The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Special Broadcasting Service
5
Amendment (Natural Program Breaks and Disruptive Advertising)
6
Act 2012.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or
8
repealed as set out in the applicable items in the Schedule
9
concerned, and any other item in a Schedule to this Act has effect
10
according to its terms.

4 Objects
12
The objects of this Act are to:
13
(a)
define
natural program break in consideration of the
14
examples given to the Parliament in 1991; and
15
(b) wind down the number of in-program breaks while providing
16
an option for the SBS to replace in-program advertising with
17
intra-program advertising, while having regard to the
18
financial position of SBS; and
19
(c) in the longer term, limit in-program breaks to live or delayed
20
broadcasts of sports events on SBS television.

Insert:

natural program break means a break in a program in which:
7
(a) the positioning of the break during the program is as intended
8
by the maker of the program; and
9
(b) the audience does not miss any significant element that
10
relates directly to the content of the program; and
11
(c) the sole purpose is to place non-program material, such as
12
advertisements, sponsorship announcements and program
13
promotions, products and services.

Insert:

45A Limit on advertisements etc. during natural program breaks
7
for certain television programs
8
(1) There must be no more than one natural program break within an
9
individual television program in which advertisements or other
10
non-program material is broadcast.
11
(2) Subsection (1) does not apply to television programs that consist of
12
the live or delayed broadcast of sporting events.

45B Optional temporary cessation of in-program advertising
14
(1) This section does not apply to television programs that consist of
15
the live or delayed broadcast of sporting events.
16
(2) During the period of 8 hours commencing at 6.00 pm each day, the
17
SBS may choose not to broadcast advertisements during natural
18
program breaks in television programs screened during that period.
19
(3) If the SBS chooses not to broadcast advertisements in accordance
20
with subsection (2), there is payable to the SBS such money as is
21
calculated in accordance with the regulations.
22
(4) Payments under subsection (3) are to be made from money
23
appropriated by the Parliament for the purposes of that subsection.

Repeal the sections, substitute:

45A No in-program breaks for certain television programs
7
(1) An individual television program must be broadcast without
8
interruption for program breaks.
9
(2) Subsection (1) does not apply to television programs that consist of
10
the live or delayed broadcast of sporting events.
