The Parliament of Australia enacts:

1  Short title 

6 

 

  This Act is the Superannuation (Objective) Act 2016. 

7 

2  Commencement 

8 

 

(1)  Each provision of this Act specified in column 1 of the table 

9 

commences, or is taken to have commenced, in accordance with 

10

3  Simplified outline of this Act 

10 

For every Bill or regulation relating to superannuation, there must 

11 

be a statement of its compatibility with the primary objective of the 

12 

superannuation system and the subsidiary objectives of the 

13 

superannuation system.

4  Definitions 

15 

 

  In this Act: 

16 

primary objective of the superannuation system has the meaning 

17 

given by subsection 5(1). 

18 

rule-maker has the same meaning as in the Legislation Act 2003. 

19 

subsidiary objectives of the superannuation system has the 

20 

meaning given by subsection 5(2).

5  The objectives of the superannuation system 

1 

 

(1)  The primary objective of the superannuation system is to provide 

2 

income in retirement to substitute or supplement the age pension. 

3 

 

(2)  The subsidiary objectives of the superannuation system are the 

4 

matters prescribed by the regulations. 

5 

 

(3)  To avoid doubt, this section does not affect the meaning of any law 

6 

of the Commonwealth (other than this Act or the regulations).

6  Statements of compatibility--Bills relating to superannuation 

8 

 

(1)  A member of Parliament who proposes to introduce a Bill for an 

9 

Act into a House of the Parliament must, if the Bill relates to 

10 

superannuation, cause a statement of compatibility to be prepared 

11 

in respect of the Bill. 

12 

 

(2)  A member of Parliament who introduces a Bill for an Act into a 

13 

House of the Parliament, or another member acting on his or her 

14 

behalf, must, if the Bill relates to superannuation, cause the 

15 

statement of compatibility prepared under subsection (1) to be 

16 

presented to the House. 

17 

 

(3)  A statement of compatibility must include an assessment of 

18 

whether the Bill is compatible with: 

19 

 

(a)  the primary objective of the superannuation system; and 

20 

 

(b)  the subsidiary objectives of the superannuation system. 

21 

 

(4)  A statement of compatibility prepared under subsection (1) is not 

22 

binding on any court or tribunal. 

23 

 

(5)  A failure to comply with this section in relation to a Bill that 

24 

becomes an Act does not affect the validity, operation or 

25 

enforcement of the Act or any other provision of a law of the 

26 

Commonwealth. 

27 

 

(6)  This section does not apply to a Bill to the extent that it amends or 

28 

repeals, or relates to an amendment or repeal of, an Act prescribed 

29 

by regulations made for the purposes of this subsection.

7  Statements of compatibility--regulations relating to

superannuation

(1)  The rule-maker for a regulation made under an Act must, if the 

3 

regulation relates to superannuation, cause a statement of 

4 

compatibility to be prepared in respect of the regulation. 

5 

Note: 

The statement of compatibility must be included in the explanatory 

6 

statement relating to the regulation (see section 15J of the Legislation 

7 

Act 2003). 

8 

 

(2)  A statement of compatibility must include an assessment of 

9 

whether the regulation is compatible with: 

10 

 

(a)  the primary objective of the superannuation system; and 

11 

 

(b)  the subsidiary objectives of the superannuation system. 

12 

 

(3)  A statement of compatibility prepared under subsection (1) is not 

13 

binding on any court or tribunal. 

14 

 

(4)  A failure to comply with this section in relation to a regulation 

15 

does not affect the validity, operation or enforcement of the 

16 

regulation or any other provision of a law of the Commonwealth. 

17 

 

(5)  This section does not apply to a regulation to the extent that it 

18 

amends or repeals, or relates to an amendment or repeal of, a 

19 

regulation made under an Act prescribed by regulations made for 

20 

the purposes of this subsection.

8  Regulations 

22 

 

  The Governor-General may make regulations prescribing matters: 

23 

 

(a)  required or permitted by this Act to be prescribed by the 

24 

regulations; or 

25 

 

(b)  necessary or convenient to be prescribed for carrying out or 

26 

giving effect to this Act.
