This Act provides for payments to declared recipient bodies,

statutory recipient bodies, Animal Health Australia and Plant
2
Health Australia and for crediting of amounts to the National
3
Residue Survey Special Account.

Payments to declared recipient bodies and statutory recipient
5
bodies
6
The Commonwealth must pay to declared recipient bodies and
7
statutory recipient bodies amounts connected with various levies
8
and charges collected under rules made under the Collection Act.
9
The bodies must spend the payments on various activities,
10
including research and development activities and marketing
11
activities for the benefit of primary industries.
12
The Commonwealth must also make matching payments to the
13
bodies, based on amounts of expenditure on research and
14
development activities or certain other activities by the bodies and
15
on gross value of production amounts.
16
The bodies must spend the matching payments on various
17
activities, including research and development activities for the
18
benefit of primary industries.
19
Payments to Animal Health Australia and Plant Health Australia
20
The Commonwealth must pay to Animal Health Australia and
21
Plant Health Australia amounts connected with various levies and
22
charges collected under rules made under the Collection Act.
23
Animal Health Australia and Plant Health Australia must spend the
24
payments on various activities, including activities relating to the
25
promotion or maintenance of the health of plants, animals, fungi or
26
algae.

National Residue Survey Special Account
28
There is a National Residue Survey Special Account.

There is credited to the Account amounts connected with various

levies and charges collected under rules made under the Collection
2
Act.

The main purpose of the Account is making payments for purposes
4
relating to the following activities:
5
(a) the monitoring, testing and reporting of the level of
6
contaminants in NRS products or the environment;
7
(b) the prevention of contamination in, and the management
8
of risks associated with contamination of, NRS products.

4 General definitions
10
(1) In this Act:
11
agricultural statistics body
means:
12
(a) the part of the Department known as the Australian Bureau of
13
Agricultural and Resource Economics and Sciences, unless
14
paragraph (b) applies; or
15
(b) if the rules prescribe a body for the purposes of this
16
paragraph
--
that body.
17
AHA commodity/service
means the following:
18
(a) an animal product;
19
(b) a plant product, a fungus product or an algal product
20
prescribed by the rules for the purposes of this paragraph;
21
(c) goods that are of a kind consumed by, or used in the
22
maintenance or treatment of, animals;
23
(d) a service that facilitates the production of an animal product.
24
algae
means macroalgae, microalgae or cyanobacteria, and
25
includes seaweeds.
26
algal product
means:
27
(a) an alga; or
28
(b) any part of an alga; or
29
(c) anything produced by an alga; or

(d) anything wholly or principally produced from, or wholly or

principally derived from, an alga.

animal
means any member, alive or dead, of the animal kingdom
3
(other than a human being).

Animal Health Australia
means Australian Animal Health Council
5
Limited (ACN 071 890 956).
6
animal product
means:
7
(a) an animal; or
8
(b) any part of an animal; or
9
(c) anything produced by an animal; or
10
(d) anything wholly or principally produced from, or wholly or
11
principally derived from, an animal.

average Commonwealth main fishing industry GVP amount
has
13
the meaning given by section 30.
14
average declared fishery GVP amount
has the meaning given by
15
section 32.
16
average gross value of production amount
has the meaning given
17
by section 25.
18
average State/Territory main fishing industry GVP amount
has
19
the meaning given by section 31.
20
average total main fishing industry GVP amount
has the meaning
21
given by section 29.
22
charge
means a charge imposed by regulations under the
Primary
23
Industries (Customs) Charges Act 2023
.
24
civil penalty provision
has the same meaning as in the Regulatory
25
Powers Act.

Collection Act
means the
Primary Industries Levies and Charges

Collection Act 2023
.

Commonwealth entity
has the same meaning as in the
Public

Commonwealth main fishing industry GVP amount
has the

meaning given by section 30.

constitutional trade or commerce
means trade or commerce:
3
(a) between Australia and a place outside Australia; or
4
(b) among the States; or
5
(c) between a State and a Territory; or
6
(d) between 2 Territories; or
7
(e) within a Territory.
8
declared fishery
means a part of the fishing industry that is the
9
subject of a declaration that is referred to in section 5 and is in
10
force.
11
declared fishery expenditure amount
has the meaning given by
12
section 27.
13
declared fishery GVP amount
has the meaning given by
14
section 32.
15
declared fishery levy or charge
, in relation to a declared fishery, is
16
a levy or charge prescribed by the rules in relation to that fishery.
17
declared livestock export body
has the meaning prescribed by the
18
rules.
19
declared meat processor body
has the meaning prescribed by the
20
rules.
21
declared recipient body
means a body that is the subject of a
22
declaration in force under subsection 39(1).
23
designated primary industry sector
, in relation to a declared
24
recipient body or a statutory recipient body,
means the following:
25
(a) each primary industry prescribed by the rules in relation to
26
the body;
27
(b) each part of a primary industry, being a part prescribed by the
28
rules in relation to the body.

emergency animal biosecurity response deed
means the following
1
as in force from time to time:
2
(a) the government and livestock industry cost sharing deed in
3
respect of emergency animal disease responses made by the
4
Commonwealth and other parties, and executed by the
5
Commonwealth in March 2002;
6
(b) a deed:
7
(i) that relates to an emergency biosecurity response; and
8
(ii) that is prescribed by the rules for the purposes of this
9
subparagraph.
10
emergency plant biosecurity response deed
means the following as
11
in force from time to time:
12
(a) the Government and Plant Industry Cost Sharing Deed in
13
respect of Emergency Plant Pest Responses, executed by the
14
Commonwealth on 26 May 2005;
15
(b) a deed:
16
(i) that relates to an emergency biosecurity response; and
17
(ii) that is prescribed by the rules for the purposes of this
18
subparagraph.
19
entrusted person
means any of the following:
20
(a) the Minister;
21
(b) the Secretary;
22
(c) an APS employee in the Department;
23
(d) any other person who is employed or engaged by the
24
Commonwealth to provide services to the Commonwealth in
25
connection with the Department and who is covered by an
26
authorisation in force under subsection (2);
27
(e) any other person who is:
28
(i) employed or engaged by the Commonwealth or a body
29
corporate that is established by a law of the
30
Commonwealth; and
31
(ii) in a class of persons prescribed by the rules for the
32
purposes of this subparagraph.
33
fishing industry
has the meaning prescribed by the rules.

funding agreement
means an agreement in force under section 38
1
or 42.

fungus
means any member, alive or dead, of the fungi kingdom,
3
and includes yeasts, mushrooms and truffles.

fungus product
means:
5
(a) a fungus; or
6
(b) any part of a fungus; or
7
(c) anything produced by a fungus; or
8
(d) anything wholly or principally produced from, or wholly or
9
principally derived from, a fungus.
10
general collected amounts
means amounts prescribed by the rules
11
for the purposes of this definition.
12
gross value of production amount
has the meaning given by
13
section 25.
14
levy
means a levy imposed by regulations under:
15
(a) the
Primary Industries (Excise) Levies Act 2023
; or
16
(b) the
Primary Industries (Services) Levies Act 2023
.
17
main fishing industry
has the meaning prescribed by the rules.
18
marketing activities
, in relation to a declared recipient body or a
19
statutory recipient body, means the following:
20
(a) the marketing, advertising or promotion of:
21
(i) a designated primary industry sector in relation to that
22
body; or
23
(ii) goods that are the produce, or that are derived from the
24
produce, of a designated primary industry sector in
25
relation to that body;
26
(b) activities incidental to such marketing, advertising or
27
promotion.
28
marketing collected amounts
means amounts prescribed by the
29
rules for the purposes of this definition.

NRS products
means:

(a) food products; or
1
(b) products that result from any of the following:
2
(i) agriculture or the cultivation of land;
3
(ii) the maintenance of animals for commercial purposes;
4
(iii) fishing or aquaculture;
5
(iv) hunting or trapping;
6
(v) horticulture;
7
(vi) any other primary industry activity; or
8
(c) any other products that are of a kind used as inputs to the
9
production of products covered by paragraph (a) or (b);
10
whether or not the products have been subjected to any operation
11
(including harvesting, chilling, freezing, drying, bottling, packing,
12
canning and preserving).
13
nursery products
includes trees, shrubs, plants, seeds, bulbs,
14
corms, tubers, propagating material and plant tissue cultures,
15
grown for ornamental purposes or for producing fruits, vegetables,
16
nuts or cut flowers and foliage.
17
PHA commodity/service
means the following:
18
(a) a plant product, a fungus product or an algal product;
19
(b) an animal product prescribed by the rules for the purposes of
20
this paragraph;
21
(c) goods that are of a kind consumed by, or used in the
22
maintenance or treatment of, plants, fungi or algae;
23
(d) goods that are for use in the production or preparation of
24
nursery products;
25
(e) a service that facilitates the production of a plant product, a
26
fungus product or an algal product.
27
plant
means any member, alive or dead, of the plant kingdom.
28
Plant Health Australia
means Plant Health Australia Limited
29
(ACN 092 607 997).
30
plant product
means:
31
(a) a plant; or
32
(b) any part of a plant; or

(c) anything produced by a plant; or

(d) anything wholly or principally produced from, or wholly or

has the meaning prescribed by the rules.

qualifying expenditure amount
has the meaning given by
5
section 24.

recipient body
means a declared recipient body or a statutory
7
recipient body.
8
Regulatory Powers Act
means the
Regulatory Powers (Standard
9
Provisions) Act 2014
.
10
relevant animal health body
, for an AHA commodity/service, has
11
the meaning given by section 7.
12
relevant fishing expenditure amount
has the meaning given by
13
section 26.
14
relevant NRS information
means:
15
(a) information obtained or generated by a person in the course
16
of, or for the purposes of, carrying out activities covered by
17
paragraph 66(1)(a) and paid for with amounts debited from
18
the National Residue Survey Special Account; or
19
(b) information obtained or generated by a person in the course
20
of or for the purposes of:
21
(i) administering Part 5; or
22
(ii) assisting another person to administer Part 5.
23
relevant plant health body
, for a PHA commodity/service, has the
24
meaning given by section 8.
25
research and development
has the meaning given by section 10.
26
research and development activity
has the meaning given by
27
section 9.
28
research and development collected amounts
means amounts
29
prescribed by the rules for the purposes of this definition.

rules
means the rules made by the Minister under section 90.

Secretary
means Secretary of the Department.

State or Territory body
includes a Department of State, or an

authority or agency, of a State or Territory.

State/Territory main fishing industry GVP amount
has the
5
meaning given by section 31.

statutory recipient body
means the following:
7
(a) a research and development corporation established under
8
regulations, or continued in existence under regulations,
9
made for the purposes of section 8 of the
Primary Industries
10
Research and Development Act 1989
;
11
(b) the Rural Industries Research and Development Corporation
12
established under section 9 of the
Primary Industries
13
Research and Development Act 1989
;
14
(c) Wine Australia.

total main fishing industry GVP amount
has the meaning given
16
by section 29.

(2) The Secretary may, in writing, authorise a person for the purposes
18
of paragraph (d) of the definition of
entrusted person
in
19
subsection (1).

5 Declared fishery
21
The rules may declare part of the fishing industry, whether
22
managed in whole or in part by or on behalf of the Commonwealth
23
or a State or Territory, to be a declared fishery.
24
6 Designated primary industry sectors for
declared recipient bodies
25
(1) The rules may:
26
(a) prescribe a primary industry in relation to a declared recipient
27
body only if the primary industry is a nationally significant
28
one; or
29
(b) prescribe a part of a primary industry in relation to a declared
30
recipient body only if that part is a nationally significant one.

(2) The following matters are relevant to whether a primary industry,
1
or a part of a primary industry, is a nationally significant one:
2
(a) the national presence of the primary industry or part,
3
including the geographical factors affecting the extent of that
4
presence;
5
(b) the economic significance of the primary industry or part to
6
the Australian economy;
7
(c) the historical significance of the primary industry or part.
8
(3) Subsection (2) does not limit the matters relevant to whether a
9
primary industry, or a part of a primary industry, is a nationally
10
significant one.

7 Definition of
relevant animal health body
12
(1) For the purposes of this Act,
relevant animal health body
, for an
13
AHA commodity/service, means a body determined in an
14
instrument under subsection (2) in relation to the AHA
15
commodity/service.
16
(2) The Secretary may, by notifiable instrument, determine one or
17
more bodies in relation to one or more specified AHA
18
commodities/services.
19
(3) The Secretary must not determine a body in relation to an AHA
20
commodity/service unless:
21
(a) the body is a member of Animal Health Australia; and
22
(b) the Secretary is satisfied that the body represents an industry
23
in relation to the AHA commodity/service.
24
8 Definition of
relevant plant health body
25
(1) For the purposes of this Act,
relevant plant health body
, for a PHA
26
commodity/service, means a body determined in an instrument
27
under subsection (2) in relation to the PHA commodity/service.
28
(2) The Secretary may, by notifiable instrument, determine one or
29
more bodies in relation to one or more specified PHA
30
commodities/services.

(3) The Secretary must not determine a body in relation to a PHA
1
commodity/service unless:

of the social or environmental consequences of adopting technical

developments, innovations or technology.

(1) The Commonwealth must pay to a recipient body amounts equal to

the following amounts that are received by or on behalf of the

Commonwealth:

(a) amounts of a levy or charge imposed by a provision

prescribed by the rules in relation to that body, to the extent
9
that those amounts are equal to the components of the rate of
10
that levy or charge prescribed by the rules;
11
(b) in relation to that levy or charge

amounts paid by a person
12
under rules made for the purposes of paragraph 10(1)(a) of
13
the Collection Act, to the extent that those amounts are equal
14
to those components;
15
(c) amounts by way of penalty under section 9 or 11 of the
16
Collection Act, to the extent that those amounts are

attributable to the non-payment of those components or of
18
amounts equal to those components.

(2) For the purposes of paragraph (1)(a), a provision prescribed by the

rules must be a provision of regulations made under:

Primary Industries (Excise) Levies Act 2023

Primary Industries (Customs) Charges Act 2023

(1) A recipient body that is paid amounts under section 15 must pay to

the Commonwealth
amounts equal to the Commonwealth's costs

in:

(a) collecting or recovering the amounts covered by

paragraphs 15(1)(a), (b) and (c); and

(a) the amount of those costs; and

(a) is a debt due to the Commonwealth; and

determines. Those times may be after the end of the relevant

GVP limit, an amount equal to the excess is a carry-over amount

for the body for the next financial year after the relevant financial

year.

average gross value of production amount

(1) The
average gross value of production amount
, in relation to a

recipient body to which subsection 23(1) applies, for a financial

subsection (2) of this section in relation to the recipient body for

the relevant financial year.

(2) For the purposes of subsection (1), the Secretary must, by

notifiable instrument, determine an amount in relation to the

recipient body for the relevant financial year. The Secretary must

do so as soon as practicable after the start of that year.

(3) That amount is to be the average of the gross value of production

amounts, in relation to the body, for each of the last 3 financial

years before the relevant financial year.

(4) The Secretary must specify in the instrument under subsection (2)

each gross value of production amount the Secretary used to

determine that average.

(7) Once the Secretary has determined an amount under subsection (2)

(a) the Secretary must, for the relevant financial year, disregard

any amount provided to the Secretary by the head of the
14
agricultural statistics body in substitution for a gross value of
15
production amount in relation to the body; and
16
(b) the Secretary must take the substituted amount into account
17
in determining an amount under subsection (2) in relation to
18
the body for each of the next 2 financial years after the
19
relevant financial year.

Alternative average gross value of production amount
21
(8) The Secretary may, by notifiable instrument, determine that
22
subsection (1) does not apply in relation to a specified recipient
23
body and a specified financial year (the
relevant financial year
).

The determination has effect accordingly.

(9) The Secretary may make a determination under subsection (8) only
26
if the Secretary is satisfied that the head of the agricultural
27
statistics body is unable to provide the Secretary with the gross
28
value of production amount, in relation to the body, for one or
29
more of the last 3 financial years before the relevant financial year.

(10) If the Secretary makes a determination under subsection (8), the
31
Secretary must specify in that determination:

(6) If the Minister revokes a declaration under subsection 39(1) in

relation to a body, the Minister may, in writing, direct the body:

41 Minister may give directions to declared recipient bodies

(1) The Minister may give a written direction to a declared recipient
2
body if:

(a) the Minister is satisfied that the direction is
in Australia's

national interest because of exceptional and urgent
5
circumstances; and
6
(b) the Minister is satisfied that the direction would not require
7
the body to incur expenses greater than the sum of the
8
amounts previously paid to the body under this Act that have
9
not been spent or committed and the amounts the body will
10
receive under this Act during the period to which the
11
direction relates; and
12
(c)
the Minister has given the body's directors an adequate
13
opportunity to discuss with the Minister the need for the
14
proposed direction and the impact of compliance with
15
subsections (3) to (5
) on the body's commercial activities.

(2) The body must comply with the direction.

(b) enter into another funding agreement with the body.

(3) Without limiting subsection (1) or (2), the agreement may contain
6
terms and conditions dealing with the following matters:

(a) the management of any payments to the body under this Act;

(b) any other matter in connection with the making of payments

to the body under this Act or the spending of those payments;

(c)
the monitoring of the body's compliance with its obligations
11
under this Act or the agreement;

(d) the provision of information by the body to the

Commonwealth about a matter covered by paragraph (a), (b)

or (c);

(e) the management of any payments to the body by the

Commonwealth other than under this Act.

(4) The body must comply with the terms and conditions specified in

the agreement.

Publishing requirement

(5) If the Minister, on behalf of the Commonwealth, enters into, or

varies, a funding agreement with a statutory recipient body under
22
this section, that body must publish a copy of the agreement, or of
23
the agreement as varied, on its website as soon as reasonably
24
practicable after the day on which the agreement was entered into
25
or the variation occurred.

49 Application of money
1
(1) A payment made under section 48 in relation to an AHA

commodity/service is subject to the condition that Animal Health
3
Australia must apply the payment in accordance with the priorities
4
in this section.

Payment of Commonwealth costs
6
(2) The first priority is to apply the payment in making a payment to
7
the Commonwealth
of amounts equal to the Commonwealth's
8
costs in:
9
(a) collecting or recovering the amounts covered by
10
paragraphs 48(1)(a), (b) and (c); and
11
(b) administering section 48 in relation to the making of the
12
payments under that section.
13
Note:
For further rules about these costs, see subsections (7) and (8).

Reimbursing Animal Health Australia
15
(3) The second priority is to apply the payment in meeting, or
16
reimbursing Animal Health Australia for meeting, costs Animal
17
Health Australia incurs:
18
(a) in receiving and applying the payment in accordance with the
19
priorities in this section; and
20
(b) before or in the financial year in which the payment is made.

Discharging liability under emergency animal biosecurity response
22
deed
23
(4) The third priority is to apply the payment in making a payment to
24
the Commonwealth if the payment to the Commonwealth is:
25
(a) on behalf of a relevant animal health body for the AHA
26
commodity/service; and
27
(b) for the purpose of discharging a liability of that body to the
28
Commonwealth under an emergency animal biosecurity
29
response deed relating to the AHA commodity/service.

Promotion or maintenance of health of animals, plants, fungi or

algae and research and development

(5) The fourth priority is to apply the payment, in accordance with a
3
request by a relevant animal health body for the AHA
4
commodity/service, in:
5
(a) taking measures relating to the promotion or maintenance of
6
the health of animals, plants, fungi or algae to which the
7
AHA commodity/service relates; or
8
(b) making a payment to an organisation that is concerned with
9
research and development in relation to the AHA
10
commodity/service.
11
When payment can be applied in accordance with lower priority
12
(6) Animal Health Australia does not contravene the condition in
13
subsection (1) by applying the payment in accordance with a lower
14
priority if Animal Health Australia cannot apply the payment in
15
accordance with a higher priority. For this purpose, a priority in a
16
later subsection is lower than a priority in an earlier subsection.
17
Recovery of Commonwealth costs
18
(7) The Secretary must give Animal Health Australia written notice of:
19
(a) the amount of the costs referred to in subsection (2); and
20
(b) the period within which Animal Health Australia must pay
21
the amount under subsection (2).
22
(8) If an amount payable by Animal Health Australia under
23
subsection (2) remains unpaid at the end of that period, the amount:
24
(a) is a debt due to the Commonwealth; and
25
(b) may be recovered by the Minister, on behalf of the
26
Commonwealth, by action in a court of competent
27
jurisdiction.

(1) The Commonwealth must pay to Plant Health Australia amounts

equal to the sum of the following amounts that are received by or
13
on behalf of the Commonwealth in relation to a PHA
14
commodity/service:
15
(a) amounts of a levy or charge imposed by a provision
16
prescribed by the rules in relation to Plant Health Australia,
17
to the extent that those amounts are equal to the components
18
of the rate of that levy or charge prescribed by the rules;
19
(b) in relation to that levy or charge
--
amounts paid by a person
20
under rules made for the purposes of paragraph 10(1)(a) of
21
the Collection Act, to the extent that those amounts are equal
22
to those components;
23
(c) amounts by way of penalty under section 9 or 11 of the
24
Collection Act, to the extent that those amounts are
25
attributable to the non-payment of those components or of
26
amounts equal to those components.
27
(2) For the purposes of paragraph (1)(a), a provision prescribed by the
28
rules must be a provision of regulations made under:
29
(a) the
Primary Industries (Excise) Levies Act 2023
; or
30
(b) the
Primary Industries (Customs) Charges Act 2023
; or
31
(c) the
Primary Industries (Services) Levies Act 2023
.

59 Application of money

(1) A payment made under section 58 in relation to a PHA

commodity/service is subject to the condition that Plant Health
3
Australia must apply the payment in accordance with the priorities
4
in this section.

Payment of Commonwealth costs
6
(2) The first priority is to apply the payment in making a payment to
7
the Commonwealth of amounts equal to the Commonwealth's
8
costs in:
9
(a) collecting or recovering the amounts covered by
10
paragraphs 58(1)(a), (b) and (c); and
11
(b) administering section 58 in relation to the making of the
12
payments under that section.
13
Note:
For further rules about these costs, see subsections (9) and (10).

Reimbursing Plant Health Australia
15
(3) The second priority is to apply the payment in meeting, or
16
reimbursing Plant Health Australia for meeting, costs Plant Health
17
Australia incurs:
18
(a) in receiving and applying the payment in accordance with the
19
priorities in this section; and
20
(b) before or in the financial year in which the payment is made.
21
Discharging liability under emergency plant biosecurity response
22
deed
23
(4) The third priority is to apply the payment in making a payment to
24
the Commonwealth if the payment to the Commonwealth is:
25
(a) on behalf of a relevant plant health body for the PHA
26
commodity/service referred to in subsection (1); and
27
(b) for the purpose of discharging a liability of that body to the
28
Commonwealth under an emergency plant biosecurity
29
response deed relating to the PHA commodity/service.
30
(5) The fourth priority is to apply the payment in making a payment to
31
the Commonwealth if the payment to the Commonwealth is:

(a) on behalf of, and at the request of, a relevant plant health

Commonwealth under an emergency plant biosecurity
5
response deed relating to any other PHA commodity/service
6
for which that body is a relevant plant health body.

(6) If a body has a liability to the Commonwealth under an emergency
8
plant biosecurity response deed relating to 2 or more PHA
9
commodities/services for which the body is a relevant plant health
10
body:
11
(a) the body must determine a proportionate amount of the total
12
liability for each of the PHA commodities/services; and
13
(b) for subsections (
4) and (5), the amount of the body's liability
14
in relation to each PHA commodity/service is the determined
15
proportionate amount for that PHA commodity/service.
16
Promotion or maintenance of health of plants, animals, fungi or
17
algae
18
(7) The fifth priority is to make payments to any person, in accordance
19
with a request by a body that is a relevant plant health body for the
20
PHA commodity/service referred to in subsection (1), for any
21
purpose relating to the promotion or maintenance of the health of:
22
(a) plants, animals, fungi or algae to which that PHA
23
commodity/service relates; or
24
(b) if the body is a relevant plant health body for any other PHA
25
commodity/service
--
plants, animals, fungi or algae to which
26
that other PHA commodity/service relates.
27
When payment can be applied in accordance with lower priority
28
(8) Plant Health Australia does not contravene the condition in
29
subsection (1) by applying the payment in accordance with a lower
30
priority if Plant Health Australia cannot apply the payment in
31
accordance with a higher priority. For this purpose, a priority in a
32
later subsection is lower than a priority in an earlier subsection.

Recovery of Commonwealth costs

(9) The Secretary must give Plant Health Australia written notice of:

(a) the amount of the costs referred to in subsection (2); and
3
(b) the period within which Plant Health Australia must pay the
4
amount under subsection (2).

(10) If an amount payable by Plant Health Australia under
6
subsection (2) remains unpaid at the end of that period, the amount:
7
(a) is a debt due to the Commonwealth; and
8
(b) may be recovered by the Minister, on behalf of the
9
Commonwealth, by action in a court of competent
10
jurisdiction.

60 Effect of refunds

Set-off

(1) If:
14
(a) an amount (the
received amount
) covered by

paragraph 58(1)(a), (b) or (c) is received by or on behalf of

the Commonwealth in relation to a PHA commodity/service;

and
18
(b) the Commonwealth pays to Plant Health Australia under
19
section 58 an amount equal to the received amount; and
20
(c) the Commonwealth, after making that payment, refunds an
21
amount equal to the whole or a part of the received amount;
22
the Commonwealth may set off an amount equal to the refund
23
against a payment the Commonwealth must make under section 58
24
in relation to the PHA commodity/service.

Note:
The Commonwealth might refund an amount because a person paid
26
too much levy or charge.

(2) If the Commonwealth is not able to do so, the Secretary may give

subsection (2) to pay an amount to the Commonwealth and an

(a) is a debt due to the Commonwealth; and

(b) may be recovered by the Minister, on behalf of the

Commonwealth, by action in a court of competent

jurisdiction.

contaminants in NRS products;
14
(ii) the testing, either on a random basis or in specific cases,
15
of NRS products or the environment for the purpose of

tracing the sources of contaminants and determining the
17
causes of contamination;
18
(iii) the testing and reporting of the level of contaminants in
19
NRS products or the environment, and any associated
20
activities, for the purpose of investigating the potential
21
sources, and determining the potential causes, of such
22
contaminants;
23
(iv) the prevention of contamination in, and the management
24
of risks associated with contamination of, NRS
25
products;
26
(b)
meeting or reimbursing the Commonwealth's costs in
27
relation to:
28
(i) collecting or recovering the amounts covered by
29
paragraphs 65(1)(a), (b) and (c); or
30
(ii) administering paragraphs 65(1)(a), (b) and (c); or
31
(iii) the carrying out of a main activity; or
32
(iv) the carrying out of an activity that facilitates a main
33
activity or that is incidental or ancillary to a main

72 Disclosure to persons holding an approval

(1) An entrusted person may disclose relevant NRS information to a

person who holds an approval in force under this section.

Approvals

(2) A person may, in writing, make a request to the Secretary for an

approval under this section.

(3) The Secretary must, in writing, grant the person an approval or
17
refuse to grant the person an approval.
18
(4) The Secretary may grant the person an approval only if the
19
Secretary is satisfied that the person requires relevant NRS
20
information to enable the person to monitor, regulate or manage
21
agricultural or veterinary chemical residues or contaminants in
22
NRS products or the environment.
23
(5) An approval must specify the purposes for which the person may
24
use or disclose relevant NRS information that the person receives
25
under subsection (1).

(6) If the Secretary grants the person an approval, the Secretary must
27
give the person written notice of the approval and of the purposes
28
covered by subsection (5).

82 Enforcement of civil penalty provisions

Enforceable civil penalty provisions

(1) Each civil penalty provision of this Act is enforceable under Part 4
15
of the Regulatory Powers Act.

Note:
Part 4 of the Regulatory Powers Act allows a civil penalty provision to
17
be enforced by obtaining an order for a person to pay a pecuniary
18
penalty for the contravention of the provision.

Authorised applicant
20
(2) For the purposes of Part 4 of the Regulatory Powers Act, the
21
Secretary is an authorised applicant in relation to the civil penalty
22
provisions of this Act.

(3) The Secretary may, in writing, delegate to an SES employee, or
24
acting SES employee, in the Department the Secretary's powers
25
under Part 4 of the Regulatory Powers Act in relation to the civil

penalty provisions of this Act.

(4) A person exercising powers under a delegation under

84 Internal reconsideration of decisions

(1) A person (the
aggrieved person
) whose interests are affected by a

decision of the Secretary under subsection 72(3) to refuse to grant
4
a person an approval may request the Secretary to reconsider the
5
decision.

(2) Subsection (1) does not apply to a decision that is made by the
7
Secretary personally.

Form and timing of request

(3) The aggrieved person must make the request in writing before the
10
end of:
11
(a) the period of 28 days beginning on the day on which that
12
person is notified of the decision, unless paragraph (b)
13
applies; or
14
(b) if the Secretary allows a longer period for making the

request

(4) The aggrieved person must set out in the request the reasons for the

(1) Applications may be made to the Administrative Appeals Tribunal

(1) If, apart from this subsection, the Commonwealth does not have

power under this Act to pay an amount (the
relevant amount
) to a

body purportedly as a payment under subsection 15(1), 23(1),
5
26(1), 27(1), 44(1), 48(1), 54(1) or 58(1), then the Commonwealth
6
may pay the relevant amount to the body.

Debt
8
(2) If a payment is made under subsection (1) to the body, the relevant
9
amount:
10
(a) is a debt due to the Commonwealth by the body; and
11
(b) may be recovered by the Minister, on behalf of the
12
Commonwealth, by action in a court of competent
13
jurisdiction.

Set-off
15
(3) The Commonwealth may set off the whole or a part of the relevant
16
amount against a later payment the Commonwealth must make
17
under this Act to the body.
18
(4) The debt under subsection (2) is reduced by the amount of the
19
set-off.

Appropriation

(5) The Consolidated Revenue Fund is appropriated for the purposes
22
of making payments under subsection (1).

87 Report about recoverable payments

(1) The Secretary must cause the following information to be included

in the Department'
s annual report for a financial year:

(a) the number of payments under subsection 86(1) that APS

employees in the Department are aware of that were made

during that financial year;

Incorporation of other instruments
