The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Medical Research Future Fund
6
(Consequential Amendments) Act 2015.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(a) the day after this Act receives the Royal
Assent;
(b) the day after the Medical Research
Future Fund Act 2015 receives the Royal

However, the provisions do not commence
at all if the event mentioned in paragraph (b)
does not occur.
3. Schedule 2
A single day to be fixed by Proclamation.
However, if the provisions do not commence
within the period of 6 months beginning on
the day Schedule 1 to this Act commences,
they commence on the day after the end of
that period.
4. Schedule 3
The later of:
(a) immediately after the commencement of
Schedule 1 to this Act; and
(b) the commencement of Schedule 1 to the
Acts and Instruments (Framework
Reform) Act 2015.
However, the provisions do not commence
at all if the event mentioned in paragraph (b)
does not occur.
Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

Part IVAA--Payments relating to the former

46AA Payments relating to the former Health and Hospitals Fund

(1) The Minister may, by writing, direct that, on a specified day, a
5
specified amount is to be paid to a person if:
6
(a) the payment relates to the creation or development of health
7
infrastructure; and
8
(b) before the repeal of Chapter 4 of the Nation-building Funds
9
Act 2008:
10
(i) the HHF Advisory Board (within the meaning of
11
Chapter 4) had advised the Minister that the making of
12
the payment in relation to the creation or development
13
of that infrastructure satisfied the HHF evaluation
14
criteria; and
15
(ii) the Minister had recommended, under section 258 of
16
that Act, the making of the payment in relation to that
17
infrastructure; and
18
(iii) the person is not a State or Territory.
19
Note:
Chapter 4 of the Nation-building Funds Act 2008 established the
20
Health and Hospitals Fund which provided payments in relation to the
21
creation or development of health infrastructure.
22
(2) Two or more directions under subsection (1) may be set out in the
23
same document.
24
(3) A direction under subsection (1) is not a legislative instrument.

46AB Terms and conditions
26
(1) The terms and conditions on which a payment is made to a person
27
under section 46AA are to be set out in a written agreement
28
between the Commonwealth and the person.
29
(2) The person must comply with the terms and conditions.
30
(3) The agreement may be entered into by the Minister on behalf of the
31
Commonwealth.

to the provision of pharmaceutical, sickness and hospital benefits.

Benefits to students

(5) This Part has the effect it would have if its operation with respect
21
to making payments were expressly confined to making payments
22
for the purposes of the creation or development of health
23
infrastructure through the provision of benefits to students.
24
Communication

(6) This Part has the effect it would have if its operation with respect
26
to making payments were expressly confined to making payments
27
for the purposes of the creation or development of health
28
infrastructure with respect to postal, telegraphic, telephonic or
29
other like services.

(7) This Part has the effect it would have if its operation with respect

to making payments were expressly confined to making payments

for the purposes of the creation or development of health

infrastructure in or with respect to a Territory.

(8) This Act has the effect it would have if its operation with respect to
7
making payments were expressly confined to making payments for
8
the purposes of the creation or development of health infrastructure
9
with respect to trade or commerce:

(a) between Australia and other countries; or
11
(b) among the States; or
12
(c) between Territories or between a Territory and a State.

Corporations

(9) This Part has the effect it would have if its operation with respect
15
to making payments were expressly confined to making payments
16
to a corporation to which paragraph 51(xx) of the Constitution
17
applies for the purposes of carrying out the corporation's activities.
18
Race

(10) This Part has the effect it would have if its operation with respect
20
to making payments were expressly confined to making payments
21
for the purposes of the creation or development of health
22
infrastructure with respect to the people of any race for whom it is
23
deemed necessary to make special laws.

Quarantine

(11) This Part has the effect it would have if its operation with respect
26
to making payments were expressly confined to making payments
27
for the purposes of the creation or development of health

infrastructure with respect to quarantine.
