The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Social Security and Other Legislation
6
Amendment (Economic Security Strategy) Act 2008.
7
2 Commence ment

This Act commences on the day on which it receives the Royal
9
Assent.

900 Qualification for economic security strategy payment

Qualified if this section applies
12
(1) A person is qualified for an economic security strategy payment if
13
subsection (2), (3) or (4) applies to the person.
14
Receipt of certain payments
15
(2) This subsection applies to a person if:
16
(a) the person was receiving one of the following payments in
17
respect of 14 October 2008:
18
(i) an age pension;
19
(ii) a disability support pension;
20
(iii) a wife pension;
21
(iv) a carer payment;
22
(v) a bereavement allowance;
23
(vi) a widow B pension;
24
(vii) a widow allowance;
25
(viii) partner allowance;
26
(ix) carer allowance; and
27
(b) except in the case of carer allowance, the person was
28
receiving that payment because of a claim the person made
29
on or before 14 October 2008.

Pension age and receipt of other payments
1
(3) This subsection applies to a person if:
2
(a) the person reached pension age on or before 14 October
3
2008; and
4
(b) the person was receiving one of the following payments in
5
respect of 14 October 2008:
6
(i) a parenting payment;
7
(ii) austudy payment;
8
(iii) special benefit;
9
(iv) a payment under the ABSTUDY Scheme that includes
10
an amount identified as living allowance; and
11
(c) the person was receiving that payment because of a claim the
12
person made on or before 14 October 2008.

Qualified for seniors health card
15
(4) This subsection applies to a person if:
16
(a) on or before 14 October 2008, the person made a claim for a
17
seniors health card under Division 1 of Part 3 of the
18
Administration Act and had not withdrawn that claim on or
19
before 14 October 2008; and
20
(b) on 14 October 2008, the person was qualified for the card.
21
One payment under this section only
22
(5) A person cannot receive more than one payment under this section,
23
regardless of how many times the person qualifies under this
24
section.
25
(6) Despite anything else in this section, a person who is eligible for a
26
payment under section 118ZZQ of the Veterans' Entitlements Act
27
is not qualified for a payment under this section unless the person
28
is so qualified because he or she was receiving carer allowance in
29
respect of 14 October 2008.

901 Amount of economic security strategy payment--gene ral
31
(1) The amount of a person's economic security strategy payment
32
under this Part is the amount, specified in column 3 of the
33
following table, that corresponds to the family situation, specified
34

in column 2 of the table, that applied to the person on 14 October
1

(2) However, this section does not apply to a person if he or she is
7
qualified under section 900 for an economic security strategy
8
payment because he or she was receiving carer allowance in
9
respect of 14 October 2008.

902 Amount of economic security strategy payment--person
11
receiving care r allowance
12
(1) If a person:
13
(a) is qualified under section 900 for an economic security
14
strategy payment because he or she was receiving carer
15
allowance in respect of 14 October 2008; and
16
(b) would not be so qualified if he or she had not been receiving
17
carer allowance in respect of 14 October 2008;
18
the amount of the person's economic security strategy payment
19
under this Part is the amount worked out under subsection (3) for
20
the person's carer allowance.
21
(2) If a person:
22
(a) is qualified under section 900 for an economic security
23
strategy payment because he or she was receiving carer
24
allowance in respect of 14 October 2008; and
25
(b) would be so qualified even if he or she had not been
26
receiving carer allowance in respect of 14 October 2008;

