A Bill for an Act to deal with consequential matters in connection with the National Fuelwatch (Empowering Consumers) Act 2008, and for other purposes
The Parliament of Australia enacts:

 

1 Short title

This Act may be cited as the National Fuelwatch (Empowering Consumers) (Consequential Amendments) Act 2008.

 

2 Commencement

    (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

The day on which this Act receives the Royal Assent.


 

2. Schedule 1
At the same time as the National Fuelwatch (Empowering Consumers) Act 2008 commences.



Note: This table relates only to the provisions of this Act as originally passed by both Houses of the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.


Schedule 1--Amendments

Trade Practices Act 1974

 

1 Subsection 25(1)
Before "or the Australian Postal Corporation Act 1989", insert ", the National Fuelwatch (Empowering Consumers) Act 2008".

 

2 At the end of subsection 29(1)
Add "or the National Fuelwatch (Empowering Consumers) Act 2008".

 

3 Section 154
After "contravention of this Act,", insert "the National Fuelwatch (Empowering Consumers) Act 2008,".

 

4 Section 154A (after paragraph (a) of the definition of evidential material)
Insert:

(aa) the National Fuelwatch (Empowering Consumers) Act 2008; or

 

5 After paragraph 154V(2)(a)
Insert:

(aa) the National Fuelwatch (Empowering Consumers) Act 2008; or

 

6 Subsection 155(1)
After "a contravention of this Act", insert ", the National Fuelwatch (Empowering Consumers) Act 2008".

 

7 Subsection 155AAA(21) (after paragraph (b) of the definition of protected information)
Insert:

(ba) information that:

        (i)   was obtained by the Commission under Part XID or section 155; and

        (ii)   relates to a matter arising under the National Fuelwatch (Empowering Consumers) Act 2008; or
