The Parliament of Australia enacts:

1 Short title

This Act may be cited as the National Health Security Amendment

(Background Checking) Act 2009.

2 Commencement

This Act commences on the day this Act receives the Royal
8
Assent.

Each Act that is specified in a Schedule to this Act is amended or
11
repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

Insert:

(2A) An example of requirements relating to a matter described in
5
paragraph (2)(b) is requirements for background checks of
6
individuals to be conducted under the AusCheck scheme (within
7
the meaning of the AusCheck Act 2007) for the purposes of
8
determining whether they should be authorised to handle or
9
dispose of security-sensitive biological agents.