the amount of the person's economic security strategy payment

under this Part is the sum of the amount worked out under
2
subsection (3) for the person's carer allowance and the amount that
3
would have been worked out under section 901 for the person if
4
subsection 901(2) had not applied.
5
(3) Subject to subsection (4), the amount for a person's carer
6
allowance is worked out by adding together the amount applicable
7
under this section for each person (care receiver) whose care
8
qualified the person for carer allowance in respect of 14 October
9
2008.
10
(4) If subsection 953(2) applied in relation to the carer allowance in
11
respect of 14 October 2008, the 2 disabled children whose care
12
qualified the person for carer allowance in respect of 14 October
13
2008 are to be treated as if they were a single care receiver in
14
relation to the person qualified for the economic security strategy
15
payment.
16
(5) Subject to subsection (6), the amount applicable for a care receiver
17
is $1,000.
18
(6) If the rate at which carer allowance in respect of 14 October 2008
19
was paid took account of a determination under subsection 981(1)
20
of a particular share (being a percentage or proportion) in relation
21
to a care receiver, the amount applicable for the care receiver is
22
that share of $1,000.
23
2 Certain claims that would otherwise be taken to have been
24
made on or before 14 October 2008
25
For the purposes of the provisions inserted by item 1, the following are
26
to be disregarded:
27
(a) the effect of section 12 of the Social Security
28
(Administration) Act 1999, so far as it relates to a
29
determination under that section that is made after
30
14 October 2008;
31
(b) the effect of section 15 of the Social Security
32
(Administration) Act 1999, so far as it relates to the Secretary
33
becoming satisfied of a matter, as mentioned in that section,
34
after 14 October 2008.

1223ABAAA Debts arising in respect of economic security strategy
2
payments
3
(1) If:
4
(a) an individual has been paid an economic security strategy
5
payment; and
6
(b) after the payment was made to the individual, a
7
determination in relation to the individual, at least so far as it
8
relates to 14 October 2008 or to a period that includes that
9
day, is or was (however described) changed, revoked, set
10
aside, or superseded by another determination; and
11
(c) the determination is one to which subsection (3) applies in
12
relation to the payment; and
13
(d) the decision to change, revoke, set aside or supersede the
14
determination is or was made for the reason, or for reasons
15
including the reason, that the individual knowingly made a
16
false or misleading statement, or knowingly provided false
17
information; and
18
(e) had the change, revocation, setting aside or superseding
19
occurred on or before 14 October 2008, the payment would
20
not have been made;
21
the amount of the payment is a debt due to the Commonwealth by
22
the individual.
23
(2) If:
24
(a) an individual has been paid an economic security strategy
25
payment; and
26
(b) after the payment was made to the individual, a
27
determination in relation to the individual, at least so far as it
28
relates to 14 October 2008 or to a period that includes that
29
day, is or was (however described) changed, revoked, set
30
aside, or superseded by another determination; and
31
(c) the determination is one to which subsection (3) applies in
32
relation to the payment; and
33
(d) the decision to change, revoke, set aside or supersede the
34
determination is or was made for the reason, or for reasons
35
including the reason, that the individual knowingly made a
36
false or misleading statement, or knowingly provided false
37
information; and

(e) had the change, revocation, setting aside or superseding

occurred on or before 14 October 2008, the payment would

have been reduced;

the amount by which the payment would have been reduced is a
4
debt due to the Commonwealth by the individual.

(3) This subsection applies to:
6
(a) if the individual qualified for the payment because of
7
subsection 900(2)--a determination made under Part 3 of the
8
Administration Act because of which the individual was
9
receiving a payment of a kind referred to in paragraph
10
900(2)(a); and
11
(b) if the individual qualified for the payment because of
12
subsection 900(3)--a determination made under Part 3 of the
13
Administration Act because of which the individual was
14
receiving a payment of a kind referred to in paragraph
15
900(3)(b).
16
(4) If:
17
(a) an individual has been paid an economic security strategy
18
payment; and
19
(b) the individual qualified for the payment because of
20
subsection 900(4) in relation to having claimed a seniors
21
health card; and
22
(c) the individual knowingly made a false or misleading
23
statement, or knowingly provided false information, in
24
relation to the claim; and
25
(d) but for that statement or information, the payment would not
26
have been paid to the individual;
27
the amount of the relevant payment is a debt due to the
28
Commonwealth by the individual.
29
(5) Apart from section 1224AA, the other provisions of this Part under
30
which debts arise do not apply in relation to payments to which this
31
section applies.

