1 Short title
4
This Act may be cited as the Public Service Amendment Act 2012.

2 Commencement
6
(1) Each provision of this Act specified in column 1 of the table
7
commences, or is taken to have commenced, in accordance with
8
column 2 of the table. Any other statement in column 2 has effect
9
according to its terms.

57 Roles and responsibilities of Secretaries
7
Roles of Secretaries
8
(1) The roles of the Secretary of a Department include, but are not
9
limited to, the following:
10
(a) principal official policy adviser to the Agency Minister;
11
(b) manager, ensuring delivery of government programs and
12
collaboration to achieve outcomes within the Agency
13
Minister's portfolio and, with other Secretaries, across the
14
whole of Government;
15
(c) leader, providing stewardship within the Department and, in
16
partnership with the Secretaries Board, across the APS;
17
(d) any other role prescribed by the regulations.
18
Responsibilities of Secretaries
19
(2) The responsibilities of the Secretary of a Department are as
20
follows:
21
(a) to manage the affairs of the Department efficiently,
22
effectively, economically and ethically;
23
(b) to advise the Agency Minister about matters relating to the
24
Department;
25
(c) to implement measures directed at ensuring that the
26
Department complies with the law;
27
(d) to provide leadership, strategic direction and a focus on
28
results for the Department;

(e) to maintain clear lines of communication within the Agency

Minister's portfolio, as negotiated between the Secretary and
2
the other Agency Heads in the portfolio;
3
(f) to engage with stakeholders, particularly in relation to the
4
core activities of the Department;
5
(g) to manage the affairs of the Department in a way that is not
6
inconsistent with the policies of the Commonwealth and the
7
interests of the APS as a whole;
8
(h) to ensure that the Agency Minister's portfolio has a strong
9
strategic policy capability that can consider complex,
10
whole-of-government issues;
11
(i) to assist the Agency Minister to fulfil the Agency Minister's
12
accountability obligations to the Parliament to provide factual
13
information, as required by the Parliament, in relation to the
14
operation and administration of the Department;
15
(j) such other responsibilities as are prescribed by the
16
regulations.
17
(3) Subsection (2) does not affect a Secretary's responsibilities under
18
any other law.

58 Appointment
22
(1) The Secretary of a Department is to be appointed by the
23
Governor-General, by written instrument, on the recommendation
24
of the Prime Minister.
25
Note:
The Secretary of a Department is eligible for reappointment as the
26
Secretary of that Department (see section 33AA of the Acts
27
Interpretation Act 1901).
28
(2) The Secretary of a Department holds office for the period specified
29
in the instrument of appointment.
30
(3) The period of a person's appointment as the Secretary of a
31
Department must be:
32
(a) 5 years; or
33
(b) if the person has requested a shorter period--that shorter
34
period.

(4) Subsection (3) does not apply in relation to a person who is
1
reappointed as the Secretary of a Department. In this case, the
2
person's appointment may be for any period not exceeding 5 years.

(5) The Secretary of a Department holds office on a full-time basis.
4
(6) Before recommending to the Governor-General that a person be
5
appointed as the Secretary of the Prime Minister's Department, the
6
Prime Minister must have received a report about the appointment
7
prepared by the Commissioner.
8
(7) Before recommending to the Governor-General that a person be
9
appointed as the Secretary of a Department other than the Prime
10
Minister's Department, the Prime Minister must have received a
11
report about the appointment from the Secretary of the Prime
12
Minister's Department.
13
(8) The report from the Secretary of the Prime Minister's Department
14
about the appointment of the Secretary of another Department
15
must:
16
(a) be prepared after consultation with:
17
(i) the Commissioner; and
18
(ii) the person who is expected to be the Agency Minister of
19
the other Department at the time the appointment is
20
made; and
21
(b) if the Secretary of the Prime Minister's Department and the
22
Commissioner disagree in relation to the proposed
23
appointment--explain the substance of the disagreement.
24
59 Termination of appointment
25
(1) The Governor-General may, on the recommendation of the Prime
26
Minister and by notice in writing, terminate the appointment of a
27
Secretary.

