(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

76A Cessation by operation of law of certain bridging visas etc.
1
(1) This section applies if:
2
(a) a non-citizen holds a Subclass 070 (Bridging (Removal
3
Pending)) visa (the
first visa
) immediately before the
4
commencement of this section; and
5
(b) the first visa was granted to the non-citizen without an
6
application for the first visa being made by the non-citizen;
7
and
8
(c) the first visa was granted during the period that:
9
(i) starts at the start of 8 November 2023; and
10
(ii) ends immediately before the commencement of this
11
section; and
12
(d) at the time the first visa was granted, there was no real
13
prospect of the removal of the non-citizen from Australia
14
becoming practicable in the reasonably foreseeable future.
15
(2) Despite any other provision of this Act or the regulations,
the first
16
visa ceases to be in effect immediately after the commencement of
17
this section.
18
Note:
The visa period for the first visa ends when it ceases to be in effect
19
under this subsection.
20
(3) Despite any other provision of this Act or the regulations:
21
(a) the non-citizen is taken, immediately after the first visa
22
ceases to be in effect under subsection (2), to have been
23
granted another Subclass 070 (Bridging (Removal Pending))
24
visa (the
second visa
); and
25
(b) the second visa is taken to come into effect as soon as it is
26
taken to be granted under paragraph (a) of this subsection.

Note:
The visa period for the second visa begins when it is taken to be
28
granted.

(4) This Act and the regulations apply, after the commencement of this
30
section, in relation to the second visa in the same way as they
31
would apply in relation to a Subclass 070 (Bridging (Removal
32
Pending)) visa granted under the regulations.
33
(5) Without limiting subsection (4), the following provisions of the
34
regulations, as in force at the time the second visa is taken to be
35
granted under paragraph (3)(a), apply in relation to the second visa:

(a) a provision specifying when a Subclass 070 (Bridging
1
(Removal Pending)) visa is in effect;
2
(b) a provision prescribing that a Subclass 070 (Bridging
3
(Removal Pending)) visa permits the visa holder to remain in
4
Australia;
5
(c) a provision specifying the mandatory conditions to which a
6
Subclass 070 (Bridging (Removal Pending)) visa that is taken
7
to be granted under paragraph (3)(a) is subject.

76B Offence relating to monitoring conditions of certain bridging
9
visas
10
(1) A person commits an offence if:
11
(a) the person holds a Subclass 070 (Bridging (Removal
12
Pending)) visa; and
13
(b) at the time the visa was granted, there was no real prospect of
14
the removal of the person from Australia becoming
15
practicable in the reasonably foreseeable future; and
16
(c) the visa is subject to a monitoring condition; and
17
(d) the person fails to comply with a requirement of the
18
monitoring condition.
19
Penalty: 5 years imprisonment or 300 penalty units, or both.
20
(2) Subsection (1) does not apply if the person has a reasonable
21
excuse.

Note:
A defendant bears an evidential burden in relation to the matter in this
23
subsection (see subsection 13.3(3) of the
Criminal Code
).

(3) Section 4K of the
Crimes Act 1914
(continuing and multiple
25
offences) does not apply to an offence against subsection (1) of this
26
section.

(4) In this section:
28
monitoring condition
is a mandatory condition that:
29
(a) requires the holder of a Subclass 070 (Bridging (Removal
30
Pending)) visa to do any of the following things:
31
(i) to notify the Minister or Department of specified
32
matters within a specified period or before or by a
33
specified day;

(ii) to report at a specified time or times, and at a specified
1
place or in a specified manner;
2
(iii) to attend at a specified place, on a specified day and at a
3
specified time; and
4
(b) is not a prescribed condition.

76C Offence relating to requirement to remain at notified address
6
(1) A person commits an offence if:
7
(a) the person holds a Subclass 070 (Bridging (Removal
8
Pending)) visa; and
9
(b) the visa is subject to a condition requiring the person to
10
remain, between certain times of a day, at a particular address
11
for the person for the day; and
12
(c) the person fails to comply with the requirement of the
13
condition.

Penalty: 5 years imprisonment or 300 penalty units, or both.
15
(2) Subsection (1) does not apply if the person has a reasonable
16
excuse.

Note:
A defendant bears an evidential burden in relation to the matter in this
18
subsection (see subsection 13.3(3) of the
Criminal Code
).

76D Offences relating to monitoring device and related monitoring
20
equipment
21
Requirement to wear monitoring device at all times
22
(1) A person commits an offence if:
23
(a) the person holds a Subclass 070 (Bridging (Removal
24
Pending)) visa; and
25
(b) the visa is subject to a condition requiring the person to wear
26
a monitoring device at all times; and
27
(c) the person fails to comply with the requirement of the
28
condition.