4 Subsection 1231(1AA)

Repeal the subsection, substitute:
34
(1AA) However, the Secretary:
35

(a) must not make a determination that would reduce a payment

to nil if the reduction to nil would result in the person being
2
in severe financial hardship; and
3
(b) must not make a determination that would reduce (including
4
reduce to nil) an economic security strategy payment, unless
5
the person to whom the payment:
6
(i) is to be made; or
7
(ii) would, apart from the deduction, be made;
8
has requested that the Secretary determine under this section
9
the amount of a deduction that is to be made from the
10
payment.

(a) on 8 December 2008, or on such later date that the Secretary

considers to be the earliest date on which it is reasonably
27
practicable for the payment to be made; and
28
(b) in such manner as the Secretary considers appropriate.

118ZZQ Eligibility for economic security strategy payment

Eligible if this section applies
12
(1) A person is eligible for an economic security strategy payment if
13
subsection (2) or (3) applies to the person.
14
Eligible for certain payments
15
(2) This subsection applies to a person if:
16
(a) one of the following payments was payable to the person in
17
respect of 14 October 2008:
18
(i) a service pension;
19
(ii) an income support supplement;
20
(iii) a carer service pension that is payable as a result of the
21
operation of subclause 8(2) or (4) of Schedule 5; and
22
(b) that payment was payable because of a claim the person
23
made on or before 14 October 2008.
24
Eligible for seniors concession allowance
25
(3) This subsection applies to a person if:
26
(a) on 14 October 2008, the person was eligible for seniors
27
concession allowance under section 118PA; or
28
(b) both:

(i) on or before 14 October 2008, the person made a claim
1
for a seniors health card under Division 2 of Part VIIC
2
and had not withdrawn that claim on or before
3
14 October 2008; and
4
(ii) on 14 October 2008, the person was eligible for the
5
card.

One payment under this section only
7
(4) A person cannot receive more than one payment under this section,
8
regardless of how many times the person becomes eligible under
9
this section.

118ZZR Amount of economic security strategy payment

The amount of a person's economic security strategy payment
12
under section 118ZZQ is the amount, specified in column 3 of the
13
following table, that corresponds to the family situation, specified
14
in column 2 of the table, that applied to the person on 14 October

If an individual is eligible for economic security strategy payment,
21
the Commission must pay the payment to the individual in a single
22
lump sum:
23
(a) on 8 December 2008, or on such later date that the
24
Commission considers to be the earliest date on which it is
25
reasonably practicable for the payment to be made; and
26

118ZZU Debts arising in respect of economic security strategy
2
payment
3
(1) This section applies in relation to an individual who has been paid
4
an economic security strategy payment (the relevant payment)
5
under this Part.
6
(2) If the individual was eligible for the relevant payment because of
7
subsection 118ZZQ(2), a relevant determination is a determination
8
made under Part III or Part IIIA because of which the payment
9
referred to in paragraph 118ZZQ(2)(a) was payable.
10
(3) If the individual was eligible for the relevant payment because of
11
subsection 118ZZQ(3) and because of holding or having held a
12
seniors health card, a relevant determination is a determination
13
made under this Act because of which the person became the
14
holder of the card.
15
(4) If:
16
(a) after the relevant payment was made to the individual, a
17
relevant determination in relation to the individual, at least so
18
far as it relates to 14 October 2008 or to a period that
19
includes that day, is or was (however described) changed,
20
revoked, set aside or superseded by another determination;
21
and
22
(b) the decision to change, revoke, set aside or supersede the
23
relevant determination is or was made for the reason, or for
24
reasons including the reason, that the individual knowingly
25
made a false or misleading statement, or knowingly provided
26
false information; and
27
(c) had the change, revocation, setting aside or superseding
28
occurred on or before 14 October 2008, the relevant payment
29
would not have been made;
30
the amount of the relevant payment is a debt due to the
31
Commonwealth by the individual.
32
(5) If:
33
(a) after the relevant payment was made to the individual, a
34
relevant determination in relation to the individual, at least so
35
far as it relates to 14 October 2008 or to a period that
36

includes that day, is or was (however described) changed,
1
revoked, set aside or superseded by another determination;
2
and

