1 Short title

This Act may be cited as the Offshore Petroleum and Greenhouse
6
Gas Storage Regulatory Levies Legislation Amendment (2011
7
Measures No. 1) Act 2011.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11
column 2 of the table. Any other statement in column 2 has effect
12
according to its terms.

for use, or is being prepared for use, in connection with

operations authorised by a petroleum title (the current
21
title); or
22
(ii) a well has been used in connection with operations
23
authorised by a petroleum title from which the current
24
title is derived, and the wellhead is situated in the title
25
area of the current title; and
26
(b) an OHS inspector has begun to conduct an inspection
27
concerning a contravention or possible contravention of
28
subclause 13A(1) or (2) of Schedule 3 to the Offshore
29
Petroleum and Greenhouse Gas Storage Act 2006; and

(c) the contravention or possible contravention relates to the

well; and

(d) a particular time (the threshold time) is the first time when

the amount of the costs and expenses reasonably incurred by
4
the Safety Authority in relation to the conduct of the
5
inspection exceeds $30,000; and
6
(e) the Safety Authority has given the registered holder of the
7
current title a written notice stating that the amount of the
8
costs and expenses reasonably incurred by the Safety
9
Authority in relation to the conduct of the inspection has
10
exceeded $30,000;
11
levy is imposed on the inspection in respect of:
12
(f) the period of 3 months beginning at the threshold time; and
13
(g) each successive 3-month period at any time during which an
14
OHS inspector continues to conduct the inspection.

Note:
Clause 13A of Schedule 3 to the Offshore Petroleum and Greenhouse
16
Gas Storage Act 2006 deals with the duties of petroleum titleholders
17
in relation to wells.

(2) Levy imposed by subsection (1) is to be known as well
19
investigation levy.

(3) Well investigation levy imposed by subsection (1) is payable by

the registered holder of the current title.

10 Imposition of well investigation levy--State/Territory petroleum
9
titles

(1)
If:
11
(a)
either:
12
(i) a well has been used, is being used, has been prepared
13
for use, or is being prepared for use, in connection with
14
operations authorised by a State/Territory petroleum
15
title (the current title) granted under a State PSLA or
16
Territory PSLA; or
17
(ii) a well has been used in connection with operations
18
authorised by a petroleum title from which the current
19
title is derived, and the wellhead is situated in the title
20
area of the current title; and
21
(b) an OHS inspector has begun to conduct an inspection
22
concerning a contravention or possible contravention of a
23
provision of the State PSLA or Territory PSLA that
24
substantially corresponds to subclause 13A(1) or (2) of
25
Schedule 3 to the Offshore Petroleum and Greenhouse Gas
26
Storage Act 2006; and
27
(c) the contravention or possible contravention relates to the
28
well; and
29
(d) a particular time (the threshold time) is the first time when
30
the amount of the costs and expenses reasonably incurred by
31
the Safety Authority in relation to the conduct of the
32
inspection exceeds $30,000; and
33
(e) the Safety Authority has given the registered holder of the
34
current title a written notice stating that the amount of the
35
costs and expenses reasonably incurred by the Safety
36

registered holder, in relation to a State/Territory petroleum title,

means the person whose name is shown in the Register kept under
2
the relevant State PSLA or Territory PSLA as the holder of the
3
title.

State/Territory petroleum title means an instrument under a State
5
PSLA or Territory PSLA that confers, in relation to the coastal
6
waters of a State or Territory, some or all of the rights that a
7
Commonwealth petroleum title confers in relation to the offshore
8
area of the State or Territory.

title area has the same meaning as in the provisions of the relevant
10
State PSLA or Territory PSLA that substantially correspond to
11
clause 13A of Schedule 3 to the Offshore Petroleum and
12
Greenhouse Gas Storage Act 2006.

well includes well-related equipment associated with a well.

Part 4A--Annual well levy

10A Imposition of annual well levy--Commonwealth petroleum
17
titles
18
(1) If there are one or more eligible wells in relation to a petroleum
19
title for a year, levy is imposed on those wells.
20
Note: For
eligible well, see subsections (5) and (6).
21
(2) Levy imposed by subsection (1) is to be known as annual well
22
levy.
23
(3) Annual well levy imposed by subsection (1) is payable by the
24
registered holder of the petroleum title.

Amount of annual well levy
26
(4) The amount of annual well levy imposed by subsection (1) in
27
respect of one or more wells is the amount that is specified in, or
28
worked out in accordance with, the regulations.
29
Eligible well
30
(5) For the purposes of this section, if:

(a) immediately before the start of a year, a well is wholly or

partly situated in the title area of a petroleum title (the
2
current title); and
3
(b) the well is or was drilled under the authority of:
4
(i) the current title; or
5
(ii) a petroleum title from which the current title is derived;
6
and
7
(c) the well is not abandoned;
8
the well is an eligible well in relation to the current title for that
9
year.

