A Bill for an Act to remove unfair impediments preventing holders of temporary protection visas from obtaining permanent protection visas, and for related purposes

The Parliament of Australia enacts:

1  Short title

This Act may be cited as the Migration Legislation Amendment (Enabling Permanent Protection) Act 2006.

2  Commencement

This Act commences on the day on which it receives the Royal Assent.

3  Schedule(s)

(1) Each Act, and each set of regulations, that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

(2) The amendment of any regulation under subsection (1) does not prevent the regulation, as so amended, from being amended or repealed by the Governor-General.

 

Schedule 1--Amendment of the Migration Regulations 1994

1  Schedule 2, clauses 866.214 and 866.215

Repeal the clauses.

2  Schedule 2, clauses 866.222A and 866.222B

Repeal the clauses.

3  Schedule 2, clause 866.225

Repeal the clause, substitute:

866.225 (1) The applicant satisfies public interest criteria 4001, 4002 and 4003A.

(2) If the applicant holds a Subclass 785 (Temporary Protection) visa, then when determining whether the applicant satisfies public interest criteria 4001, 4002 and 4003A, the Minister must apply a presumption that the applicant does satisfy those criteria.

(3) The presumption does not apply if there are reasonable grounds to believe that the applicant no longer satisfies public interest criterion 4001, 4002 or 4003A.

4  Schedule 2, clauses 866.228 and 866.228A

Repeal the clauses.