(b) the decision to change, revoke, set aside or supersede the

relevant determination is or was made for the reason, or for
5
reasons including the reason, that the individual knowingly
6
made a false or misleading statement, or knowingly provided
7
false information; and
8
(c) had the change, revocation, setting aside or superseding
9
occurred on or before 14 October 2008, the relevant payment
10
would have been reduced;
11
the amount by which the relevant payment would have been
12
reduced is a debt due to the Commonwealth by the individual.
13
(6) If:
14
(a) an individual was eligible for the relevant payment because
15
of subsection 118ZZQ(3) and because of having claimed a
16
seniors health card; and
17
(b) the individual knowingly made a false or misleading
18
statement, or knowingly provided false information, in
19
relation to the claim; and
20
(c) but for that statement or information, the relevant payment
21
would not have been paid to the individual;
22
the amount of the relevant payment is a debt due to the
23
Commonwealth by the individual.
24
(7) If:
25
(a) an individual was eligible for the relevant payment because
26
of subsection 118ZZQ(3) and because of holding or having
27
held a gold card; and
28
(b) the individual knowingly made a false or misleading
29
statement, or knowingly provided false information, that
30
resulted (directly or indirectly) in the individual becoming
31
the holder of the gold card; and
32
(c) but for that statement or information, the relevant payment
33
would not have been paid to the individual;
34
the amount of the relevant payment is a debt due to the
35
Commonwealth by the individual.
36
(8) The other provisions of this Act under which debts arise do not
37
apply in relation to payments to which this section applies.

Division 1--Entitlements in respect of eligible children
3
89 When is an individual entitle d to an economic security strategy
4
payment to families?
5
(1) An individual (the entitled individual) is entitled to an economic
6
security strategy payment to families if subsection (2), (3), (4), (5),
7
(6), (7) or (8) applies to the individual.
8
FTB category
9
(2) This subsection applies to the individual if:
10
(a) in relation to 14 October 2008, a determination under
11
section 16 of the Family Assistance Administration Act was
12
in force in respect of the individual as a claimant; and
13
(b) the rate (the applicable rate) of family tax benefit payable
14
under the determination in relation to 14 October 2008
15
consisted of or included a Part A rate greater than nil worked
16
out taking into account one or more FTB children.
17
(3) This subsection applies to the individual if:
18
(a) in relation to 14 October 2008, a determination under
19
section 17 of the Family Assistance Administration Act was
20
in force in respect of the individual as a claimant; and
21
(b) the determination was made as a result of a claim made in the
22
2008-09, 2009-10 or 2010-11 income year; and
23
(c) if the claim was made in the 2008-09 income year--the rate
24
(the applicable rate) of family tax benefit payable under the
25
determination in relation to 14 October 2008 consisted of or
26
included a Part A rate greater than nil worked out taking into
27
account one or more FTB children; and
28
(d) if the claim was made in the 2009-10 or 2010-11 income
29
year:
30
(i) the individual has satisfied the FTB reconciliation
31
conditions under section 32B of the Family Assistance
32
Administration Act for all of the same-rate benefit
33
periods in the 2008-09 income year; and
34