(6) For the purposes of this section, if:
11
(a) during a year, a well began to be drilled in the title area of a
12
petroleum title (the current title); and
13
(b) the well was drilled under the authority of:
14
(i) the current title; or
15
(ii) a petroleum title from which the current title is derived;
16
and
17
(c) the well was abandoned during that year;
18
the well is an eligible well in relation to the current title for the
19
subsequent year.

Abandoned wells
21
(7) For the purposes of this section, if the Offshore Petroleum and
22
Greenhouse Gas Storage (Resource Management and
23
Administration) Regulations 2011 requires the commencement of
24
the abandonment of a well to be approved by the Safety Authority
25
under those regulations, disregard the abandonment unless:
26
(a) the commencement of the abandonment was approved by the
27
Safety Authority under those regulations; and
28
(b) if the approval was subject to conditions--the abandonment
29
was in accordance with those conditions.

(8) In this section:

derived has the same meaning as in Schedule 3 to the Offshore

Petroleum and Greenhouse Gas Storage Act 2006.

Transitional

(9) For the purposes of this section, if this section does not commence
9
on a 1 January, the period:
10
(a) beginning at the commencement of this section; and
11
(b) ending at the end of 31 December next following that
12
commencement;
13
is taken to be a year.

(10) Subsection (6) does not apply to a well that began to be drilled
15
before the commencement of this section.

10B Imposition of annual well levy--State/Territory petroleum titles
17
(1)
If:
18
(a) there are one or more eligible wells in relation to a
19
State/Territory petroleum title for a year; and
20
(b) the State/Territory petroleum title was granted under a law of
21
a particular State or Territory; and
22
(c) at the start of the year, the Safety Authority has functions or
23
powers under regulations of the State or Territory that
24
substantially correspond to Part 5 of the Offshore Petroleum
25
and Greenhouse Gas Storage (Resource Management and
26
Administration) Regulations 2011;
27
levy is imposed on those wells.

Note: For
eligible well, see subsections (5) and (6).

(2) Levy imposed by subsection (1) is to be known as annual well
30
levy.

(3) Annual well levy imposed by subsection (1) is payable by the
32
registered holder of the State/Territory petroleum title.

Amount of annual well levy

(4) The amount of annual well levy imposed by subsection (1) in
2
respect of one or more wells is the amount that is specified in, or
3
worked out in accordance with, the regulations.

Eligible well
5
(5) For the purposes of this section, if:
6
(a) immediately before the start of a year, the well is wholly or
7
partly situated in the title area of a State/Territory petroleum
8
title (the current title); and
9
(b) the well is or was drilled under the authority of:
10
(i) the current title; or
11
(ii) a State/Territory petroleum title from which the current
12
title is derived; and
13
(c) the well is not abandoned;
14
the well is an eligible well in relation to the current title for that
15
year.

(6) For the purposes of this section, if:
17
(a) during a year, a well began to be drilled in the title area of a
18
State/Territory petroleum title (the current title); and
19
(b) the well was drilled under the authority of:
20
(i) the current title; or
21
(ii) a State/Territory petroleum title from which the current
22
title is derived; and
23
(c) the well was abandoned during that year;
24
the well is an eligible well in relation to the current title for the
25
subsequent year.

Abandoned wells
27
(7) For the purposes of this section, if regulations of a State or
28
Territory that substantially correspond to Part 5 of the Offshore
29
Petroleum and Greenhouse Gas Storage (Resource Management
30
and Administration) Regulations 2011 require the commencement
31
of the abandonment of a well to be approved by the Safety
32
Authority under those regulations of the State or Territory,
33
disregard the abandonment unless:

(a) the commencement of the abandonment was approved by the

Safety Authority under those regulations of the State or
2
Territory; and

(b) if the approval was subject to conditions--the abandonment
4
was in accordance with those conditions.

(8) In this section:

Commonwealth petroleum title means a petroleum title within the
8
meaning of Schedule 3 to the Offshore Petroleum and Greenhouse
9
Gas Storage Act 2006.

derived has the same meaning as in the provisions of the relevant
11
State PSLA or Territory PSLA that substantially correspond to
12
Schedule 3 to the Offshore Petroleum and Greenhouse Gas
13
Storage Act 2006.

registered holder, in relation to a State/Territory petroleum title,
15
means the person whose name is shown in the Register kept under
16
the relevant State PSLA or Territory PSLA as the holder of the
17
title.

State/Territory petroleum title means an instrument under a State
19
PSLA or Territory PSLA that confers, in relation to the coastal
20
waters of a State or Territory, some or all of the rights that a
21
Commonwealth petroleum title confers in relation to the offshore
22
area of the State or Territory.

title area has the same meaning as in the provisions of the relevant
24
State PSLA or Territory PSLA that substantially correspond to
25
clause 13A of Schedule 3 to the Offshore Petroleum and
26
Greenhouse Gas Storage Act 2006.

