1 Short title

This Act may be cited as the Paid Parental Leave and Other

Legislation Amendment (Dad and Partner Pay and Other

Measures) Act 2012.

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

Chapter 3A--Dad and partner pay

Chapter 3A sets out when dad and partner pay is payable to a
2
person. The key provisions for the Chapter are found in Part 3A-1.

A person can only be paid dad and partner pay if the Secretary
4
makes a determination that dad and partner pay is payable to the
5
person. Part 3A-2 has rules about when the Secretary can make that
6
determination.

The Secretary cannot make that determination if the person is not
8
eligible for dad and partner pay. Part 3A-3 has the rules about
9
eligibility. For the main case, to be eligible a person must
10
(broadly):
11
(a) satisfy the work test, the income test and the Australian
12
residency test; and
13
(b) be caring for the child; and
14
(c) not be working.

The Secretary also cannot make that determination if the person
16
has not made a claim for dad and partner pay. Part 3A-4 has the
17
rules about claims.

Part 3A-5 sets out how dad and partner pay is paid to a person.

Generally, dad and partner pay is paid by the Secretary as a single

payment.

115AE The determination must specify the person's DAPP period
1
(1) If the Secretary makes a determination that dad and partner pay is
2
payable to a person for a child, the Secretary must specify, in the
3
determination, the period for which dad and partner pay is payable
4
to the person. That period is the person's DAPP period.

(2) A person's DAPP period must be the same as, or within, the
7
maximum DAPP period for the child.

(3)
The
maximum DAPP period for a child is the period that:
9
(a) starts on the child's maximum DAPP period start day; and
10
(b) ends on the child's maximum DAPP period end day.
11
(4)
The
maximum DAPP period start day for a child is the later of the
12
following days:
13
(a) the day the child was born;
14
(b) the claimant's nominated start date.
15
(5)
The
maximum DAPP period end day for a child is the earlier of
16
the following days:
17
(a) the day that is 13 days after the maximum DAPP period start
18
day;
19
(b) the day before the child's first birthday.

This Part is about the Secretary making determinations about
25
whether dad and partner pay is payable to a person. These
26
determinations are payability determinations. A person cannot be
27
paid dad and partner pay unless there is a payability determination
28
that dad and partner pay is payable to the person.

Division 2 has the rules that apply to the Secretary when making a

payability determination.
2
Division 3 has restrictions that apply in particular circumstances to
3
prevent the Secretary from making a payability determination that
4
dad and partner pay is payable to a person (for example, where the
5
child's birth has not been verified or the person has already been
6
paid dad and partner pay for the child).
7
Division 4 has general rules that apply to payability determinations
8
(for example, if the Secretary makes a determination, the Secretary
9
must give a notice of it to the claimant).
10
Division 5 deals with initial eligibility determinations. These
11
determinations can be made by the Secretary before the Secretary
12
makes a payability determination. The Secretary can make an
13
initial eligibility determination if the Secretary is satisfied that the
14
person satisfies, or will satisfy, particular eligibility criteria (the
15
work test, the income test and the Australian residency test). If the
16
Secretary makes a determination, the Secretary must give a notice
17
of it to the claimant.

When Secretary must make determination
22
(1) If a person has made an effective claim for dad and partner pay for
23
a child, the Secretary must make a determination on the claim.
24
When dad and partner pay is payable to DAPP claimant
25
(2) The Secretary must determine that dad and partner pay is payable
26
to the DAPP claimant for the claimant's DAPP period if, when
27
making the determination, the Secretary is satisfied that the DAPP
28

person requested the Secretary to revoke the determination.

There are other eligibility criteria that apply for more unusual

cases--see subsection 115CB(3) (which deals with when a child is
4
stillborn or dies) and subsection 115CB(4) (which allows the PPL
5
rules to prescribe eligibility criteria).

