The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Quarantine Charges (Imposition--
5
Customs) Amendment Act 2014.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Note:
This item amends the short title of the Act. If another amendment of the Act is

described by reference to the Act's previous short title, that other amendment has effect
10
after the commencement of this item as an amendment of the Act under its amended
11
short title (see section 10 of the Acts Interpretation Act 1901).

Repeal the section, substitute:

5 Extraterritorial application
15
This Act extends to acts, omissions, matters and things outside:
16
(a) Australia and any external Territory to which a provision of
17
this Act extends; and
18
(b) the airspace over an area covered by paragraph (a); and
19
(c) the coastal sea (as defined in subsection 15B(4) of the Acts
20
Interpretation Act 1901) of Australia and of any external
21
Territory to which a provision of this Act extends.

Note:
Under section 4:
23
(a) all provisions of this Act extend to the Territory of Christmas
24
Island and the Territory of Cocos (Keeling) Islands; and
25
(b) a regulation may extend any or all provisions of this Act to one
26
or more other external Territories.

7 Imposition of charges

(1) A regulation may prescribe a charge in relation to a prescribed
2
matter connected with the administration of the Biosecurity Act
3
2014.

(2) The charges prescribed under subsection (1) are imposed as taxes.
5
(3) Two or more charges may be prescribed in relation to the same
6
matter, and a single charge may be prescribed in relation to 2 or
7
more matters.
8
(4) This section imposes a charge only so far as that charge is a duty of
9
customs within the meaning of section 55 of the Constitution.
