The Parliament of Australia enacts:

1 Short title

This Act is the
National Health Amendment (Decisions under the

Continence Aids Payment Scheme) Act 2021
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

(4) Without limiting subsection (1), the legislative instrument may

provide that applications may be made to the Administrative
7
Appeals Tribunal for review of decisions made in the exercise of
8
powers conferred by the instrument.

(5) Subsections 14(5) and 15(5) do not, by implication, limit
10
subsection (4) of this section.

Continence Aids Payment Scheme Amendment (Merits Review)

is as valid, and is taken always to have been as valid,

as it would have been if the amendment of the
National Health Act

1953
made by this Schedule had been in force when the
Continence

Aids Payment Scheme Amendment (Merits Review) Instrument 2020

was made.