(ii) the rate (the applicable rate) of family tax benefit that
1
was payable under the determination after the individual
2
satisfied those conditions, and that was payable in
3
relation to 14 October 2008, consisted of or included a
4
Part A rate greater than nil worked out taking into
5
account one or more FTB children.
6
(4) This subsection applies to the individual if:
7
(a) in relation to 14 October 2008, a determination under
8
section 18 of the Family Assistance Administration Act was
9
in force in respect of the individual as a claimant; and
10
(b) the determination was made as a result of a claim made in the
11
2008-09 income year or a later income year; and
12
(c) the rate (the applicable rate) of family tax benefit payable
13
under the determination in relation to 14 October 2008
14
consisted of or included a Part A rate greater than nil worked
15
out taking into account one or more FTB children.
16
Youth allowance category
17
(5) This subsection applies to the individual (the recipient) if the
18
recipient has been paid an instalment of youth allowance in relation
19
to which the following conditions are satisfied:
20
(a) the instalment was in respect of a period that included
21
14 October 2008;
22
(b) the instalment was of another individual who, on 14 October
23
2008, was under 25 years of age and was not independent
24
(within the meaning of Part 3.5 of the Social Security Act
25
1991);
26
(c) the instalment was paid to the recipient:
27
(i) on behalf of the other individual in accordance with
28
subsection 45(1) of the Social Security (Administration)
29
Act 1999; or
30
(ii) as payment nominee in accordance with Part 3A of the
31
Social Security (Administration) Act 1999.
32
ABSTUDY category
33
(6) This subsection applies to the individual if:
34
(a) the whole or a part of an instalment under the scheme known
35
as the ABSTUDY scheme that includes an amount identified
36

as living allowance was paid in respect of a dependent

student; and
2
(b) the instalment was in respect of a period that included
3
14 October 2008; and
4
(c) on 14 October 2008, the student was a dependent student
5
under the scheme and was under 25 years of age; and
6
(d) on 14 October 2008, the individual was a parent or guardian
7
of the student; and
8
(e) the individual is either:
9
(i) the parent or guardian to whom the whole or part was
10
paid; or
11
(ii) if no amount of the instalment was paid to a parent or
12
guardian of the student and no amount of the instalment
13

(a) the instalment was in respect of a period that included

14 October 2008;

(b) the instalment was of the individual who, on 14 October
7
2008, was under 25 years of age and was not independent
8
(within the meaning of Part 3.5 of the Social Security Act
9
1991).

ABSTUDY category
11
(3) This subsection applies to the individual if:
12
(a) the whole or a part of an instalment under the scheme known
13
as the ABSTUDY scheme that includes an amount identified
14
as living allowance was paid to the individual as a dependent

student; and

(b) the instalment was in respect of a period that included

14 October 2008; and

(c) on 14 October 2008, the individual was a dependent student

under the scheme and was under 25 years of age.

(a) if the relevant payment was made because, at that time,

subsection 89(2) of the Family Assistance Act applied to the

recipient--the determination referred to in paragraph

89(2)(a) of that Act;

(b) if the relevant payment was made because, at that time,

subsection 89(3) of the Family Assistance Act applied to the

(1)
Subject to this item, a Minister administering the A New Tax System
7
(Family Assistance) Act 1999, the Social Security Act 1991 or the
8
Veterans' Entitlements Act 1986 may, by legislative instrument,
9
determine a scheme under which economic security strategy payments
10
may be made to persons in particular circumstances. The Minister may,
11
by legislative instrument, vary or revoke the scheme.
12
(2)
The circumstances in which the scheme provides for payments must be
13
circumstances:
14
(a) in which the Minister considers that Part 6 of the A New Tax
15
System (Family Assistance) Act 1999, Part 2.17 of the Social
16
Security Act 1991 or Part VIIG of the Veterans' Entitlements
17
Act 1986 does not produce appropriate results; and
18
(b) occurring in the financial year starting on 1 July 2008.

Without limiting the generality of subitem (1), the scheme may deal
20
with the following:
21
(a) the circumstances in which payments are to be made;
22
(b) the amount of the payments;
23
(c) what a person has to do to get a payment;
24
(d) debt recovery;
25
(e) administrative matters, such as determination of entitlement

and how and when payments will be made.
