1 Short title

This Act may be cited as the Social Services and Other Legislation
7
Amendment (Seniors Health Card and Other Measures) Act 2014.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

(1) This section applies to the dollar amount mentioned in column 3 of
10
item 1, 2, 3 or 4 of the table in point 118ZZA-11.

(2) That dollar amount, for an indexation day on which the indexation
12
factor is greater than 1, is replaced by the amount that is worked
13
out using the following formula:

dollar (rounding up in the case of 50 cents).

322A Dismissal of application for review by SSAT
3
(1) The Principal Member may, on the request of a party or on his or
4
her own initiative, dismiss an application for review of a decision
5
if:
6
(a) the decision is not reviewable under this Division; or
7
(b) the application is frivolous or vexatious; or
8
(c) all of the parties consent; or
9
(d) the Principal Member is satisfied:
10
(i) after having communicated with each party; or
11
(ii) after having made reasonable attempts to communicate
12
with each party and having failed to do so;
13
or a combination of both, that none of the parties intends to
14
proceed with the application; or
15
(e) all of the parties fail to attend the hearing.
16
(2) The Principal Member may dismiss an application under
17
paragraph (1)(b) only if:
18
(a) one of the following applies:
19
(i) the Principal Member has received and considered
20
submissions from the applicant for review;
21
(ii) the Principal Member has otherwise communicated with
22
the applicant in relation to the grounds of the
23
application;
24
(iii) the Principal Member has made reasonable attempts to
25
communicate with the applicant in relation to the
26
grounds of the application and has failed to do so; and
27
(b) all of the parties (other than the applicant) consent to the
28
dismissal.
29
(3) If the Principal Member dismisses an application under
30
subsection (1) (other than under paragraph (1)(b)), a party to the
31
review may:
32
(a) within 28 days after receiving notification that the application
33
has been dismissed; or

(b) within such longer period as the Principal Member, in special
1
circumstances, allows;

request that the Principal Member reinstate the application.

(4) If the Principal Member considers it appropriate to do so, he or she

may reinstate the application and give such directions as he or she
5
considers appropriate in the circumstances.

(5) If it appears to the Principal Member that an application has been
7
dismissed under subsection (1) in error, he or she may, on the
8
request of a party to the review or on his or her own initiative,
9
reinstate the application and give such directions as he or she
10
considers appropriate in the circumstances.

322B Applicant for review may discontinue or withdraw application
12
(1) An applicant for review may notify the Social Security Appeals
13
Tribunal at any time that the application for review is discontinued
14
or withdrawn.
15
(2) If the applicant orally notifies the Social Security Appeals
16
Tribunal, the person who receives the notification must make a
17
written record of the day on which the notification was given.
18
(3) If notification is given under subsection (1), the Principal Member
19
is taken to have dismissed the application.
20
(4) If the Principal Member dismisses an application under
21
subsection (3), the applicant may:
22
(a) within 28 days after receiving notification that the application
23
has been dismissed; or
24
(b) within such longer period as the Principal Member, in special
25
circumstances, allows;
26
request that the Principal Member reinstate the application.
27
(5) If the Principal Member considers it appropriate to do so, he or she
28
may reinstate the application and give such directions as he or she
29
considers appropriate in the circumstances.

322C Notification of decisions
1
Social Security Appeals Tribunal affirms decisions
2
(1) If the Social Security Appeals Tribunal makes a decision on a
3
review and the decision is of a kind mentioned in
4
paragraph 316(1)(a), the Tribunal must:
5
(a) prepare a written statement (the initial statement) that sets
6
out the decision of the Tribunal on the review; and
7
(b) give each party to the review a copy of the initial statement
8
within 14 days after making the decision; and
9
(c) within 14 days after making the decision, either:
10
(i) give reasons for the decision orally to each party to the
11
review and explain that the party may make a written
12
request for a statement under subparagraph (ii) within
13
14 days after the copy of the initial statement is given to
14
the party; or
15
(ii) give each party to the review a written statement
16
(whether or not as part of the initial statement) that sets
17
out the reasons for the decision, sets out the findings on
18
any material questions of fact and refers to evidence or
19
other material on which the findings of fact are based;
20
and
21
(d) return to the Secretary any document that the Secretary has
22
provided to the Tribunal in connection with the review; and
23
(e) give the Secretary a copy of any other document that contains
24
evidence or material on which the findings of fact are based.
25
(2) If the Social Security Appeals Tribunal does not give a written
26
statement to a party under subparagraph (1)(c)(ii), the party may,
27
within 14 days after the copy of the initial statement is given to the
28
party, make a written request of the Tribunal for such a statement.
29
(3) The Social Security Appeals Tribunal must comply with a request
30
under subsection (2) within 14 days after the day on which it
31
receives the request.

(4) If the Social Security Appeals Tribunal makes a decision on a

(5) After the Social Security Appeals Tribunal determines a review,
21
the Principal Member must give each party to the review (except
22
the Secretary) a written notice stating that, if the party is
23
dissatisfied with the Tribunal's decision, application may, subject
24
to the Administrative Appeals Tribunal Act 1975, be made to the
25
Administrative Appeals Tribunal for review of the decision.
26
(6) A failure to comply with subsection (5) in relation to a decision of
27
the Social Security Appeals Tribunal does not affect the validity of
28
the decision.
