repeal of commencement instruments
19
48B Automatic repeal of commencement instruments
20
(1) This section repeals a legislative instrument that is made on or after
21
the commencement of this section and provides solely for the
22
commencement of another legislative instrument, an Act or a
23
provision of another legislative instrument or Act.

Time of repeal
25
(2) The repeal of the instrument by this section happens on the day
26
after the last occurrence of one of the following events:
27
(a) the commencement (or the last commencement) the
28
instrument provides for;
29
(b) the registration of the instrument.

Effect of repeal

(3) The repeal of the instrument by this section does not affect any
2
commencement the instrument provides for. This does not limit the
3
effect of section 7 of the Acts Interpretation Act 1901 as it applies
4
in relation to the repeal of the instrument by this section because of
5
section 13 of this Act.

Subdivision C--Repeal of amending or repealing provisions of
7
legislative instruments containing other matter
8
48C Automatic repeal of amending and repealing provisions
9
(1) This section repeals a provision of a legislative instrument if:
10
(a) the instrument is made on or after the commencement of this
11
section but is not an instrument described in subsection
12
48A(1); and
13
(b) the only legal effect of the provision (alone or in conjunction
14
with other provisions of the instrument) is:
15
(i) to amend or repeal one or more other legislative
16
instruments; or
17
(ii) to amend the instrument containing the provision.

Time of repeal
19
(2) The repeal of the provision by this section happens on the day after
20
the last occurrence of one of the following events:
21
(a) the commencement of the provision;
22
(b) the registration of the instrument containing the provision.

Effect of repeal
24
(3) The repeal of the provision by this section does not affect any
25
amendment or repeal made by the provision. This does not limit
26
the effect of section 7 of the Acts Interpretation Act 1901 as it
27
applies in relation to the repeal of the provision by this section
28
because of section 13 of this Act.
29
(4) The repeal of the provision by this section does not prevent:
30
(a) section 38 from applying after the repeal to the instrument
31
containing the provision; or

(b) section 42 from applying after the repeal to the provision or

to the instrument containing the provision.

Neither of those applications delays the repeal of the provision by
3
this section.

Subdivision D--Repeal of commencement provisions of
5
legislative instruments containing other matter

48D Automatic repeal of commencement provisions
7
(1) This section repeals a provision of a legislative instrument if:
8
(a) the instrument is made on or after the commencement of this
9
section but is not an instrument described in subsection
10
48B(1); and
11
(b) the provision provides solely for the commencement of the
12
instrument, another legislative instrument or an Act or the
13
commencement of a provision of the instrument, another
14
legislative instrument or an Act.
15
Time of repeal
16
(2) The repeal of the provision by this section happens on the day after
17
the last occurrence of one of the following events:
18
(a) the commencement (or the last commencement) the provision
19
provides for;
20
(b) the registration of the instrument containing the provision.

Effect of repeal
22
(3) The repeal of the provision by this section does not affect any
23
commencement the provision provides for. This does not limit the
24
effect of section 7 of the Acts Interpretation Act 1901 as it applies
25
in relation to the repeal of the provision by this section because of
26
section 13 of this Act.

Division 2--Repeal by regulations

48E Regulations may repeal legislative instruments, or provisions of
2
legislative instruments, no longer required
3
(1) The regulations may repeal a legislative instrument or a provision
4
of a legislative instrument.
5
(2) Before the Governor-General makes a regulation for the purposes
6
of subsection (1), the Attorney-General must be satisfied that the
7
legislative instrument or provision to be repealed is spent or is no
8
longer required.

(3) This section has effect subject to Part 5A and sections 51, 51A, 53

and 54.

Note:
A legislative instrument may be repealed under Part 5A before it could
4
be repealed by this section. Section 51 or 51A may repeal a legislative
5
instrument at a time different from the time when it would be repealed
6
by this section. Sections 53 and 54 may prevent a legislative
7
instrument from being repealed by this section.

51A Attorney-General may align sunsetting of instruments to be
26
reviewed together
27
(1) The Attorney-General may by legislative instrument (the
28
sunset-altering instrument) declare that 2 or more other legislative
29
instruments (the instruments to be reviewed) are repealed by this
30
section on a single specified day, if he or she is satisfied, on
31
application by the rule-maker of the instruments to be reviewed,
32
that:

(a) all the instruments to be reviewed:
1
(i) would, apart from this section, be repealed by section 50
2
or 51; and
3
(ii) are or will be the subject of a single review; and
4
(b) the making of the declaration will facilitate the undertaking
5
of the review and the implementation of its findings.

(2) The day specified in the sunset-altering instrument:
7
(a) must be 1 April or 1 October of a year; and
8
(b) must be not more than 5 years after the earliest day on which
9
any of the instruments to be reviewed would be repealed by
10
section 50 or 51 apart from this section; and
11
(c) may be the same as, or different from, any of the days on
12
which any of the instruments to be reviewed would be
13
repealed by section 50 or 51 apart from this section.
14
(3) The sunset-altering instrument has effect according to its terms
15
(subject to Part 5, and to section 53 operating on the instruments to
16
be reviewed).

Repeal the section, substitute:

53 Resolution that instrument continue in force
3
(1) A legislative instrument that would otherwise be repealed on a day
4
by section 50, 51 or 51A continues in force, despite those sections,
5
if:
6
(a) the instrument is mentioned in:
7
(i) a copy of a certificate laid before a House of the
8
Parliament under section 51; or
9
(ii) a list laid before a House of the Parliament under
10
section 52; and
11
(b) the House indicates, by resolution passed within 6 months
12
after the copy or list is laid before the House, that the
13
instrument should continue in force.
14
(2) The legislative instrument continues in force, subject to:
15
(a) sections 50, 51 and 51A, which apply to it after the passage
16
of the resolution as if it were registered on the day on which
17
it would have been repealed by section 50, 51 or 51A apart
18
from this section; and
19
(b) any later instrument amending or repealing it.

Note:
The legislative instrument is not required to be tabled again, and is not
21
liable to disallowance again.

Repeal the definition, substitute:

explanatory statement, in relation to a legislative instrument,
4
means the statement that relates to the instrument and meets the
5
requirements in subsection 26(1A).

(1A) For the purposes of this Act, an explanatory statement in relation to

a legislative instrument must:

(a) be prepared by the rule-maker; and

(b) explain the purpose and operation of the instrument; and

(c) if any documents are incorporated in the instrument by

reference--contain a description of the documents so
19
incorporated and indicate how they may be obtained; and
20
(d) if consultation was undertaken under section 17 before the
21
instrument was made--contain a description of the nature of
22
that consultation; and
23
(e) if no such consultation was undertaken--explain why no
24
such consultation was undertaken; and
25
(f) if section 42 applies to the instrument--contain a statement
26
of compatibility prepared under subsection 9(1) of the
27
Human Rights (Parliamentary Scrutiny) Act 2011; and
28
(g) contain such other information as is prescribed by the
29
regulations.

(1B) For the avoidance of doubt, the requirement in paragraph (1A)(b):
31
(a) may be met by an explanation that the instrument replaces a
32
specified earlier legislative instrument or a specified

provision of an earlier legislative instrument and is the same

in substance as the specified instrument or provision; and
2
(b) may be met in relation to a particular provision of the

instrument by an explanation that the provision replaces a
4
specified earlier legislative instrument or a specified
5
provision of an earlier legislative instrument and is the same
6
in substance as the specified instrument or provision.

(1C) Subsection (1B) does not limit the ways in which the requirement
8
in paragraph (1A)(b) may be met. Paragraph (1B)(b) does not
9
imply that paragraph (1A)(b) requires a separate explanation of the
10
purpose and operation of each provision of the instrument.

(1D) A single explanatory statement may relate to one or more
12
legislative instruments.