Penalty: 5 years imprisonment or 300 penalty units, or both.

Requirement to fit a monitoring device etc.
1
(2) A person commits an offence if:
2
(a) the person holds a Subclass 070 (Bridging (Removal
3
Pending)) visa; and
4
(b) the visa is subject to a condition requiring the person to allow
5
an authorised officer to fit, install, repair or remove:
6
(i) the person
's monitoring device;
or
7
(ii) any related monitoring equipment for the
person's
8
monitoring device; and
9
(c) the person fails to comply with the requirement of the
10
condition.
11
Penalty: 5 years imprisonment or 300 penalty units, or both.
12
Requirements relating to good working order of monitoring device
13
etc.
14
(3) A person commits an offence if:
15
(a) the person holds a Subclass 070 (Bridging (Removal
16
Pending)) visa; and
17
(b) the visa is subject to a condition requiring the person to take
18
any specified steps, and any other reasonable steps, to ensure
19
that the following remain in good working order:
20
(i) the
person's
monitoring device;
21
(ii) any related monitoring equipment for the
person's
22
monitoring device; and
23
(c) the person fails to comply with the requirement of the
24
condition.
25
Penalty: 5 years imprisonment or 300 penalty units, or both.
26
(4) A person commits an offence if:
27
(a) the person holds a Subclass 070 (Bridging (Removal
28
Pending)) visa; and
29
(b) the visa is subject to a condition requiring that, if the person
30
becomes aware that:
31
(i) the person
's monitoring device
is not in good working
32
order; or

(ii) any related monitoring equipment for the person
's

monitoring device is not in good working order;
2
the person must notify an authorised officer of that as soon as
3
practicable; and

(c) the person fails to comply with the requirement of the
5
condition.

Penalty: 5 years imprisonment or 300 penalty units, or both.

(5) Section 4K of the
Crimes Act 1914
(continuing and multiple
8
offences) does not apply to an offence against subsection (4) of this
9
section.

Exception
11
(6) Subsections (1), (2), (3) and (4) do not apply if the person has a
12
reasonable excuse.

Definitions

(7) In this section:
17
monitoring device
means any electronic device capable of being
18
used to determine or monitor the location of a person or an object
19
or the status of an object.
20
related monitoring equipment
, for a monitoring device, means any
21
electronic equipment necessary for operating the monitoring
22
device.

76E Rules of natural justice do not apply to decision to grant certain
24
bridging visas
25
(1) This section applies in relation to a decision to grant a non-citizen a
26
Subclass 070 (Bridging (Removal Pending)) visa (the
first visa
) if:
27
(a) the first visa is subject to one or more prescribed conditions;
28
and
29
(b) at the time the first visa is granted, there is no real prospect of
30
the removal of the non-citizen from Australia becoming
31
practicable in the reasonably foreseeable future.

(2) For the avoidance of doubt, the rules of natural justice do not apply
1
to the making of the decision.
2
(3) As soon as practicable after making the decision, the Minister
3
must:
4
(a) give the non-citizen, in the way that the Minister considers
5
appropriate in the circumstances:
6
(i) a written notice that sets out the decision; and
7
(ii) any other prescribed information; and
8
(b) invite the person to make representations to the Minister,
9
within the period and in the manner specified by the
10
Minister, as to why the first visa should not be subject to one
11
or more of the conditions prescribed for the purposes of
12
paragraph (1)(a).
13
(4) The Minister may decide whether to grant the non-citizen another a
14
Subclass 070 (Bridging (Removal Pending)) visa (the
second visa
),
15
under a prescribed provision of the regulations, that is not subject
16
to any one or more of the conditions prescribed for the purposes of
17
paragraph (1)(a) if:
18
(a) the non-citizen makes representations in accordance with the
19
invitation; and
20
(b) the Minister is satisfied that:
21
(i) there are compelling and compassionate reasons to so
22
grant the second visa; and
23
(ii) it is not contrary to the public interest to so grant the
24
second visa.

Note:
If the Minister grants the second visa, the first visa will cease to be in
26
effect, and the visa period for the first visa will end, on the grant of the
27
second visa (see subsections 68(4) and (5)).

(5) The Minister must give the non-citizen written notice of the
29
decision and the reasons for the decision.

6 Application provisions

(1)
Section 76B of the
Migration Act 1958
, as inserted by this Schedule,

applies in relation to a Subclass 070 (Bridging (Removal Pending)) visa
5
that is granted, or taken to have been granted, after the commencement
6
of this item.

(2)
Sections 76C, 76D and 76E of the
Migration Act 1958
, as inserted by
8
this Schedule, apply in relation to a Subclass 070 (Bridging (Removal
9
Pending)) visa that is granted after the commencement of this item.