Note: In
Barratt v Howard [1999] FCA 1132, the Federal Court of Australia
29
described the basis on which requirements of procedural fairness
30
applied to the termination of an appointment of Secretary under
31
section 37 of the Public Service Act 1922.
32
(2) Before recommending to the Governor-General that the
33
appointment of the Secretary of the Prime Minister's Department
34
be terminated, the Prime Minister must have received a report
35
about the proposed termination from the Commissioner.

(3) Before recommending to the Governor-General that the

appointment of the Secretary of a Department other than the Prime
2
Minister's Department be terminated, the Prime Minister must
3
have received a report about the proposed termination from the
4
Secretary of the Prime Minister's Department.
5
(4) The report from the Secretary of the Prime Minister's Department
6
about the proposed termination of the appointment of the Secretary
7
of another Department must:
8
(a) be prepared after consultation with the Commissioner; and
9
(b) if the Secretary of the Prime Minister's Department and the
10
Commissioner disagree in relation to the proposed
11
termination--explain the substance of the disagreement.

60 Engagement of former Secretaries
13
(1) The Prime Minister may, on behalf of the Commonwealth, engage
14
(otherwise than as an APS employee) a person who is a former
15
Secretary on terms and conditions determined by the Prime
16
Minister.
17
(2) A person is a former Secretary for the purposes of subsection (1)
18
if:
19
(a) the office of Secretary to which the person was appointed has
20
been abolished under subsection 56(2); or
21
(b) the person's appointment as Secretary has been terminated
22
under section 59; or
23
(c) the person has resigned his or her appointment as Secretary;
24
or
25
(d) the period of the person's appointment as Secretary has
26
ended.

An annual review of the performance of a Secretary must be

carried out in accordance with a framework established by the

Secretary of the Prime Minister's Department and the

(1) The Secretaries Board is established by this section.

(2) The Secretaries Board consists of the following members:
13
(a) the Secretary of the Prime Minister's Department, as Chair;

(b) the Secretary of each other Department;

(c)
the
Commissioner;

(d) such other persons as are nominated in writing by the
17
Secretary of the Prime Minister's Department.

(3) The Secretaries Board has the following functions:
19
(a) to take responsibility for the stewardship of the APS and for
20
developing and implementing strategies to improve the APS;
21
(b) to identify strategic priorities for the APS and consider issues
22
that affect the APS;
23
(c) to set an annual work program, and direct subcommittees to
24
develop strategies to address APS-wide issues and make
25
recommendations to the Secretaries Board;
26
(d) to draw together advice from senior leaders in government,
27
business and the community;
28
(e) to work collaboratively and model leadership behaviours.

(4) The Secretaries Board may establish one or more senior leadership
1
groups, consisting of members determined by the Secretaries
2
Board, to assist the Secretaries Board in performing its functions.

5 Subsection 35(2)

Repeal the subsection, substitute:

(2) The function of the SES is to provide APS-wide strategic
5
leadership of the highest quality that contributes to an effective and
6
cohesive APS.
7
(3) For the purpose of carrying out the function of the SES, each SES
8
employee:
9
(a) provides one or more of the following at a high level:
10
(i) professional or specialist expertise;
11
(ii)
policy
advice;
12
(iii) program or service delivery;
13
(iv) regulatory administration; and
14
(b) promotes cooperation within and between Agencies,
15
including to deliver outcomes across Agency and portfolio
16
boundaries; and

(c) by personal example and other appropriate means, promotes
18
the APS Values, the APS Employment Principles and
19
compliance with the Code of Conduct.

41 Commissioner's functions

(1) The Commissioner has the following functions:
7
(a) to strengthen the professionalism of the APS and facilitate
8
continuous improvement in workforce management in the
9
APS;
10
(b) to uphold high standards of integrity and conduct in the APS;
11
(c) to monitor, review and report on APS capabilities within and
12
between Agencies to promote high standards of
13
accountability, effectiveness and performance.
14
(2) Without limiting subsection (1), the Commissioner's functions
15
include the following:
16
(a) to foster, and contribute to, leadership, high quality learning
17
and development and career management in the APS;
18
(b) to lead the thinking about, provide advice on and drive
19
reforms to workforce management policies so that the APS is
20
ready for future demands;
21
(c) to develop, review and evaluate APS workforce management
22
policies and practices and maintain appropriate databases;
23
(d) to foster an APS workforce that reflects the diversity of the
24
Australian population;
25
(e) to promote the APS Values, the APS Employment Principles
26
and the Code of Conduct;
27
(f) to evaluate the extent to which Agencies incorporate and
28
uphold the APS Values and the APS Employment Principles;
29
(g) to partner with Secretaries in the stewardship of the APS;
30
(h) to provide advice and assistance to Agencies on public
31
service matters;
32
(i) to work with other governments (including foreign
33
governments) on matters relating to public sector workforce
34
management, leadership and career management;

