The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Land Transport Infrastructure
6
Amendment Act 2014.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

2 Subsection 4(1) (definition of approved funding recipient)

identified in the project approval instrument in relation to the

following projects:

(a) a Black Spot Project;

(b) an Investment Project;

(c) a Transport Development and Innovation Project.

approved purposes, in relation to the following projects, means the

purposes forming part of the project, other than any purposes that

(1) Without limiting its effect apart from this section, this Act also has
4
effect in relation to Commonwealth funding as provided by this
5
section.

(2) This Act also has the effect it would have if its operation in relation
7
to Commonwealth funding were expressly confined to an operation
8
limited to Commonwealth funding in connection with trade or
9
commerce:
10
(a) between Australia and other countries; or
11
(b) among the States; or
12
(c) between Territories or between a Territory and a State.
13
(3) This Act also has the effect it would have if its operation in relation
14
to Commonwealth funding were expressly confined to an operation
15
limited to Commonwealth funding for a corporation to which
16
paragraph 51(xx) of the Constitution applies.
17
(4) This Act also has the effect it would have if its operation in relation
18
to Commonwealth funding were expressly confined to an operation
19
limited to Commonwealth funding:
20
(a) in relation to a Territory government; or
21
(b) in relation to projects or activities in a Territory.

(5) This Act also has the effect it would have if its operation in relation
23
to Commonwealth funding were expressly confined to an operation
24
limited to Commonwealth funding in relation to places acquired by
25
the Commonwealth for public purposes.

(6) This Act also has the effect it would have if its operation in relation
27
to Commonwealth funding were expressly confined to an operation
28
limited to Commonwealth funding:
29
(a) by way of financial assistance to a State; or
30
(b) in relation to railway construction and extension in a State
31
with the consent of the State.

(7) This Act also has the effect it would have if its operation in relation

to Commonwealth funding were expressly confined to an operation
2
limited to Commonwealth funding in relation to external affairs.

(8) This Act also has the effect it would have if its operation in relation
4
to Commonwealth funding were expressly confined to an operation
5
limited to Commonwealth funding for purposes relating to the
6
defence of Australia.

(9) This Act also has the effect it would have if its operation in relation
8
to Commonwealth funding were expressly confined to an operation
9
limited to Commonwealth funding in so far as it is appropriate for
10
the funding to be provided by the Commonwealth as the national
11
Government of Australia.

(10) This Act also has the effect it would have if its operation in relation
13
to Commonwealth funding were expressly confined to an operation
14
limited to Commonwealth funding in so far as it is appropriate for
15
the Parliament, as the national Parliament of Australia, to authorise

the Minister to provide the funding.

limited to Commonwealth funding for purposes relating to the
20
executive power of the Commonwealth.

8 What is an Investment Project?

An Investment Project is a project for which an approval by the
2
Minister under subsection 9(1) is in force.

10 What projects are eligible for approval?

A project is eligible for approval as an Investment Project if the
13
project is for one or more of the following:

(a) the construction of an existing or proposed road that is in a
15
State or Indian Ocean Territory;
16
(b) the maintenance of an existing or proposed road that is
17
included in the National Land Transport Network;
18
(c) the construction of an existing or proposed railway that is in a
19
State or Indian Ocean Territory;
20
(d) the maintenance of an existing or proposed railway that is
21
included in the National Land Transport Network;
22
(e) the construction of an inter-modal transfer facility in a State
23
or Indian Ocean Territory;
24
(f) the acquisition or application of technology that will, or may,
25
contribute to the efficiency, security or safety of transport
26
operations in a State or Indian Ocean Territory.

Note:
The definition of construction in section 4 covers some kinds of work
28
on an existing road, railway or inter-modal transfer facility (hence the
29
references above to the construction of an existing road, railway or
30
inter-modal transfer facility).

11 Is it appropriate to approve a project?
1
The matters to which the Minister may have regard in deciding
2
whether it is appropriate to approve a project as an Investment
3
Project include, but are not limited to, the following matters:
4
(a) the extent to which the project is likely to improve the ability
5
of industries and communities to compete in international,
6
inter-State or inter-regional trade and commerce;
7
(b) the extent to which the project will improve the efficiency,
8
security or safety of transport operations;
9
(c) the results of any assessment of the economic, environmental
10
or social costs or benefits of the project;
11
(d) the extent to which the project is likely to improve access for
12
communities to services and employment;
13
(e) any transport or land use plans that might be relevant to the
14
project;
15
(f) the extent to which persons other than the Commonwealth
16
propose to contribute funding to the project.

1901, the document is taken to have been given to the partnership.

(6) The partners are jointly and severally liable to pay an amount that

relation to that Black Spot Project.

Subitem (1) does not prevent a variation or revocation of that

instrument on or after the commencement of this item.

Funding agreement

(3)
A funding agreement in force in relation to the Nation Building

Program Black Spot Project immediately before the commencement of
20
this item has effect, on and after that commencement, as if it were a
21
funding agreement in force in relation to the Black Spot Project.

(4)
Subitem (3) does not prevent a variation or termination of that
23
agreement on or after the commencement of this item.

Funding conditions

(5)
The conditions that applied under section 79 of the old law to a payment

of Commonwealth funding for the Nation Building Program Black Spot

Project that was made before the commencement of this item continue

to apply on and after that commencement.

Roads to Recovery Program

1 July 2009 to 30 June 2014 funding period

The old law, as in force immediately before the commencement of this

item, continues to apply on and after that commencement in relation to
4
a payment made under Part 8 of the old law during the Nation Building
5
Program Roads to Recovery funding period starting on 1 July 2009.

Note:
For example, this means that the conditions determined under section 90 of the old law
7
would continue to apply to such a payment and amounts would be able to be recovered
8
under section 92 of the old law.

55 Transitional rules

The Minister may, by legislative instrument, make rules prescribing
11
matters of a transitional nature (including prescribing any saving or
12
application provisions) relating to the amendments made by this Act.