The work test is mostly in Division 3 of Part 2-3, but Division 3 of
7
this Part has provisions relevant to DAPP claimants. To satisfy the
8
work test, a person must have performed enough paid work or
9
taken enough paid leave in a particular period before the person's
10
nominated start date for dad and partner pay. Special rules apply in
11
the case of premature birth or complications or illness related to the
12
pregnancy (see section 115CE) or if the person is already eligible
13
for parental leave pay (see section 115CF).
14
The income test is mostly in Division 4 of Part 2-3, but Division 4
15
of this Part has provisions relevant to DAPP claimants. To satisfy
16
the income test, the person's income for a particular income year
17
must not be more than the PPL income limit (which is $150,000
18
until 30 June 2014 and then indexed). A special rule applies if the
19
person is already eligible for parental leave pay (see subsection
20
115CG(2)).
21
The Australian residency test is in Division 5 of Part 2-3. To
22
satisfy this test, the person must be an Australian resident or be in a
23
special class of visa holder.
24
Division 6 of this Part sets out when a person is caring for a child.
25
For the main case, a person will not be eligible for dad and partner
26
pay if the person is not caring for the child.
27
Division 7 of this Part sets out when a person is not working. For
28
the main case, a person will not be eligible for dad and partner pay
29
if the person performs one hour or more of work other than for a
30
purpose of performing the work for a business that the person
31
carries on and that consists of overseeing the business or is an
32
occasional administrative task.

(1) This section sets out when a DAPP claimant is eligible for dad and

partner pay for a child on a day.

Eligible
6
(2) First, a DAPP claimant is eligible for dad and partner pay for a
7
child on a day if, on that day:
8
(a) the claimant satisfies the work test (see Division 3 of Part 2-3
9
and sections 115CD, 115CE and 115CF); and
10
(b) the claimant satisfies the income test (see Division 4 of
11
Part 2-3 and sections 115CG, 115CH and 115CJ); and
12
(c) the claimant satisfies the Australian residency test (see
13
Division 5 of Part 2-3); and
14
(d) the claimant is caring for the child (see Division 6 of this
15
Part); and
16
(e) the claimant is not working (see Division 7 of this Part).
17
(3) Second, a DAPP claimant is eligible for dad and partner pay for a
18
child on a day if:
19
(a) the child is stillborn or has died before that day; and
20
(b) on that day, the claimant would be eligible under
21
subsection (2) for dad and partner pay for the child, if
22
paragraphs (2)(d) and (e) were disregarded; and
23
(c) the claimant would have been caring for the child on that day
24
had the child not been stillborn or died.
25
(4) Third, a DAPP claimant is eligible for dad and partner pay for a
26
child on a day if, on that day, the claimant satisfies:
27
(a) the work test (see Division 3 of Part 2-3 and sections 115CD,
28
115CE and 115CF); and
29
(b) the income test (see Division 4 of Part 2-3 and
30
sections 115CG, 115CH and 115CJ); and
31
(c) the Australian residency test (see Division 5 of Part 2-3); and
32
(d) the conditions prescribed by the PPL rules.

(b) combined, the total days in the PPL period and the reference

period for the person's claim for dad and partner pay for the
19
child exceed 126;
20
then:
21
(c) the Secretary must exclude from the reference period the
22
excess number of days; and
23
(d) the person is not eligible for dad and partner pay for the child
24
on a day excluded by the Secretary.

Not eligible--claimant deceased
26
(8) Despite subsections (2), (3) and (4), a DAPP claimant is not
27
eligible for dad and partner pay for a child on a day if, on that day,
28
the claimant is deceased.

(2) A DAPP claimant's reference period is the period that is

determined by the Secretary for the purposes of making a
2
payability determination on the DAPP claimant's claim.

(3) More than one person may be caring for the same child on any
4
particular day. This does not prevent one of the persons being the
5
primary carer of the child under section 47.
6
(4) Despite subsection (1), a person is not caring for a child on a day
7
if, before that day, the child has died.