(j) to review any matter relating to the APS;

(k) to review any matter relating to the APS referred to the
2
Commissioner by the Public Service Minister, and report on
3
that matter to the Public Service Minister;
4
(l) to evaluate the adequacy of systems and procedures in
5
Agencies for ensuring compliance with the Code of Conduct;
6
(m) to inquire, in accordance with section 41A, into alleged
7
breaches of the Code of Conduct by Agency Heads;
8
(n) to inquire into and determine, in accordance with
9
section 41B, whether an APS employee, or a former APS
10
employee, has breached the Code of Conduct;
11
(o) to inquire, subject to regulations made for the purposes of
12
section 16, into whistleblower reports made to the
13
Commissioner (or a person authorised by the Commissioner)
14
as referred to in that section;
15
(p) such other functions as are conferred on the Commissioner
16
by this Act, the regulations or any other law;
17
(q) such other functions as the Prime Minister, by legislative
18
instrument, directs the Commissioner to perform;
19
(r) to do anything incidental to or conducive to the performance
20
of any of the Commissioner's functions.

Note:
Neither section 42 (disallowance) nor Part 6 (sunsetting) of the
22
Legislative Instruments Act 2003 applies to a direction given under
23
paragraph (2)(q) (see sections 44 and 54 of that Act).

Reports may include recommendations
25
(3) A report made by the Commissioner in the performance of his or
26
her functions may include recommendations.
27
Fees
28
(4) The regulations may authorise the Commissioner to charge fees
29
(on behalf of the Commonwealth) for the performance, on request,
30
of the Commissioner's functions.

41A Inquiry into alleged breach of Code of Conduct by Agency
1
Head
2
(1) The Commissioner may, for the purposes of paragraph 41(2)(m),
3
inquire into an alleged breach of the Code of Conduct by an
4
Agency Head.
5
(2) The Commissioner must report on the results of an inquiry under
6
subsection (1) (including, if relevant, recommendations for
7
sanctions) to:
8
(a) if the Agency Head is a Secretary--the Prime Minister; or
9
(b) if the Agency Head is the Head of an Executive Agency--the
10
Agency Minister; or
11
(c) if the Agency Head is the Head of a Statutory Agency that is
12
prescribed by the regulations for the purposes of this
13
paragraph--the Presiding Officers; or
14
(d) if the Agency Head is the Head of a Statutory Agency that is
15
not prescribed by the regulations for the purposes of
16
paragraph (c)--the Agency Minister.
17
(3) The regulations may prescribe circumstances in which the
18
Commissioner:
19
(a) may decline to conduct an inquiry under subsection (1); or
20
(b) may discontinue such an inquiry without making a report
21
under subsection (2).

41B Inquiry into alleged breach of Code of Conduct by APS
23
employee or former APS employee
24
Request for inquiry
25
(1) The Commissioner may, for the purposes of paragraph 41(2)(n),
26
inquire into and determine whether an APS employee, or a former
27
APS employee, in an Agency has breached the Code of Conduct if:
28
(a) the Agency Head or the Prime Minister requests the
29
Commissioner to do so; and
30
(b) the Commissioner considers it would be appropriate to do so.
31
(2) The Prime Minister may make a request under paragraph (1)(a) in
32
relation to an alleged breach of the Code of Conduct of which the
33
Prime Minister has become aware as a result of, or in the course of,
34
a systems review or a special review.

