The Parliament of Australia enacts:

1 Short title

This Act is the
Protecting Pensioners from the Cashless Debit

Card Act 2021
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

1 Definitions

(1)
In this Schedule:
4
cashless debit card scheme
means Part 3D of the
Social Security
5
(Administration) Act 1999
.
6
Family Responsibilities Commission
means the Family
7
Responsibilities Commission established under the
Family
8
Responsibilities Commission Act 2008
(Qld).
9
Indigenous person
means:
10
(a) an Aboriginal person (within the meaning of the
Aboriginal
11
and Torres Strait Islander Act 2005
); or
12
(b) a Torres Strait Islander (within the meaning of that Act).
13
plan area
means any of the following:
14
(a) the Ceduna area;
15
(b) the East Kimberley area;
16
(c) the Goldfields area;
17
(d) the Bundaberg and Hervey Bay area;
18
(e) the Cape York area.
19
publication deadline
means the later of:
20
(a) 31 January 2022; and
21
(b) the day occurring 7 days after this item commences.

(2)
An expression that is used in Part 3D of the
Social Security
23
(Administration) Act 1999
has the same meaning, when used in this
24
Schedule, as in that Part.

2 Local services and jobs plans
26
(1)
The Minister must, for each plan area, prepare a written plan (a
local
27
services and jobs plan
) for:
28
(a) creating jobs in the area;
29
(b) improving community services in the area; and
30
(c) addressing social issues in the area.
31
(2)
In preparing a local services and jobs plan for a plan area, the Minister
32
must:

(a) have regard to the principle that the plan should prioritise
1
evidence-based local investments; and
2
(b) consult with the following:
3
(i) community organisations, including First Nations
4
organisations, that operate in the area;
5
(ii) health services that operate in the area;
6
(iii) businesses that operate in the area;
7
(iv) the State in which the area is located; and
8
(v) each relevant local council.

(3)
Without limiting subitem (1), the local services and jobs plan for the
10
Cape York area must set out transitionary arrangements to support the
11
continued operation of the Family Responsibilities Commission.
12
(4)
The Minister must cause the local services and jobs plan for each plan
13
area to be:
14
(a) published on the Department's website on or before the
15
publication deadline; and
16
(b) tabled in each House of the Parliament within 3 sitting days
17
of that House after the plan is published under paragraph (a).
18
(5)
A local services and jobs plan:
19
(a) is not a legislative instrument; and
20
(b) does not affect any legal rights, liabilities or duties.

Constitutional basis of this item
22
(6)
The purpose of this item is to inform:
23
(a) the Parliament in making laws for the peace, order and good
24
government of the Commonwealth; and
25
(b) the Executive Government in exercising the executive power
26
of the Commonwealth, including the execution and
27
maintenance the laws of the Commonwealth;
28
including with respect to the following:
29
(c) corporations to which paragraph 51(xx) of the Constitution
30
applies;
31
(d) invalid and old-age pensions;
32
(e) the provision of maternity allowances, widows' pensions,
33
child endowment, unemployment, pharmaceutical, sickness

and hospital benefits, medical and dental services, benefits to
1
students and family allowances;
2
(f) special laws for Indigenous persons;
3
(g) financial assistance to the States.

3 Cost of cashless debit card scheme
5
(1)
The Minister must prepare a written estimate of the full cost to the
6
Commonwealth of the operation of the cashless debit card scheme.
7
(2)
The Minister must cause the estimate to be:
8
(a) published on the Department's website on or before the
9
publication deadline; and
10
(b) tabled in each House of the Parliament within 3 sitting days
11
of that House after the estimate is published under
12
paragraph (a).

4 Contract with Indue Ltd
14
(1)
The Minister must cause a copy of each contract between the
15
Commonwealth and Indue Ltd relating to the operation of the cashless
16
debit card scheme to be:
17
(a) published on the Department's website on or before the later
18
of:
19
(i) 31 December 2021; and
20
(ii) the day occurring 7 days after this item commences; and
21
(b) tabled in each House of the Parliament within 3 sitting days
22
of that House after the contract is published under
23
paragraph (a).

(2)
Before publishing or tabling a copy of a contract under subitem (1), the
25
Minister may remove from the copy any confidential commercial
26
information contained in the contract.

5 Technology working group and product level blocking
28
(1)
The Minister must cause copies of each document mention in
29
subitem (2) to be:
30
(a) published on the Department's website within 7 days after
31
the commencement of this item; and

(b) tabled in each House of the Parliament within 3 sitting days
1
of that House after the document is published under
2
paragraph (a).

(2)
For the purposes of subitem (1), the documents are:
4
(a) the minutes of the cashless debit card technology working
5
group; and
6
(b) all other documents associated with the working group that,
7
on the commencement of this item, are in the Minister's
8
possession; and
9
(c) all documents associated with product level blocking under
10
the cashless debit card scheme that, on the commencement of
11
this item, are in the Minister's possession.
