1 Short title

This Act is the
Offshore Petroleum and Greenhouse Gas Storage

Amendment (Stopping PEP11) Act 2021
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

Cancellation of PEP11

(1) PEP11 ceases to be in force 2 months after this section commences
8
(unless it ceases to be in force earlier).
9
(2) The Joint Authority must not consider, or continue considering, a
10
PEP11 application.
11
(3) To avoid doubt, subsection (2) does not apply to a PEP11
12
application that:
13
(a) was made before the commencement of this section; and
14
(b) the Joint Authority finally determined before that
15
commencement.
16
No future permits etc. for PEP11 blocks
17
(4) The Joint Authority mustf not invite applications for the grant of a
18
petroleum exploration permit or petroleum production licence over
19
a PEP11 block.
20
(5) The Joint Authority or Titles Administrator must not:
21
(a) grant any of the following:
22
(i) a petroleum exploration permit over a PEP11 block;
23
(ii) a petroleum retention lease over a PEP11 block
24
(iii) a petroleum production licence over a PEP11 block;
25
(iv) an infrastructure licence in relation to a place in a
26
PEP11 block;
27
(v) a pipeline licence that authorises the licensee to do any
28
of the things mentioned in subsection 211(1) at a
29
location in a PEP11 block;

(vi) a petroleum special prospecting authority over a PEP11

block;
2
(vii) a petroleum access authority if the authority area
3
includes a PEP11 block;
4
(viii) a petroleum scientific investigation consent that
5
authorises the holder to carry on petroleum exploration
6
operations in a location in a PEP11 block; or
7
(b) renew, vary, or suspend a condition of, a petroleum
8
exploration permit, petroleum retention lease, petroleum
9
production licence, infrastructure licence, pipeline licence,
10
petroleum special prospecting authority, petroleum access
11
authority or petroleum scientific investigation consent if the
12
permit, lease etc. as so renewed etc. would be a permit, lease
13
etc. that under paragraph (a) could not be granted.
14
(6) For the purposes of subsection (5), it does not matter whether or
15
not a person applied for the grant, renewal, variation or suspension
16
before, on or after the commencement of this section.

(7) In this section:
18
earlier PEP11
means:
19
(a) the permit:
20
(i) known as Exploration Permit for Petroleum No. 11 (Act
21
1967); and
22
(ii) granted under the repealed
Petroleum (Submerged
23
Lands) Act 1967
on 24 June 1999; or
24
(b) either of the following (other than PEP11):
25
(i) an exploration permit granted under that Act by way of
26
the renewal of an earlier PEP11;
27
(ii) a petroleum exploration permit granted under this Act
28
by way of the renewal of an earlier PEP11.

PEP11
means the petroleum exploration permit known as
30
Petroleum Exploration Permit/NSW PEP11.
31
PEP11 application
means an application under this Act that relates
32
to PEP11.
33
Example: An application under section 119 for renewal of PEP11.

PEP11 block
means a block covered by PEP 11, or an earlier
1
PEP11, at any time occurring:
2
(a) on or after 24 June 1999; and
3
(b) before the commencement of this section.
