The Parliament of Australia enacts:

1 Short title

This Act is the
Royal Commissions Amendment (Confidentiality

Protections) Act 2020
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Act (which deals with certain information given to the

Disability Royal Commission) applies;

2 Application provision

The amendments of section 7 of the
Freedom of Information Act 1982

made by this Schedule apply in relation to the following:

(a) a request for access, made under section 15 of that Act, that
12
is received on or after the commencement of this item;
13
(b) an application, made under section 48 of that Act, that is
14
received on or after the commencement of this item.

Disability Royal Commission
means the Royal Commission into

Violence, Abuse, Neglect and Exploitation of People with
20
Disability issued by the Governor-General by Letters Patent on
21
4 April 2019 (and including any later variations of those Letters
22
Patent).

6OO Protection of certain information given to the Disability Royal

Commission

(1) This section applies to information if:

(a) the information was given by, or on behalf of, a natural

person to the Disability Royal Commission other than for the
2
purposes of a private session; and
3
(b) the information identifies the natural person who gave the
4
information, or on whose behalf the information was given;
5
and
6
(c) the Commission indicated that the information, if given,
7
would be treated as confidential; and
8
(d) the information was treated as confidential by the
9
Commission.

(2) Section 6OE applies in relation to the information as if it were a
11
statement or disclosure made by the natural person at a private
12
session for the Commission.

(3) Sections 6OH, 6OK and 6OL apply in relation to the information
14
as if it were information given by the natural person at a private
15
session for the Commission.
16
(4) Section 6OM applies in relation to the information as if it were a
17
record that contains information obtained at a private session for
18
the Commission.