Transitional
28
(9) For the purposes of this section, if this section does not commence
29
on a 1 January, the period:
30
(a) beginning at the commencement of this section; and
31
(b) ending at the end of 31 December next following that
32
commencement;

is taken to be a year.

Part 4B--Well activity levy

10C Imposition of well activity levy--Commonwealth petroleum

titles

(1)
If:

(a)
either:

(i) a person makes an application to the Safety Authority,
9
under Part 5 of the Offshore Petroleum and Greenhouse
10
Gas Storage (Resource Management and
11
Administration) Regulations 2011, for acceptance of a
12
well operations management plan; or
13
(ii) a person makes an application to the Safety Authority,
14
under Part 5 of the Offshore Petroleum and Greenhouse
15
Gas Storage (Resource Management and
16
Administration) Regulations 2011, for approval to
17
commence an activity relating to a well; and
18
(b) the person is the registered holder of a petroleum title;
19
levy is imposed on the application.
20
(2) Levy imposed by subsection (1) is to be known as well activity
21
levy.
22
(3) Well activity levy imposed by subsection (1) is payable by the
23
person.
24
Amount of well activity levy
25
(4) The amount of well activity levy imposed by subsection (1) on an
26
application is the amount that is specified in, or worked out in
27
accordance with, the regulations.

Exemption
29
(5)
If:
30
(a) at a particular time, a person makes an application to the
31
Safety Authority, under Part 5 of the Offshore Petroleum and
32
Greenhouse Gas Storage (Resource Management and
33

Administration) Regulations 2011, for approval to commence
1
an activity relating to a well; and
2
(b) well activity levy is imposed by subsection (1) on the
3
application; and
4
(c) during the 6-month period beginning at that time:
5
(i) the person makes another application under that Part for
6
approval to commence an activity relating to the well;
7
or
8
(ii) another person who has become the registered holder of
9
a petroleum title makes an application under that Part
10
for approval to commence an activity relating to the
11
well;
12
well activity levy is not imposed by subsection (1) on the
13
application referred to in subparagraph (c)(i) or (ii), as the case
14
may be.

Definitions

(6) In this section:
17
petroleum title means:
18
(a) a petroleum exploration permit; or
19
(b) a petroleum retention lease; or
20
(c) a petroleum production licence.

registered holder, in relation to a petroleum title, has the same
22
meaning as in the Offshore Petroleum and Greenhouse Gas
23
Storage Act 2006.

10D Imposition of well activity levy--State/Territory petroleum
25
titles
26
(1)
If:
27
(a)
either:
28
(i) a person makes an application to the Safety Authority,
29
under the regulations of a State or Territory that
30
substantially correspond to Part 5 of the Offshore
31
Petroleum and Greenhouse Gas Storage (Resource
32
Management and Administration) Regulations 2011, for
33
acceptance of a well operations management plan; or
34

(ii) a person makes an application to the Safety Authority,

under regulations of a State or Territory that

Management and Administration) Regulations 2011, for

approval to commence an activity relating to a well; and
6
(b) the person is the registered holder of a State/Territory
7
petroleum title;
8
levy is imposed on the application.

(2) Levy imposed by subsection (1) is to be known as well activity
10
levy.

(3) Well activity levy imposed by subsection (1) is payable by the
12
person.

(4) The amount of well activity levy imposed by subsection (1) on an

application is the amount that is specified in, or worked out in

accordance with, the regulations.

Exemption

(5)
If:

(a) at a particular time, a person makes an application to the
20
Safety Authority, under the regulations of a State or Territory
21
that substantially correspond to Part 5 of the Offshore
22

approval to commence an activity relating to a well; and

(b) well activity levy is imposed by subsection (1) on the
26
application; and
27
(c) during the 6-month period beginning at that time:

(i) the person makes another application under those
29
regulations for approval to commence an activity
30
relating to the well; or
31
(ii) another person who has become the registered holder of
32
a State/Territory petroleum title makes an application
33
under those regulations for approval to commence an
34
activity relating to the well;

well activity levy is not imposed by subsection (1) on the

Definitions

(6) In this section:

Commonwealth petroleum title means:
6
(a) a petroleum exploration permit; or
7
(b) a petroleum retention lease; or
8
(c) a petroleum production licence.

registered holder, in relation to a State/Territory petroleum title,
10
means the person whose name is shown in the Register kept under
11
the relevant State PSLA or Territory PSLA as the holder of the
12
title.

State/Territory petroleum title means an instrument under a State
14
PSLA or Territory PSLA that confers, in relation to the coastal
15
waters of a State or Territory, some or all of the rights that a
16
Commonwealth petroleum title confers in relation to the offshore
17
area of the State or Territory.