Division 7--Not working
9
115CM When a DAPP claimant is not working
10
(1) A DAPP claimant is not working on a day if neither of the
11
following apply on that day:
12
(a) the DAPP claimant performs one hour or more of paid work,
13
other than for a purpose that is a permissible purpose under
14
subsection 49(2);
15
(b) the DAPP claimant is on paid leave.
16
(2) However, the PPL rules may prescribe circumstances in which a
17
DAPP claimant is taken to be not working even though
18
paragraph (1)(a) or (b) applies to the claimant.

section 115DK.

Only a natural person can make a claim for dad and partner pay.

A claim for dad and partner pay must be made in the form

Only the following people can make a claim for dad and partner

pay for a child:

(a) the biological father of the child;
18
(b) the partner of the child's birth mother;

(c) an adoptive parent of the child;

(d) a person who satisfies circumstances prescribed by the PPL

rules.

(1) A claim for dad and partner pay is not effective unless the

requirements of the following provisions that apply to the claim are

satisfied:

(a) section 115DF (which deals with the form etc. of the claim);

have been made.

115DF Requirements of the claim
7
The claim for dad and partner pay must:
8
(a) be made in the form approved, and the manner required, by
9
the Secretary for dad and partner pay; and
10
(b) contain any information required by the Secretary; and
11
(c) be accompanied by any documents required by the Secretary.

115DG Nominated start date
13
(1) The claim must state a specific date (the nominated start date)
14
which is the first day of the period for which the claimant wants to
15
be paid dad and partner pay.
16
(2) The nominated start date must be on or after:
17
(a) if the claim is made before the child is born--the expected
18
date of birth of the child; or
19
(b) if the claim is made after the child is born--the child's actual
20
date of birth.
21
(3) Before a payability determination is made on the claim for dad and
22
partner pay, the claimant may change his or her nominated start
23
date by notifying the Secretary of the new nominated start date.
24
(4) If a payability determination is made that dad and partner pay is
25
payable to the claimant, the claimant may only change his or her
26
nominated start date (the old date) by notifying the Secretary,
27
before the old date, of the new nominated start date.

(1) The Secretary must pay dad and partner pay that is payable to a

person to the credit of a bank account nominated and maintained

provided for by subsection (1). If the Secretary gives the direction,
22
the payment is to be paid in accordance with the direction.

(3) A direction made under subsection (2) is not a legislative

instrument.

If the Secretary pays dad and partner pay to or in relation to a

person, in particular circumstances, the Secretary must give the

115EF Effect of extending DAPP period after review

(1)
If:

(a) the Secretary has made a payability determination that dad

and partner pay is payable to a person; and

(b) after the Secretary has paid the dad and partner pay, a

decision is made in relation to the payability determination
6
that has the effect that a higher amount of dad and partner
7
pay is payable to the person;
8
the Secretary must pay the person the difference between the
9
higher amount and the amount already paid to the person as soon
10
as practicable after the decision is made.

(2) To avoid doubt, any difference worked out under subsection (1) is
12
also dad and partner pay.

115EG Protection of payment
14
(1) A payment of dad and partner pay is absolutely inalienable,
15
whether by way of, or in consequence of, sale, assignment, charge,
16
execution, bankruptcy or otherwise.

Note:
Section 115EK (which deals with the effect of a garnishee etc. order)

also provides a protection for an account into which dad and partner
19
pay has been paid.

(2) Subsection (1) has effect subject to section 115EH.

115EH Deductions for PAYG withholding

The Secretary may deduct an amount from a payment of dad and
23
partner pay to a person if the Secretary is required to withhold the
24
amount under section 12-110 in Schedule 1 to the Taxation

Administration Act 1953.

