2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

Omit "The", substitute "Subject to subsection (3), the".

2 At the end of section 61A

Add:

(3) The Secretary may not make the deductions requested by the
8
person if the deductions relate to goods hired under a consumer
9
lease entered into by the person where:
10
(a) the goods are hired wholly or predominantly for personal,
11
domestic or household purposes; and
12
(b) a charge is or may be made for hiring the goods and the
13
charge together with any other amount payable under the
14
consumer lease exceeds the cash price of the goods; and
15
(c) the lessor hires the goods in the course of a business of hiring
16
goods carried on in this jurisdiction or as part of or
17
incidentally to any other business of the lessor carried on in
18
this jurisdiction.

3 Subclause 1(1) of Schedule 1

Insert:

consumer lease
means a contract for the hire of goods by a natural
22
person or strata corporation under which that person or corporation
23
does not have a right or obligation to purchase the goods.

4 Application of amendments
25
Despite the amendments made by this Schedule, section 61A of the
26
Social Security (Administration) Act 1999
, as in force immediately
27
before this item commences, continues in force in relation to a request
28
made by a person to the Secretary relating to goods hired by the person
29
under a consumer lease prior to the commencement of this item.
