The Parliament of Australia enacts:

1 Short title
10
This Act may be cited as the Save Our Solar (Solar Rebate
11
Protection) Bill 2008.

2 Commence ment
13
This Act commences on the day on which it receives the Royal
14
Assent.

3 Objects of Act
16
The objects of this Act are to improve the operation of the Solar
17
Homes and Communities Plan by:
18
(a) requiring that guidelines on the operation of the plan are:
19
(i) tabled in each house of Parliament, and
20
(ii) subject to disallowance;
21
(b)
establishing in legislation the general responsibility of the
22
Secretary for the administration of the plan; and
23
(c) establishing in legislation principles of administration to be
24
observed in the operation of the plan.

4 Inte rpretation

In this Act, unless the contrary intention appears:

installation includes the acquisition of a solar system as well as its

installation.

solar systems means solar photovoltaic systems.

the Minister means the Minister for Environment, Heritage and the
4
Arts.

the plan means the plan, known at the time of commencement of
6
this Act as the Solar Homes and Communities Plan, under which
7
rebates are payable in respect of the installation of solar systems.
8
the Secretary means the Secretary, Department of the
9
Environment, Water, Heritage and the Arts.

5 Guidelines for the scheme

(1) As soon as practicable after the commencement of this Act the
12
Minister must, by instrument in writing, determine new guidelines
13
for the operation of the plan.
14
(2) Guidelines determined under subsection (1) must contain details
15
on:
16
(a) the eligibility requirements to be satisfied by a person or an
17
organisation in order to receive a payment under the plan;
18
and
19
(b) the types of solar systems to which the plan will apply.
20
(3) An instrument determining guidelines under subsection (1) is a
21
legislative instrument for the purposes of the Legislative
22
Instruments Act 2003.

6 Responsibility of Minister

The Minister is to have general responsibility for the operation of
25
the plan and, in particular for:
26
(a) determining guidelines as required by section (5), and
27
(b) in the event of disallowance of guidelines, determining
28
replacement guidelines so as to ensure that there is no time
29
when the plan is not in operation.

7 Secretary to have responsibility for administration of plan

The Secretary is to have general responsibility for the
2
administration of the plan.

8 Payment not to be made unless in accordance with guidelines
4
A payment must not be made in relation to the installation of a
5
solar system unless the requirements of the guidelines made under
6
section 5 have been satisfied in respect of the installation.

9 Principles of administration

In administrating this Act, the Secretary is to have regard to the
9
necessity of ensuring that:
10
(a) payments for the purposes of the plan are made only in accordance
11
with guidelines determined under section 5;
12
(b) information about the operation of the plan is made available to
13
members of the public, including those involved in the supply of
14
solar systems; and
15
(c) procedures and practices established under or for the purposes of
16
this Act and for the operation of the plan help to minimise abuses
17
of the plan.

10 Regulations
19
The Governor-General may make regulations prescribing matters:
20
(a)
required or permitted by this Act to be prescribed; or
21
(b)
necessary or convenient to be prescribed for carrying out or giving
22
effect to this Act.