An amount must not be deducted from a payment of dad and

partner pay except in accordance with section 115EH. This section

applies despite any other law of the Commonwealth, a State or a

(1) The payment of dad and partner pay is not to be taken into account

for the purposes of the following provisions or laws:
21
(a) a provision of a law of the Commonwealth, a State or a
22
Territory, if the provision deals with:
23
(i) workers' compensation; or
24
(ii)
accident
compensation;
25
(b) a law, or a provision of a law, prescribed by the PPL rules, to
26
the extent that the law or provision deals with a matter
27
referred to in paragraph (a).
28
(2) The PPL rules may provide that subsection (1) does not apply in
29
relation to a prescribed provision of a law of the Commonwealth, a

State or a Territory.

child and the employee is not fit for work, she may be entitled to:

(a) paid personal leave under Subdivision A of Division 7; or
16
(b) unpaid special maternity leave under section 80.

Return to work

(4) The employee may give the employer written notice that the
19
employee wishes to return to work:
20
(a) after the start of the period of leave, but before its end; and
21
(b) within 4 weeks after the employer receives the notice.
22
(5)
The
employer:
23
(a) may give the employee written notice requiring the employee
24
to return to work on a specified day; and
25
(b) must do so if the employee gives the employer written notice
26
under subsection (4);
27
unless the leave has not started and the employer cancels it under
28
subsection (2).

(6) The specified day must be after the start of the period of leave, and:
30
(a) if subsection (4) applies--within 4 weeks after the employer
31
receives the notice under that subsection; or
32
(b) otherwise--at least 6 weeks after the notice is given to the
33
employee under subsection (5).

(1) This Subdivision does not prevent an employee from performing

work for his or her employer on a keeping in touch day while he or

she is taking unpaid parental leave. If the employee does so, the

performance of that work does not break the continuity of the

period of unpaid parental leave.

(2) A day on which the employee performs work for the employer
21
during the period of leave is a keeping in touch day if:
22
(a) the purpose of performing the work is to enable the employee
23
to keep in touch with his or her employment in order to
24
facilitate a return to that employment after the end of the
25
period of leave; and
26
(b) both the employee and the employer consent to the employee
27
performing work for the employer on that day; and
28
(c) the day is not within:
29
(i) if the employee suggested or requested that he or she
30
perform work for the employer on that day--14 days
31
after the date of birth, or day of placement, of the child
32
to which the period of leave relates; or

The duration of the work the employee performs on that day is not

relevant for the purposes of this subsection.

The employer will be obliged, under the relevant contract of

employment or industrial instrument, to pay the employee for

performing work on a keeping in touch day.

(3) The employee's decision whether to give the consent mentioned in
11
paragraph (2)(b) is taken, for the purposes of section 344 (which
12
deals with undue influence or pressure), to be a decision to make,
13
or not make, an arrangement under the National Employment
14
Standards.

(4) For the purposes of paragraph (2)(d), treat as 2 separate periods of
16
unpaid parental leave:
17
(a) a period of unpaid parental leave taken during the employee's
18
available parental leave period; and
19
(b) a period of unpaid parental leave taken as an extension of the
20
leave referred to in paragraph (a) for a further period
21
immediately following the end of the available parental leave
22
period.

Note:
Performance of work on keeping in touch days is also dealt with, for
24
the purposes of parental leave pay, in sections 49 and 50 of the Paid
25
Parental Leave Act 2010.

79B Unpaid parental leave not extended by paid leave or keeping in

84A Replacement employees

Before an employer engages an employee to perform the work of
2
another employee who is going to take, or is taking, unpaid
3
parental leave, the employer must notify the replacement
4
employee:
5
(a) that the engagement to perform that work is temporary; and
6
(b) of the rights:
7
(i) the employer; and
8
(ii) the employee taking unpaid personal leave;
9
have under subsections 77A(2) and (3) (which provide a right
10
to cancel the leave if the pregnancy ends other than by the
11
birth of a living child or if the child dies after birth); and

(c) of the rights the employee taking unpaid parental leave has
