The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Stop Dumping on the Great Barrier
5
Reef Act 2014.

2 Commencement
7
This Act commences on the day after this Act receives the Royal
8
Assent.

Great Barrier Reef World Heritage Area has the meaning given
7
by the Great Barrier Reef Marine Park Act 1975.

10AA Dumping of dredged material into the Great Barrier Reef

World Heritage Area

Offence
13
(1) A person commits an offence if:
14
(a) the person dumps dredged material into any part of the sea;
15
and
16
(b) the part is in the Great Barrier Reef World Heritage Area.
17
Penalty: 250 penalty units or imprisonment for 12 months, or
18
both.

(2) Strict liability applies to paragraph (1)(b).

For strict liability, see section 6.1 of the Criminal Code.

Other laws

(3) Despite anything in this Act, the Environment Protection and
23
Biodiversity Conservation Act 1999 or the Great Barrier Reef
24
Marine Park Act 1975, dumping dredged material into the Great
25
Barrier Reef World Heritage Area is not, and must not be,
26
approved or permitted under those Acts (including regulations
27
made under those Acts).

(4) The following provisions of this Act do not apply in relation to

dumping dredged material into the Great Barrier Reef World
2
Heritage Area:

(a) section 5 (about controlled material related to the exploration,
4
exploitation and processing of seabed mineral resources);
5
(b) section 9 (about declared coastal waters of States);
6
(c) subsection 15(1) and sections 18 to 25 (about permits).

(5) The other provisions of this Act apply:
8
(a) to dredged material that is, or is to be, dumped into the Great
9
Barrier Reef World Heritage Area in the same way as the
10
provisions apply to controlled material that is, or is to be,
11
dumped into Australian waters; and
12
(b) in relation to an offence against subsection (1) of this section
13
in the same way as the provisions apply in relation to an
14
offence against section 10A.

3 After section 10C

Insert:

10CA Loading for the purpose of dumping dredged material into
18
the Great Barrier Reef World Heritage Area
19
(1) A person commits an offence if:
20
(a) the person loads dredged material on a vessel or platform in
21
Australia or Australian waters; and
22
(b) the person:
23
(i) knows that the material will be dumped into the Great
24
Barrier Reef World Heritage Area; or
25
(ii) is reckless as to whether the material will be dumped
26
into the Great Barrier Reef World Heritage Area.

Penalty: 250 penalty units or imprisonment for 12 months, or
28
both.

Other laws

(2) Despite anything in this Act, the Environment Protection and
31
Biodiversity Conservation Act 1999 or the Great Barrier Reef

Marine Park Act 1975, loading dredged material on a vessel or
33
platform is not, and must not be, approved or permitted under those

Acts (including regulations made under those Acts), if the material
1
will be dumped into the Great Barrier Reef World Heritage Area.

(3) The following provisions of this Act do not apply in relation to
3
loading dredged material on a vessel or platform for dumping into
4
the Great Barrier Reef World Heritage Area:
5
(a) section 5 (about controlled material related to the exploration,
6
exploitation and processing of seabed mineral resources);
7
(b) section 9 (about declared coastal waters of States);
8
(c) subsection 15(2) and sections 18 to 25 (about permits).

(4) The other provisions of this Act apply:
10
(a) to dredged material that is loaded on a vessel or platform and
11
will be dumped into the Great Barrier Reef World Heritage
12
Area in the same way as the provisions apply to controlled
13
material that is loaded on a vessel or platform and will be
14
dumped into Australian waters; and
15
(b) in relation to an offence against subsection (1) of this section
16
in the same way as the provisions apply in relation to an
17
offence against section 10C.

4 Application of amendments
19
The amendments made by this Schedule do not apply in relation to
20
dumping or loading if an approval or permission for the dumping or
21
loading was granted on or before 9 December 2013 under the
22
Environment Protection and Biodiversity Conservation Act 1999, the
23
Environment Protection (Sea Dumping) Act 1981 or the Great Barrier
24
Reef Marine Park Act 1975 (including regulations made under those
25
Acts).
