The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act may be cited as the Migration Amendment (Protecting 

5 

Babies Born in Australia) Act 2014.

2  Commencement 

7 

 

  This Act commences on the day after this Act receives the Royal 

8 

Assent.

1  Paragraph 5AA(2)(a)

Repeal the paragraph, substitute: 

4 

 

(a)  the person entered the migration zone except: 

5 

 

(i)  on an aircraft that landed in the migration zone; or 

6 

 

(ii)  by being born in the migration zone; or 

7 

Note: 

Non-citizens born in the migration zone are taken to have entered 

8 

Australia when they are born: see section 10.

2  Application of amendments

The amendment made by this Schedule applies to children born on or 

11 

after the commencement of this item.