Procedures for inquiry
1
(3) The Commissioner must establish written procedures for inquiring
2
into and determining whether an APS employee, or a former APS
3
employee, in an Agency has breached the Code of Conduct
4
(including by engaging in conduct referred to in subsection
5
15(2A)). The procedures:
6
(a) must comply with basic procedural requirements prescribed
7
by the regulations; and
8
(b) must have due regard to procedural fairness.
9
(4) In addition, and without affecting subsection (3), the procedures
10
may be different for:
11
(a) different categories of APS employees or former APS
12
employees; or
13
(b) APS employees, or former APS employees, who:
14
(i) have been convicted of an offence against a
15
Commonwealth, State or Territory law in respect of
16
conduct that is alleged to constitute a breach of the Code
17
of Conduct; or
18
(ii) have been found to have committed such an offence but
19
no conviction is recorded.
20
(5) The Commissioner must ensure that the procedures established
21
under subsection (3) are made publicly available.
22
(6) Procedures established under subsection (3) are not legislative
23
instruments.
24
Commissioner's powers
25
(7) For the purposes of inquiring into and determining whether an APS
26
employee, or a former APS employee, in an Agency has breached
27
the Code of Conduct, the Commissioner may exercise the same
28
powers as the Agency Head may exercise in determining whether
29
an APS employee, or a former APS employee, in the Agency has
30
breached the Code of Conduct.
31
Report on results of inquiry
32
(8) The Commissioner must report on the results of an inquiry and
33
determination under this section (including an inquiry that is

discontinued) in relation to an APS employee, or a former APS
1
employee, in an Agency to:
2
(a) the Agency Head; and
3
(b) if the Prime Minister requested the inquiry--the Prime
4
Minister.

Recommendation of sanctions
6
(9)
If:
7
(a) the Commissioner finds that an APS employee in an Agency
8
has breached the Code of Conduct; and
9
(b) the Commissioner is requested to recommend sanctions in
10
respect of the breach by:
11
(i) the Agency Head; or
12
(ii) if the Prime Minister requested the inquiry--the Prime
13
Minister;
14
the Commissioner may recommend any of the sanctions referred to
15
in subsection 15(1).

Note:
A sanction referred to in subsection 15(1) would be imposed on the
17
APS employee by the Agency Head, not by the Commissioner.
18
Discontinuation of inquiry
19
(10) The regulations may prescribe circumstances in which the
20
Commissioner may discontinue an inquiry under this section.

41C Systems reviews
22
(1) The Prime Minister may direct the Commissioner to conduct a
23
review (a systems review) of any matter relating to an Agency,
24
including:
25
(a) the management and organisational systems, structures or
26
processes in an Agency; and
27
(b) the functional relationships between 2 or more Agencies.
28
(2) An Agency Minister may request the Prime Minister to make a
29
direction under subsection (1) that relates to an Agency.
30
(3) The Secretary of a Department may request the Prime Minister to
31
make a direction under subsection (1) that relates to the
32
Department or any other Agency in the same portfolio as the
33
Department.

(4) The Commissioner must give a report on the review to:
1
(a) the Prime Minister; and
2
(b) if the review was conducted because of a request by an
3
Agency Minister or a Secretary--the Agency Minister or the
4
Secretary.
5
(5) If a direction under subsection (1) is given in writing, the direction
6
is not a legislative instrument.

41D Special reviews
8
(1) The Prime Minister may direct the Commissioner to conduct a
9
review (a special review) of:
10
(a) any matter relating to an Agency; or
11
(b) the functional relationships between 2 or more Agencies.
12
(2) The Commissioner must give a report on the review to:
13
(a) the Prime Minister; and
14
(b) the Agency Minister of each Agency to which the review
15
relates.
16
(3) If a direction under subsection (1) is given in writing, the direction
17
is not a legislative instrument.

APS Employment Principles
2
(1) The APS is a career-based public service that:
3
(a) makes fair employment decisions with a fair system of
4
review; and
5
(b) recognises that the usual basis for engagement is as an
6
ongoing APS employee; and
7
(c) makes decisions relating to engagement and promotion that
8
are based on merit; and
9
(d) requires effective performance from each employee; and
10
(e) provides flexible, safe and rewarding workplaces where
11
communication, consultation, cooperation and input from
12
employees on matters that affect their workplaces are valued;
13
and
14
(f) provides workplaces that are free from discrimination,
15
patronage and favouritism; and
16
(g) recognises the diversity of the Australian community and
17
fosters diversity in the workplace.

Decisions based on merit
19
(2) For the purposes of paragraph (1)(c), a decision relating to
20
engagement or promotion is based on merit if:
21
(a) all eligible members of the community were given a
22
reasonable opportunity to apply to perform the relevant
23
duties; and
24
(b) an assessment is made of the relative suitability of the
25
candidates to perform the relevant duties, using a competitive
26
selection process; and
27
(c) the assessment is based on the relationship between the
28
candidates' work-related qualities and the work-related
29
qualities genuinely required to perform the relevant duties;
30
and
31
(d) the assessment focuses on the relative capacity of the
32
candidates to achieve outcomes related to the relevant duties;
33
and
34
(e) the assessment is the primary consideration in making the
35
decision.

Commissioner's Directions; and

(a) different categories of APS employees or former APS

(b) APS employees, or former APS employees, who:
13
(i) have been convicted of an offence against a

Commonwealth, State or Territory law in respect of

conduct that is alleged to constitute a breach of the Code
16
of Conduct; or

(ii) have been found to have committed such an offence but
18
no conviction is recorded.

(6) The Commissioner must issue directions in writing for the
20
purposes of paragraph (4)(a).

(b) the Merit Protection Commissioner considers it would be

writing, to the Merit Protection Commissioner doing so.

reviewable under the Administrative Decisions (Judicial Review) Act

(2) The Merit Protection Commissioner must establish written

Conduct (including by engaging in conduct referred to in

25
by the regulations; and

(b) must have due regard to procedural fairness.

determining whether an APS employee, or a former APS
17
employee, in the Agency has breached the Code of Conduct.

Report on results of inquiry
19
(7) The Merit Protection Commissioner must report on the results of
20
an inquiry and determination under this section to the Agency
21
Head who requested the inquiry.

If the Merit Protection Commissioner finds that an APS employee in
23
an Agency has breached the Code of Conduct, the Agency Head may
24
impose a sanction on the APS employee under subsection 15(1).

(3) An entrusted person may make a record of, disclose or otherwise

use protected information for the purposes of, or in connection

with:

(a) the performance of the entrusted person's functions or duties,
5
or the exercise of the entrusted person's powers, under this
6
Act or the regulations; or
7
(b) the performance of the functions, or the exercise of the
8
powers, of the Commissioner under this Act or the
9
regulations.

Authorised disclosure of protected information by the
11
Commissioner
12
(4) The Commissioner may disclose protected information in a report
13
prepared for purposes connected with the performance of the
14
functions, or the exercise of the powers, of the Commissioner
15
under this Act or the regulations, if the Commissioner is satisfied
16
that the disclosure is necessary for the purpose of setting out the
17
grounds for the conclusions and recommendations contained in the
18
report.
19
(5) Subject to subsection (6), the Commissioner may disclose
20
protected information to a person, or to the public or a section of
21
the public, if the Commissioner is satisfied that:
22
(a)
the
disclosure:
23
(i) is in the interests of an Agency or a person; or
24
(ii) is in the public interest; and
25
(b) the disclosure is not likely to interfere with a review or
26
inquiry under this Act or the regulations.
27
(6) The Commissioner must not disclose the name of an individual, or
28
any other material that would enable an individual to be identified,
29

Prohibition on disclosure or other use of protected information

(2) Except as authorised by this section or the regulations, a person
4
who is, or was, an entrusted person must not, directly or indirectly,
5
make a record of, disclose or otherwise use protected information.

Note:
Section 70 of the Crimes Act 1914 creates offences in relation to the
7
disclosure of information by Commonwealth officers.

Authorised disclosure or other use of protected information
9
(3) An entrusted person may make a record of, disclose or otherwise
10
use protected information for the purposes of, or in connection
11
with:
12
(a) the performance of the entrusted person's functions or duties,
13
or the exercise of the entrusted person's powers, under this
14
Act or the regulations; or
15
(b) the performance of the functions, or the exercise of the
16
powers, of the Merit Protection Commissioner under this Act
17
or the regulations.

Authorised disclosure of protected information by the Merit
19
Protection Commissioner
20
(4) The Merit Protection Commissioner may disclose protected
21
information in a report prepared for purposes connected with the
22
performance of the functions, or the exercise of the powers, of the
23
Merit Protection Commissioner under this Act or the regulations, if
24
the Merit Protection Commissioner is satisfied that the disclosure
25
is necessary for the purpose of setting out the grounds for the
26
conclusions and recommendations contained in the report.
27
(5) Subject to subsection (6), the Merit Protection Commissioner may
28
disclose protected information to a person, or to the public or a
29
section of the public, if the Merit Protection Commissioner is
30
satisfied that:
31
(a)
the
disclosure:
32
(i) is in the interests of an Agency or a person; or
33
(ii) is in the public interest; and

(b) the disclosure is not likely to interfere with a review or

inquiry under this Act or the regulations.

(6) The Merit Protection Commissioner must not disclose the name of

an individual, or any other material that would enable an individual
4
to be identified, in protected information that is disclosed under
5
subsection (5), unless the Merit Protection Commissioner is
6
satisfied that the disclosure is fair and reasonable in all the
7
circumstances.

competent, and cannot be compelled, to disclose protected

information in any proceeding:

(a) before a court (whether exercising federal jurisdiction or

not); or

(b) before a person authorised by a law of the Commonwealth or
31
a State or Territory, or by consent of the parties, to hear,
32
receive and examine evidence.

(4) The person is not liable to any penalty under the provisions of any

other law by reason of his or her giving the information or

producing the document to the Commissioner.

(5) To the extent that the giving of the information or the production of

(1)
This item applies to a person who, immediately before the

The person continues to hold office as the Secretary of the Department

as if the person had, at the commencement time, been appointed as the

Secretary of the Department by the Governor-General, on the

recommendation of the Prime Minister, under subsection 58(1) of the

new Public Service Act.

(3)
The person continues to hold office as the Secretary of the Department:
12
(a) for the balance of the period of the person's appointment that
13
remained immediately before the commencement time; and
14
(b) on the same terms and conditions as applied to the person
15
immediately before the commencement time.

(4)
Subsections 58(3) and (6) to (8) of the new Public Service Act do not
17
apply to the person.

(5)
To avoid doubt, section 57 of the new Public Service Act applies to the
19
person.

4 Appointments of Secretaries proposed before

commencement time

(1) If:
23
(a) before the commencement time, the Prime Minister had

received a report about a vacancy in the office of the

Secretary of the Prime Minister's Department under

subsection 58(2) of the old Public Service Act; and

(b) immediately before the commencement time, no appointment

to fill that vacancy had been made under subsection 58(1) of
29
the old Public Service Act;

then, after the commencement time, the report is taken to have been

received by the Prime Minister under subsection 58(6) of the new

Public Service Act.

Department under subsection 59(2) of the old Public Service

(b) the appointment had not been terminated before that time;

then, after that time, the report is taken to have been received by the

If the APS employee is found to have breached the Code of Conduct,

the Agency Head must determine the sanction (if any) to be imposed on
8
the APS employee in accordance with the procedures established under
9
paragraph 15(3)(b) of the new Public Service Act. For that purpose, a

reference to the Code of Conduct in those procedures is to be read as a
11
reference to the old Code of Conduct.

23 Finding by Agency Head of breach of Code of Conduct but

(1)
This item applies if, before the commencement time, an Agency Head

had found that an APS employee in the Agency had breached the Code

of Conduct, but no sanction had been imposed.

The Agency Head must determine the sanction (if any) to be imposed

on the APS employee in accordance with the procedures established
19
under paragraph 15(3)(b) of the new Public Service Act. For that
20
purpose, a reference to the Code of Conduct in those procedures is to be

read as a reference to the old Code of Conduct.

32 Non-ongoing APS employees become temporary APS

employees at commencement time

(1)
This item applies to a person if:
4
(a) the person had been engaged as a non-ongoing APS
5
employee under paragraph 22(2)(b) or (c) of the old Public
6
Service Act; and
7
(b) the engagement was in effect immediately before the
8
commencement time; and
9
(c) the engagement was to continue to have effect after the
10
commencement time.
11
(2)
The person becomes a temporary APS employee at the commencement
12
time as if the person had been engaged under paragraph 22(2)(b) of the
13
new Public Service Act on the same terms and conditions (including the
14
period (if any) of the person's engagement) as applied to the person
15
immediately before the commencement time.

33 Engagement processes in progress before
17
commencement time
18
(1) If:
19
(a) before the commencement time, an Agency Head had
20
engaged a person as a non-ongoing APS employee for the
21
purposes of the Agency under paragraph 22(2)(b) or (c) of
22
the old Public Service Act; and
23
(b) the engagement was to take effect after the commencement
24
time;
25
the engagement takes effect as if the Agency Head had engaged the
26
person as a temporary APS employee for the purposes of the Agency
27
under paragraph 22(2)(b) of the new Public Service Act on the same
28
terms and conditions as would have applied to the person if the person
29
had been engaged as a non-ongoing APS employee for the purposes of
30
the Agency under paragraph 22(2)(b) or (c) of the old Public Service
31
Act.

(2) If:
33
(a) before the commencement time, a process had begun to
34
engage a person as a non-ongoing APS employee for the
35

purposes of an Agency under paragraph 22(2)(b) or (c) of the

old Public Service Act; and
2
(b) the process was in progress immediately before that time;

process to engage a person as a temporary APS employee for the
5
purposes of the Agency under paragraph 22(2)(b) of the new Public
6
Service Act.

34 Saving--circumstances for engagement of non-ongoing
8
APS employees
9
(1)
This item applies in relation to a person who:
10
(a) becomes a temporary APS employee because of item 32 of
11
this Schedule; or
12
(b) is engaged as a temporary APS employee because of subitem
13
33(1) of this Schedule.
14
(2)
Despite the repeal of subsection 22(4) of the old Public Service Act by
15
item 61 of Schedule 1 to this Act, that subsection (and the regulations in
16
force for the purposes of that subsection) continue to apply, at and after
17
the commencement time, in relation to the person's engagement.
18
(3)
Paragraphs 22(4)(a) and (b) of the new Public Service Act (and the
19
regulations in force for the purposes of those paragraphs) do not apply
20
in relation to the person's engagement.
21
(4)
Paragraph 22(4)(c) of the new Public Service Act (and the regulations
22
in force for the purposes of that paragraph) apply in relation to the
23
person's engagement.
24
(5)
If the person is a person who becomes a temporary APS employee
25
because of item 32 of this Schedule, then, for the purpose of applying
26
regulations in force for the purposes of paragraph 22(4)(c) of the new
27
Public Service Act in relation to the person's engagement, the period of
28
the person's engagement as a temporary APS employee is taken to
29
include the period of the person's engagement as a non-ongoing APS
30
employee referred to in that item.

35 Termination of employment of non-ongoing APS

employee in progress before commencement time
33
(1)
This item applies if:

(a) before the commencement time, an Agency Head had

terminated the employment of a non-ongoing APS employee
2
in the Agency under subsection 29(1) of the old Public

(b) the termination was to take effect after the commencement

time.

(2)
Despite the amendments made by items 62 and 63 of Schedule 1 to this
7
Act, the old Public Service Act (and the regulations in force for the
8
purposes of that Act) continue to apply, at and after the commencement
9
time, in relation to the termination.

36 Procedures for termination of temporary APS employees
11
after commencement time
12
(1)
The procedures prescribed in regulations (the termination regulations)
13
in force for the purposes of subsection 29(4) of the old Public Service
14
Act apply to the termination of the employment of a temporary APS
15
employee after the commencement time.
16
(2)
For the purposes of subitem (1), a reference in the termination
17
regulations to a non-ongoing APS employee is to be read as a reference
18
to a temporary APS employee.
19
(3)
This item ceases to have effect on the commencement of
20
Commissioner's Directions issued for the purposes of paragraph
21
11A(1)(f) of the new Public Service Act.

the old Public Service Act; and

(b) the resignation took effect not earlier than 6 months before

the closing date for nominations; and
20
(c) the person was a candidate in the election but failed to be
21
elected.

(2)
The person is entitled to be again engaged as an APS employee, in
23
accordance with regulations in force for the purposes of subsection
24
32(2) of the old Public Service Act and within the time limits prescribed
25
by those regulations.

46 Saving--Commissioner's Directions on SES matters
27
Despite the repeal of section 36 of the old Public Service Act by item 84
28
of Schedule 1 to this Act, Commissioner's Directions in force for the
29
purposes of that section continue in force at and after the
30
commencement time as if they were Commissioner's Directions about
31
employment matters relating to SES employees issued for the purposes
32
of paragraphs 11A(1)(a), (b), (c), (d) and (f) of the new Public Service
33
Act.
