The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Renewable Energy (Electricity)
5
(Small-scale Technology Shortfall Charge) Act 2010.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

the Renewable Energy (Electricity)
Amendment Act 2010 commences.

3 Definitions

An expression used in this Act and in the Renewable Energy
9
(Electricity) Act 2000 has the same meaning in this Act as it has in
10
that Act.

4 Act to bind Crown
12
This Act binds the Crown in right of each of the States, of the
13
Australian Capital Territory, of the Northern Territory and of
14
Norfolk Island. However, it does not bind the Crown in right of the
15
Commonwealth.

5 Imposition
17
The small-scale technology shortfall charge that is payable under
18
the Renewable Energy (Electricity) Act 2000 is imposed by this
19
section.

6 Rate of charge

The
rate of charge is $65 per MWh.

7 Act does not impose a tax on property of a State

(1) This Act does not impose a tax on property of any kind belonging

to a State.

(2) In this section:

property of any kind belonging to a State has the same meaning as
7
in section 114 of the Constitution.