(1) This regulation applies to a non-citizen who:
15
(a) is an eligible non-citizen under subregulation 2.20(18); and

(b) holds a Bridging R (Class WR) visa.

(2) Despite anything in Schedule 1 and Divisions 070.2 to 070.4 of
18
Part 070 of Schedule 2, the Minister may grant the non-citizen
19
another Bridging R (Class WR) visa if the Minister is satisfied that,
20
if the visa is granted, the non-citizen will abide by the conditions to
21
which the visa will be subject under Division 070.6 of that Part.

2.25AC Conditions not engaging offence relating to mandatory
23
conditions

For the purposes of paragraph (b) of the definition of
monitoring
25
condition
in subsection 76B(4) of the Act, the following conditions
26
are prescribed:

commencing to perform work, or a regular organised activity,

(b) whether or not a working with children or vulnerable people

check (however described) is required in relation to the work.

overseas by the holder at least 7 working days before undertaking
24
the travel.

(2) If the holder does not comply with subclause (1), the holder must
26
notify Immigration of the travel within 2 working days after
27
departing on the travel.

The holder:

(a) must, within 5 working days of the grant, notify Immigration
30
of the details of the holder's association with, or membership
31
of, any organisation (other than an organisation formed for a
32
purpose of engaging in communications on governmental or
33
political matters); and

(b) must notify Immigration of any change in those details
1
(including the beginning or end of any association or
2
membership) within 2 working days after the change occurs.

(1) The holder must notify Immigration of the details of any contact
4
with the following within 2 working days after the contact occurs:
5
(a) any individual, group or organisation that is alleged, or is
6
known by the holder, to be engaging in criminal or other
7
illegal activities;
8
(b) any individual, group or organisation that has previously
9
engaged in, or has expressed an intention to engage in,
10
criminal or other illegal activities.
11
(2) Subclause (1) does not apply to:
12
(a) contact in the course of attending a therapeutic or
13
rehabilitative service; or
14
(b) contact in connection with legal proceedings or legal advice.

The holder must notify Immigration of each of the following
16
matters within 5 working days after the matter occurs:
17
(a) the holder receives, within any period of 30 days, an amount
18
or amounts totalling AUD10 000 or more from one or more
19
other persons;
20
(b) the holder transfers, within any period of 30 days, an amount
21
or amounts totalling AUD10 000 or more to one or more
22
other persons;
23
(c)
the holder's banking arrangements change.

(1) If the holder incurs a debt or debts totalling AUD10 000 or more,
25
the holder must notify Immigration within 5 working days after the
26
holder incurs the debt or debts.
27
(2) If the holder is declared bankrupt or otherwise experiences
28
significant financial hardship, the holder must notify Immigration
29
within 5 working days after the holder is so declared or the
30
financial hardship begins, as the case may be.
31
(3) The holder must notify Immigration of any significant change in
32
relation to the holder's debts, bankruptcy or financial hardship
33
within 5 working days after the change occurs.

The holder must, within 7 days after receiving an oral or written
1
request from the Minister, provide evidence of the holder's current
2
financial circumstances.

(1) The holder must, between 10 pm on one day and 6 am the next day
4
or between such other times as are specified in writing by the
5
Minister, remain at a notified address for the holder for those days.
6
(2) If the Minister specifies other times for the purposes of
7
subclause (1), the times must not be more than 8 hours apart.
8
(3) In this clause:
9
notified address
for a holder for a particular day or days means any
10
of the following:
11
(a) the address notified by the holder under condition 8513 or
12
8550;
13
(b) an address at which the holder stays regularly because of a
14
close personal relationship with a person at that address, and
15
which the holder has notified to Immigration for the purposes
16
of this paragraph;
17
(c) if, for the purposes of this paragraph, the holder notifies
18
Immigration of an address for that day or those days no later
19
than 12 pm on the day before that day or the earliest day of
20
those days (as the case may be)

that address.

(1) The holder must wear a monitoring device at all times.
22
(2) The holder must allow an authorised officer to fit, install, repair or
23
remove the following:
24
(a) the
holder's
monitoring device;
25
(b) any related monitoring equipment for the
holder's monitoring
26
device.

(3) The holder must take any steps specified in writing by the Minister,
28
and any other reasonable steps, to ensure that the following remain
29
in good working order:
30
(a)
the holder's monitoring device;
31
(b)
any related monitoring equipment for the holder's mon
itoring

device.

(4) If the holder becomes aware that either of the following is not in

good working order:

(a)
the holder's monitoring device;
3
(b)
any related monitoring equipment for the holder's monitoring
4
device;
5
the holder must notify an authorised officer of that as soon as
6
practicable.

(5) In this clause:
