The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Passenger Movement Charge
5
Amendment Act 2012.

2 Commencement

This Act commences on 1 July 2012.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

Repeal the section, substitute:

6 Rate of passenger movement charge--use of tickets etc.

Financial year beginning on 1 July 2012

(1) If a person departs from Australia using a ticket or equivalent
8
authority sold or issued in the financial year beginning on 1 July
9
2012, the rate of passenger movement charge in respect of the
10
departure is $55.

Financial years beginning on or after 1 July 2013
12
(2) If a person departs from Australia using a ticket or equivalent
13
authority sold or issued in a financial year (the indexation year)
14
beginning on or after 1 July 2013, the rate of passenger movement
15
charge in respect of the departure is the following amount:

former rate of charge means the rate of passenger movement
19
charge in respect of a person departing from Australia using a
20
ticket or equivalent authority sold or issued in the financial year
21
before the indexation year.

indexation factor means the indexation factor for the indexation
23
year worked out under section 8.

(3) An amount worked out under subsection (2) is to be calculated to 2
25
decimal places (rounding up if the third decimal place is 5 or
26
more).

7 Rate of passenger movement charge--other cases

Financial year beginning on 1 July 2012

(1) If a person departs from Australia in the financial year beginning
3
on 1 July 2012 otherwise than using a ticket or equivalent
4
authority, the rate of passenger movement charge in respect of the
5
departure is $55.

Financial years beginning on or after 1 July 2013
7
(2) If a person departs from Australia in a financial year (the
8
indexation year) beginning on or after 1 July 2013 otherwise than
9
using a ticket or equivalent authority, the rate of passenger
10
movement charge in respect of the departure is the following
11
amount:

former rate of charge means the rate of passenger movement
15
charge in respect of a person departing from Australia in the
16
financial year before the indexation year otherwise than using a
17
ticket or equivalent authority.

indexation factor means the indexation factor for the indexation
19
year worked out under section 8.

(3) An amount worked out under subsection (2) is to be calculated to 2

decimal places (rounding up if the third decimal place is 5 or

more).

8 Indexation factor

(1)
The
indexation factor for a financial year (the indexation year) is
25
the number worked out using the following formula:

base March quarter means the March quarter that has the highest

index number of the March quarters before the reference March
2
quarter (but not earlier than the March quarter 2012).

index number, for a quarter, means the All Groups Consumer
4
Price Index number that is the weighted average of the 8 capital
5
cities and is published by the Australian Statistician in relation to
6
that quarter.

March quarter means a quarter ending on 31 March.

reference March quarter means the last March quarter before the
9
start of the indexation year.

(2) The indexation factor is to be calculated to 3 decimal places
11
(rounding up if the fourth decimal place is 5 or more).

(3) If an indexation factor worked out under this section would be less
13
than 1, the indexation factor is to be increased to 1.
14
(4) Calculations under this section:
15
(a) are to be made using only the index numbers published in
16
terms of the most recently published reference base for the
17
Consumer Price Index; and
18
(b) are to be made disregarding index numbers published in
19
substitution for previously published index numbers (except
20
where the substituted numbers are published to take account
21
of changes in the reference base).

2 Application provision
23
The amendment made by item 1 applies in relation to the departure of a
24
person from Australia on or after 1 July 2012, unless:
25
(a) the person departs using a ticket or equivalent authority; and
26
(b) the ticket or authority was sold or issued before 1 July 2012.
