1 Short title

This Act is the
Productivity Commission Amendment (Electricity

Reporting) Act 2023
.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

means a period of 3 months beginning on 1 January,

1 April, 1 July or 1 October.

energy sources for electricity generation, in each State, the

Australian Capital Territory and the Northern Territory; and

(1) The Commission must, for each quarter, prepare a report that sets
19
out the information required by subsections (2) and (4).

Retail electricity prices
21
(2) The report must set out the following information in relation to
22
retail electricity prices in each State, the Australian Capital
23
Territory and the Northern Territory during the quarter:
24
(a) the lowest, average and highest market offer price in the State
25
or Territory, in respect of the unit price and daily supply
26
charge;

(b) the lowest, average and highest standing offer price in the

State or Territory, in respect of the unit price and daily
2
supply charge.

(3) The report may set out the information required by subsection (2)
4
by reference to different kinds of users of electricity, as the
5
Commission considers appropriate.

Energy sources for electricity generation
7
(4) The report must also set out an estimate, that is as accurate as
8
reasonably practicable, of the percentage of electricity generated in
9
each State, the Australian Capital Territory and the Northern
10
Territory during the quarter from each of the following energy
11
sources:
12
(a) coal;
13
(b) natural gas;
14
(c) hydro;
15
(d) wind;
16
(e) solar;
17
(f) any renewable energy source not mentioned in paragraph (c),
18
(d) or (e);
19
(g)
any other energy source.

Giving report to Minister and tabling in Parliament
21
(5) The report must be given to the Minister within 30 days after the
22
end of the quarter.
23
(6) The Minister must cause a copy of the report to be tabled in each
24
House of the Parliament no later than the first sitting day of that
25
House after the report is given to the Minister.

Definitions
27
(7) In this section:
28
daily supply charge
means a fixed amount per day
that is charged
29
by an electricity retailer to cover the costs of maintaining the
30
supply of electricity to a premises, including the costs associated
31
with general administration and the provision of equipment
32
(excluding metering and associated services).

electricity retailer
means a corporation authorised by or under a
1
law of the Commonwealth or of a State or Territory to sell
2
electricity.

market offer price
means a price charged by an electricity retailer
4
for supplying electricity (other than a standing offer price) that is
5
set directly by the electricity retailer
,
and includes discounts for
6
various factors.
7
standing offer price
means a price charged by an electricity retailer
8
for supplying electricity in any of the following circumstances:
9
(a) the retailer is required under a law of a State of Territory to
10
offer to supply the electricity;
11
(b) the electricity is not supplied under a contract.

Note:
Examples of the circumstances covered by paragraph (b) include the
13
following:
14
(a) a person starts consuming electricity at premises without first
15
contacting the retailer;
16
(b) a person continues consuming electricity at premises after a
17
contract for the supply of electricity to the premises has ended;
18
(c) a person is transferred to the retailer under a retailer of last resort
19
scheme.

4 Application of amendments

(1)
Section 22A of the
Productivity Commission Act 1998
, as added by this
22
Schedule, applies in relation to a quarter ending on or after the day this
23
Act commences.
24
(2)
However, the report prepared under that section for the first quarter
25
ending on or after that commencement must also set out the information
26
referred to in subsections (2) and (4) of that section in relation to each
27
earlier quarter beginning on or after 1 July 2019.
